HomeMy Public PortalAbout19721018CCMeeting1 1 1 Savannah Beach, Georgia October 18, 1972 The regular monthly meeting of Savannah Beach City Council was held at 3:00 P.M. today with Mayor Wm. Allen Hendrix presiding and the following councilmen in attendance: Edward Jung, Earl Anderson, Walter Parker, Edward Towns, Perry Zittrauer and Ernest Hosti. City Attorney Bart Shea and Police Chief John Price wer also in attendance. Visitors at the meeting were Mrs. Louise Hauser, Mre. Alice Cordray, Mrs. George McDonald, Mrs.& Mrs. Vincent, Mr. James L. Fabrikant and Mrs. Irene Brown and Mrs. Evelyn Butler. Following the reciting of the Pledge of Allegiance to the Flag, the meeting was formally opened by Mayor Hendrix. Mrs. Louise Hauser presented council with a petition signed by thirty - seven residents protesting whet they termed as a rumored change in the zoning of certain property in the area, of Fourteenth and Chatham Avenue from R -2 to C -1 or Commercial. Mrs. Hauser stated that even though this was still in the rumor stage, her group wanted to go on recodd as protesting the change before anything further developed. After further discussion, Mayor Hendrix stated that he would appoint a committee to look into this and report back to Council. Councilman Earl Anderson informed Council that Mr. Head, who owned the marina at the corner of Fourteenth and Chatham Avenue, purchased this property not knowing it was zoned residential and that his marina was a non- conforming use in that area and that it was his desire to try to get his marina re -zoned so that he oould make certain repairs and renovations to it. Mayor Hendrix told Mrs. Hauser and the other members of her group present, that this would be thoroughly investigated. The Minutes of the following meetings were approved as written: September 20, 1972 (Regular Meeting) September 20, 1972 (Special Meeting) October 4, 1972 (Special Meeting) October 12, 1972 (Special Meeting) Bills for the various departments were approved for payment. COMMUNICATIONS: Under communications, the Clerk read a letter from the Department of Housing and Urban Development, requesting a return of the Planning Advance Money-in the amount of $5,300.00. In Mayor Hendrix's reply,rread by the Clerk, only $3,164.18 was returned because the project consistsoof: 9 10 TREATMENT PLANT $1,240,000 SEWAGE PUMPING SYSTEM 510,000 COLLECTION SYSTEM 327,000 and to date, no offer has been made by HUD for either the Sewage Pumping System or the Collection System. Councilman:Ear1 Anderson, Chairman of the Sewer and Water Committee, gave a progress report on the construction of the Sewage Treatment Plant. It reflected good progress being made by Eastern Construction Company. For the information of Council, Mayor Hendrix requested the Clerk to read a letter addressed to Mr. John Blackmon, Revenue Commissioner of the State of Georgia from City Attorney Bart Shea, outlining the various steps that have been taken by the City of Savannah Beach governing authority to assure compliance with all state laws, rules and regulations regarding the sale of alcoholic beverages. Mr. Shea stated further in his letter that the Mayor and Council would appreciate an early meeting with him in an effort to expedite the removal of the blanket suspension of liqudr licenses. Councilman Zittrauer requested the use of the old convict camp building, formerly used by Gentle Haven Home for Retarded Children or a part of the building for the rapidly growing ceramics classes. Councilman Zittrauer was reminded that the City was, at the present, time, dickering with the Savannah Bar Pilots Association to sell this building. €ounciVman Zittrauer's request was, therefore, deferred to a later time. Finance Chairman Edward Jung informed Council that preparations were being made for a tax sale to Fi Fas 1970 and 1971 delinquent taxes. He stated that the advertisement would run November 7th, 14th, 21st and 28th and the sale would be held on the first Tuesday in December, that being December 5th. Council was informed by City Attorney Bart Shea that from time to time when it was necessary for him to be absent from Court'or Council Meeting, it was also necessary for him to get a substitute who for the most part was inexperienced, He.ttAted that he felt, therefore, it would be to the best advantage of the ,City to use the same person whenever someone was needed for Recorder Pro -Tem or City Attorney. Attorney Shea further stated that it would be his recommendation to use Mr. Lionel E. Drew, Jr., a law partner of his who was entirely familiar with these positions and handled them well. He then read a Resolution which,if adopted by Council, would make Mr. Lionel Drew Assistant City Attorney and,.Re.ord@r,Pro -Tem and clothe him with all of the rights, powers, duties and privileges which were now vested in himself: R E S O L U T I O N 1 1 1 1 Councilman Parker moved theagdoption of this Resolution. The motion was seconded by Councilman Jung and unanimously carried. Mayor Hendrix called a Special Meeting of Council to be held following this meeting for the purpose of discussing the offer made by Mr. Dave Williams and a group of investors from Myrtle Beach, S. C. to purchase the Tybrisa property and making a counter offer to them; also for appointing the various city officials for the ensuing administration. There being no further business, the meeting was adjourned to the Special Called Meeting which would follow a short recess. CLERK OF COUNCIL 11. 12 1 1 1 1 R E S O L U T I O N BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, IN COUNCIL DULY ASSEMBLED, AND IT IS HEREBY RESOLVED AS FOLLOWS: WHEREAS, Bart E. Shea is the appointed City Attorney as well as the appointed Recorder of the Municipality and of the Recorder's Court of the City of Savannah Beach, Tybee Island, Georgia, presides weekly on each Monday evening as Judge of said Court during the summer months and presides weekly every other Monday evening as Judge of said Court during the winter months; and WHEREAS, Said Recorder is required to be absent and away from the City on various occasions throughout the year, such absences occurring on Monday evenings when Court is scheduled to be held; and WHEREAS, said Recorder is also absent from the City on vacations; trying cases in Court before juries; when his presence is required at City Council Meetings; attending to the legal business of the municipality; etc.; and WHEREAS, it would be beneficial for the Municipality and the Mayor and Council of the City of Savannah Beach, Tybee Island, Georgia to appoint a Recorder Pro -Tem to serve in the absence of the said Bart E. Shea in his capacity as City Attorney and as Recorder of the Recorder's Court of the Municipality; and WHEREAS, the Mayor and Council desire by this Resolution to appoint Lionel E. Drew, Jr., the law partner of the appointed City Attorney and Recorder of the City of Savannah Beach, Tybee Island, Georgia as Recorder Pro -Tem to act in such capacity as City Attorney and Recorder in the absence of the said Bart E. Shea. NOW, THEREFORE, BE IT RESOLVED AND IT IS HEREBY RESOLVED UNDER THE AUTHORITY OF THE FOREGOING AS FOLLOWS: 1. The Mayor and Council of the City of Savannah Beach, Tybee Island, Georgia do hereby appoint Lionel E. Drew, Jr., as Recorder Pro -Tem and Assistant City Attorney of the Recorder's Court of the Municipality and of the City of Savannah Beach, Tybee Island, Georgia respectively, and do hereby authorize the said Lionel E. Drew, Jr. to exercise all of the rights, powers, duties and privileges granted to the said Bart E. Shea in the normal course and conduct in his capacity as Recorder Pro -Tem and Assistant City Attorney of the Municipality.
