A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD,
COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING
THE EXTENSION OF TEMPORARY OUTDOOR DINING THROUGH
JUNE 30, 2022
WHEREAS, international, national, state, and local health and governmental
authorities are responding to a pandemic outbreak of a respiratory disease caused by a
novel coronavirus now known as COVID-19; and
WHEREAS, on March 4, 2020, California Governor Gavin Newsom proclaimed a
"state of emergency" throughout the State in response to COVID-19, and in furtherance
of this proclamation has issued several Executive Orders that include extraordinary
measures directed at slowing the spread of COVID-19 and reducing impacts to residents
and businesses; and
WHEREAS, since the initial declaration of a "state of emergency" Governor
Newsom has issued additional Executive Orders in an effort to address the circumstances
surrounding the impacts created by COVID-19; and
WHEREAS, on March 16, 2020, the City Council of the City of Lynwood adopted
Resolution No. 2020.041, which confirmed the existence of a local emergency related to
the COVID-19 Pandemic to allow prompt response to emergency conditions at the local
level, and provide the City access to federal, state, and local resources during the crisis;
and
WHEREAS, City staff created a Special Permit to allow for temporary outdoor
dining to allow for restaurants to remain partially open during the pandemic; and
WHEREAS, in June 2020, the City of Lynwood ("City") allowed restaurants with
access to private sidewalks and/or private parking lots to utilize portions of those areas
for temporary outdoor dining during the shutdown; and
WHEREAS, since its inception, there have been 8 applications for temporary
outdoor dining received and approved by the City of Lynwood; and
WHEREAS, on June 15, 2021, the State lifted its COVID-19 business restrictions,
and City's emergency declarations terminated on July 15, 2021; and
WHEREAS, it is the City's intent to facilitate the establishment of a greater level of
permanent outdoor dining for restaurants on commercial property; and

WHEREAS, City staff recommends extending the temporary allowance of outdoor
dining through June 30, 2022. Prior to the expiration of such temporary outdoor dining,
City staff intends to formalize a program allowing for permanent outdoor dining for the
City Council of the City of Lynwood's consideration.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS:
Section 1. The City Council of the City of Lynwood hereby finds and determines that
all of the foregoing recitals are true and correct and are incorporated herein by reference.
Section 2. The City Council of the City of Lynwood herby approves the authority of
restaurants to acquire a Special Permit to allow for temporary outdoor dining on private
sidewalks and parking lots through June 30, 2022, on the condition that the restaurant
has a valid City of Lynwood Business License and is in compliance with all ordinances of
the City, County and laws of the State. •
Section 3. The City Council of the City of Lynwood hereby approves the continued
temporary outdoor dining for those restaurants who have already acquired a Special
Permit for said use through June 30, 2022, on the condition that the restaurant has a valid
City of Lynwood Business License and is in compliance with all ordinances of the City,
County and laws of the State.
Section 4. The City Council of the City of Lynwood directs the City Manger to formalize
a new comprehensive outdoor dining program, with the intent that such new program_will
be permanent, to be brought back for the City Council's consideration prior to June 30,
2022 deadline.
Section 5. The City Council of the City of Lynwood finds that this Resolution is
categorically exempt from CEQA under CEQA Guidelines Sections 15301 (existing
facilities).
Section 6. The City Clerk shall certify to the adoption of this resolution and hereafter the
same shall be in full force and effect.
