ORDINANCE NO. 38
AN ORDINANCE LEVYING AND ASSESSING
SPECIAL ASSESSMENTS ON CERTAIN LOTS,
PIECES AND PARCELS OF LAND LIABLE FOR
SUCH ASSESSMENTS TO PAY THE COSTS OF
CERTAIN INTERNAL IMPROVEMENTS IN THE CITY
OF BEL AIRE, KANSAS, AS HERETOFORE
AUTHORIZED BY RESOLUTIONS NOS. 82-6,
82-7, 82-8, AND 82-9 OF THE CITY; AND
PROVIDING FOR THE COLLECTION OF SUCH
SPECIAL ASSESSMENTS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL
AIRE, KANSAS:
SECTION 1. For the purpose of paying the costs of the
following described improvements in the City:
Water Works System Extensions, Phase I,
in Kappelman's Bel Aire Heights, an
addition to Sedgwick County, Kansas;
as heretofore authorized by Resolution No. 82-6 of the City of
Bel Aire, Kansas, there are hereby levied and assessed against
the properties liable therefor the several amounts set forth
following the description of each lot, piece or parcel of land
on Exhibit A to this Ordinance.
SECTION 2. For the purpose of paying the costs of the
following described improvements in the City:
Street improvements, Phase I in
Kappelman's Bel Aire Heights;
as heretofore authorized by Resolution No. 82-7 of the City of
Bel Aire, Kansas, there are hereby levied and assessed against
the properties liable therefor the several amounts set forth
following the description of each lot, piece or parcel of land
on Exhibit B to this Ordinance.

SECTION 3. For the purpose of paying the costs of the
following described improvements in the City:
Dam, lake, floodway and miscellaneous
storm drainage in Kappelman's Bel Aire
Heights.
as heretofore authorized by Resolution No. 82-8 of the City of
Bel Aire, Kansas, there are hereby levied and assessed against
the properties liable therefor the several amounts set forth
following the description of each lot, piece or parcel of land
on Exhibit C to this Ordinance.
SECTION 4. For the purpose of paying the costs of the
following described improvements in the City:
Sanitary Sewer Extensions, Phase I, in
Kappelman's Bel Aire Heights.
as heretofore authorized by Resolution No. 82-9 of the City of
Bel Aire, Kansas, there are hereby levied and assessed against
the properties liable therefor the several amounts set forth
following the description of each lot, piece or parcel of land
on Exhibit D to this Ordinance.
SECTION 5. The amounts so levied and assessed as set forth
in the foregoing Sections of this Ordinance, including Exhibits
A, B, C and D hereto, shall be due and payable from and after
the date of publication of this Ordinance: and the City Clerk
shall notify the owners of the above described properties,
insofar as known to said City Clerk, of the amounts of their
respective assessments: and, said notice shall further state
that bonds will be issued therefor. The City Clerk shall
certify to the County Clerk, in the same manner and at the same
time as other taxes are certified, for a period of fifteen (15)
years, all of the above assessments, together with interest on
such amount thereof at a rate not exceeding the maximum rate
therefor as prescribed by the laws of the State of Kansas: and
such amounts so certified shall be placed on the tax rolls and
shall be collected as other taxes are collected over said period
of fifteen {IS) years, the levy for each year being for
one-fifteenth (1/15th) of the p.rincipal amount of the assessment
plus one (1) year's interest on the amount remaining unpaid.
SECTION 6. This Ordinance shall take effect and be in
force from and after its passage, approval and publication once
in the official city newspaper.
