WHEREAS, the City Council of the City of Beaumont, California, did on the 3rd day of September, 1947, by a vote of more than two-thirds of the members of said City Council, adopt Resolution No. (7.5� entitled "resolution of the City Council of the City of Beaumont, California, determining; and declaring that the public interest and necessity demand the acquisition and construction of certain municipal improvements, and making findings relating thereto," which said resolution was duly signed and approved by the Mayor of said City and attested and certified by the City Clerk of said City; NON, THEREFORE, the City Council of the City of Beaumont DOES ORDAIN as follows: Section 1. That a special election be held, and the same is hereby called to be held, in the City of Beaumont, California, on the 7th day of October, 1947, for the purpose of submitting to the qualified voters of said City two proposi- tions of incurring indebtedness and issuing bonds of said City tr-erefor., in the amounts hereinafter set forth, and for the objects and purposes set forth in said resolution and herein- after stated. Section 2. That the objects and purposes for which said indebtednesses are proposed to be incurred and bonds issued therefor are as follows: BOND PROPOSITION NO. 1: The acquisition and construction by the City of Beaumont of a certain municipal improve- ment, to wit: a drainage system for the drainage of storm and surface waters from the property used as a public park in 'Blocks 31, 40 and 55, City of Beaumont, and from other lands, property and streets near or adjacent thereto, including the acquisition of all pipe, culverts, manholes, material, equipment, apparatus, and Property necessary therefor. BOND PROPOSITION NO. 2: The acquisition and construction by the City of Beaumont of a certain municipal improvement, to wit: additions to and extensions of the municipal sanitary sewer system, consisting of the construction of trunk sewers, the reconstruction of portions of the sewage treatment plant, and the construction of additions thereto, and including the acquisition of all lands, rights of way, pipe, equipment, apparatus, and property necessary therefor. Section 3. That the estimated cost of the proposed municipal improvement described in Bond Proposition No. 1 of Section 2 hereof is the sum of eighteen thousand dollars (,48,000.00); that the amount of the principal of the 2. indebtedness to be incurred therefor is the sum of eighteen thousand dollars (13,000.00); and that the maximum rate of interest to be paid on said indebtedness shall not exceed four per cent (40) per annum, payable semiannually. That the estimated cost of the proposed muni- cipal improvement described in 7ond Proposition Tro. 2 of Section 2 hereof is the sum of sixty-five thousand dollars L65,000.00); that the amount of the principal of the indebtedness to be incurred therefor is the sum of forty- six thousand dollars (?46,000.00); and that the maximum rate of interest to be paid on said indebtedness shall not exceed four per cent (4A per annum, payable semiannually. That if any proposition for the incurring of bonded indebtedness so submitted receives the requisite number of votes, to wit, two-thirds of the votes of the qualified voters voting on said proposition, bonds of said City, in not exceeding the Principal amount stated in such proposition, shall be issued and sold for the objects and purposes set forth in said proposition. Section 4. That the rolls for said election shall be opened et seven o'clock, A.., of the day of said election, and shall remain open continuously from said time until seven o'clock, P.-., of the same day, when said Polls be closed, except as provided in Section 5734 of the Llections Code of the State of California. That on the ballots to be used at said special 3. election, in addition to any other matters required by law, there shall be printed substantially the following: Mark crosses (x) on ballot ONLY '','vITH RUBBER STAMP; never with pen or pencil. (A,.DS12IT EE BALLOTS may be marked with PEN AlD INK OR PENCIL.) INSTRUCTIONS TO VOTERS. To vote on any measure, stamp a cross (X) in the voting square after the word "Yes" or after the word "LTc". All marks, except the cross (X), are forbidden. p11 distinguishing; marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear, or deface this ballot, return it to the inspector of election and obtain another. A cross CO stamped in the voting square after the word "YES" shall be counted in f avor of the adoption of a question or ;:proposition. A cross (X) stamped in the voting square after the word "NO" shall be counted against the adoption of a question or proposi- tion. Section 5. That said City shall constitute one precinct for the purpose of holding said election; that the polling.; place for said precinct shall be the place hereinafter designated, and that the persons here- inafter named, being competent and qualified electors and residents of said City and precinct, are hereby appointed officers of election for said precinct and they shall hold s aid. election and make return thereof in the manner provided by law. That in all particulars not recited in this ordinance, said election shall be held and con- ducted as provided by law for holding municipal elections in said City. Section 7. That the City Council of said City shall meet at its usual place of meeting in the City Hall on Tuesday, the 14th day of October, 1947, at 7:30 o'clock, 5. P. M., cf said day, and proceed to canvass the election returns and declare the result of said election. Section 8. That the City Clerk shall certify to the Passage and adoption of this ordinance by a vote of two-thirds of all of the members of the City Council of said City at a regular neetinc of said Council, and its approval by the Mayor of said City, and shall cause said ordinance to be published once a week for two (2) weeks in THE EAUMONT GAZETTE, a weekly newspaper of 7eneral circu- lation in said City. No other notice of such election need be given. Section 9. This ordinance shall take effect upon its passage. ADOPTED, SIGNED AND APPROVED this 10th day of September, 1947.
