Section 1. t\o building or structure shall be erected, placed
or constructed within or closer than 3 feet of or to the South property
line of any property abutting on Sixth Street in the City of Beaumont on the
:North side of said Sixth. Street betweenO1!aflge .Avenue on the East and
gl i•+vmerto. • Avenue on tfie West; end it shall ha unlawful to erect, construct
or pla r e any building or structure within said setback line hereby established;
and no permit shall be issued for construction within such setback line.
Section 2. IRc building or structure shall be erected, placed or
ccnstructed within or closer than 3 feet of or to the north property
line of any property abutting on Sixth Street in the City of Peaum_ort on the
south side of said Sixth Street between O •fl Avenue on the East and
a_d� Avenue on the west; and it stall he unlawful to erect, construct or
ny building or structure within said setback line hereby established;
and no permit shall be issuedfor construction within such setback line.
Section 3. Violation of this ordinance is hereby declared to
Le a misdeneancr, and shall be punished by imprisonment not exceeding sixty
clays, or fine not exceeding 4300.00, or both.
Section_ 4. This ordinance is hereby declared to be an emergency
ordinance necessary to the pixblic interest, health, comfort, convenience,
preservation of pablie peace, safety, morals, order, and the public welfare,
and shall take effect immediately tion adoption.
The following is a statement of the farts constituting such urgency:
Said Sixth Street in the City of Beaumont is a portion of the State
;;iighway of the State of California constructed through the City of Beaumont
during the years 1939 and 1940 at which time said Sixth Street was widened and
said stelte highway took all the space between the sidewalks and curbs for
highway right of way leaving a ver,' narrow and inadequate space for sidewalks for
the use of pedestrians, and if the biildin.gs are built to the property line there
will not be sufficient space for adquate sidewalks for the use of pedestrians,
end it is herefore necessary* that all buildings erected in the future be set
back the distance mentioned in this ordinance in order to provide sufficient
space for the safety of pedestrians; and because of the fact a great many huildin
are being planned for construction on Sixth Street immediately, and unless this
ordinance is adopted as an emergency ordinance the put:;li c will be harmed.
25 Section 5. The City Clerk sl all certifyto the passage or this
ordinance and shall cause it t::o Le pub 1shed once in the Beaumont Gazette,
26 a newspaper of general circulati on published, printed and circulated in Beaumont,
California, and it shall take effect ineredaistely upon adoption.
