ORDINANCE OF TIE CITY OF BEAULONT AUTHORIZING BY VOTE OF THE PEOPLE A PROPOSITION OF INCREASING TAX LEVY FOR PURPOLE OF FURNISHING GARBAGE ANTRUB.L.ISH DISPOSAL ERVICE WITHIN THE CITY OF BEAUMONT. WHEREAS, the public health of the inhabitants of the city of Beaumont requires the proper and sanitary collection and disposal of Garbage and rubbish within said City; and HEREAS, it has not been possible to obtain through private enter- prise, the proper and sanitary collection and disposal of garbage and rubbish in the City of Beaumont; and WHEREAS, the present revenuasof the City of Beaumont are insufficient to defray the cost and expense of the proper and sanitary collection and disposal of garbage and rubbish within said City, which cost and expense includes labor and equipment, and maintenance of such equipment from year to year; now, therefore THE PEOPLE OF THE CITY OF BEAULIONT DO ORDAIN AS FOLLOWS: SECTION 1. That the proposition bo subnitted to the voters of the City of Beaumont, of authorizing the City Council of the City of Beaumont to annually levy a tax upon the taxable propertywithin the City of Beaumont in the amount of Fifty Cents upon each one hundred dollars assessed value of such taxable property exclusive of ecured Personal Property and. Loney, for the purpose of defraying the cost and maintenance of equipment necessary therefor and expense of the collection and disposal of garbage and rubbish within the City of Beaumont by the City of Beaumont levy now permitted by law. in addition to the amount of tax SECTION 2. That a separate fund. which shall be known as "Garbage Disposal Fund" is hereby created provided this proposition is approved by a majority vote of the registered voters of the City of Beaumont. faECTION 3. That the rate shall be set each year by the City Council, not later than the last Tuesday in August as provided by law. Said rate to be decided after takinginto consideration any balance on hand in the "Garbage Disposal Fund" and in no case to exceed the amount of Fifty Cents per each One Hundred Dollar Asseased Value of such tax- able property exclusive of Secured Personal Property and Loney. SECTION 4. That this proposition shall be considered by the City Council, and submitted to the vote of the people for their approval or disapproval at the very earliest date possible. Proposition to appear on the ballot in approximately the following form, to wit: PROPOL:ITION NO.1 Shall ORDINMOE OF THE CITY OF BEAUMONT AUTHOR- IZING BY VOTE OF THE PEOPLE A PROPOSITION :YES: OF INCREASING TAX LEVY FOR PURPCkE OF . • FURNISHING GARBAGE AND RUBBISH DISPOSAL :NO : ERVICE 1',ITIIIN THE CITY OF :6E.AITIV ONT be adopted.: • SECTION 5, That the instructions to voters and manner of set up on the ballot of said proposition shall be as is provided by law. CTION 6. This Ordinance is presented. to the Beau:oiont City Council through an Initiative Petition, a4ned by the required fifteen per cent of the voters of the City, with, the request that tis ordinance be submitted to the voters of the City of Beaumont as soon as possible. If a majority of the voters voting on this Ordinance vote in favor of its adoption, then this ordinance shall become e valid and binding ordinance of the City of Beaumont. SECTION 7. The City Clerk shall certify to the adoption of this Ordinance, end shall cause the same to be published once in the Beaumont Gazette, a newspaper of general circulation, printed and published and circulated in the City of Beaumont, end it shall be in full force and effect immediately upon its adoption by a majority vote of the people* ADOPTED by the Beaumont City Council tLis 210. day of lita."4, 1946.
