Savannah Beach, Georgia

The Regular Monthly Meeting of Savannah Beach City Council was
had this afternoon at 3:00 P.M. in the Council Room at City Hall
and was presided over by Mayor M. J. Counihan with the following
members of Council presents Edward Towns, Perry Zittrauer, George
Schwarz, James Stettler and Edward Jung. City Attorney Bart Shea
was also present. Councilman Cary was granted an excused absence
and was not present at the Meeting.
The Minutes of the Meetings of May 24, 1972; July 19, 1972; and
August 16, 1972 were approved as written.
City Attorney Bart Shea read a Certification of the Second Special
run -off election for Mayor and Councilmen of the City of Savannah
Beach made by the Honorable Ben P. Axson, Election Superintendent,
which showed that Mr. William Allen Hendrix had received the
highest number of votes cast for any candidate for Mayor of the
City of Savannah Beach and that Ernest Hosti, Walter Parker,
Edward W. Towns, Edward Jung, Earl Anderson and Perry Zittrauer,
Jr. had received the highest number of votes for the six offices
of Councilmen.
CERTIFICATION OF ELECTION RESULTS
City Attorney Bart Shea continued stating that in conjunction with
this Certification there was also a Resolution which should be
adopted by Council, declaring the Mayor and Councilmen as certified
by Election Superintendent Ben Axson, duly elected. Attorney Shea
then read the Resolution.
RESOLUTION
Councilman Edward Towns moved that the Certification of the results
of the Ordered Special Second Election as made by Mr. Ben Axson,
Election Superintendent, be adopted by Council. This motion was
seconded by Councilman Zittrauer and unanimously carried.
Councilman Zittrauer then moved that Council adopt the Resolution
certifying the results of the election. This motion was seconded
by Councilman Stettler and unanimously carried.
City Attorney Bart Shea stated that he would read a letter from
Attorney R. B. Donaldson, Jr., regarding a claim for damages
against the City which had been filed by Mr. Franklin Kohel due
to injuries which he claims were inflicted upon him by Officer
James Bond of the Savannah Beach Police Department, without cause
or justification. Attorney Shea stated that he had thoroughly
investigated this shooting and advised the Mayor and Council to
reject this claim. Councilman Zittrauer moved that the claim be
denied and Mr. Kohel's attorney be so notified. Councilman Ed.
Towns seconded the motion and it was unanimously carried.

Councilman Zittrauer informed Council that Mrs. Lucy Patterson
who is our Recreation Director and also is in charge of our.
Ceramics Program, has been using her auto for the past two years
to haul ceramics greenware and supplies and has asked him to
request permission from Council to use the City's Toyota pick -up
on Wednesday and Thursday of each week. Councilman Zittrauer
put this in the form of a motion and it was seconded and unanimously
approved.
Councilman George Schwarz made an appeal to everyone involved in
the City government - -old Councilmen and new Councilmen - -to try to
work together for the best interest of Savannah Beach in an effort to
make our City a better place in which to live.
There being no further business, the meeting was adjourned to the
next regular or special called meeting.

R E S O L U T I O N
WHEREAS, on August 4, 1970, the Chief of Police as Ex- Officio
Tax Collector of Savannah Beach, Tybee Island, Chatham County,
Georgia conveyed to the City of Savannah Beach certain property
known as Lot 34, Pamela Terrace Subdivision, Chatham County,
Georgia, for past due taxes amounting to $11.32 due the City of
Savannah Beach for the year 1969, by Helen and John E. Kuhne; and
WHEREAS, Helen Kuhne is now deceased and the present rightful
owner, John E. Kuhne has redeemed said property by paying $31.77
representing all taxes due the City of Savannah Beach for the
years 1969 through 1972, together with all costs attendant to
said tax sale pursuant to authorization of the Mayor and
Councilmen of the City of Savannah Beach on August 16th. 1972; and
WHEREAS, by virtue of said redemption the said JOHN E. KUHNE by
virtue of aforesaid payment, is entitled to a Quit Claim Deed for
said property, he being the rightful owner thereof.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCILMEN OF THE
CITY OF SAVANNAH BEACH, IN COUNCIL ASSEMBLED THAT said property
known as Lot 34, Pamela Terrace Subdivision, Savannah Beach, Tybee
Island, Chatham County, Georgia, is hereby quitclaimed to the said
JOHN E. KUHNE as the rightful owner thereof and the MAYOR of the
CITY OF SAVANNAH BEACH is hereby authorized and directed to execute
a Quit Claim Deed to the said JOHN E. KUHNE to carry out the purposes
of this Resolution.
