AN ORDINANCE OF THE CITY OF McCALL, A MUNICIPAL CORPORATION OF THE
STATE OF IDAHO, VALLEY COUNTY, IDAHO AMENDING ORDINANCE NO. 912
McCALL CITY CODE, TO PROVIDE FOR AMENDMENTS TO TITLE 5 CHAPTER 8
SECTION 5, REQUIRING BEAR -PROOF CONTAINERS FOR ALL SOLID WASTE,
GARBAGE OR REFUSE PLACED OUTSIDE A SECURE ENCLOSED STRUCTURE, AND
PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF
THE CITY OF McCALL, IDAHO, AS FOLLOWS:
SECTION 1. That section 05 of Chapter 8 of Title 5 of the McCall City Code, be, and the
same is hereby amended to read as follows:
5.08.05: REQUIRED BEAR -PROOF CONTAINERS: Within the city limits of the City of
McCall each owner, lessor/lessee, or manager of commercial or residential real property who
subscribes to Solid Waste collection services from the Approved Waste Management Contractor
must either purchase from any source, or lease a bear -proof Solid Waste container from the
Approved Waste Management Contractor. Any nonsubscriber of Solid Waste collection services
shall provide for the proper storage and disposal of all Solid Waste, Garbage, or Refuse on their
premises. It is unlawful for any owner, lessor/lessee, or manager to place Solid Waste, Garbage,
or Refuse in a container which is not an approved and properly secured and latched bear -proof
container, unless such solid waste is placed in a secure and enclosed structure, or otherwise
personally attended. This Section shall not be construed to require more than one Container per
mailing address. Owners or managers of multifamily or multitenant properties may lease a bear -
proof Solid Waste container under this Section, and provide the same for all tenants, whe which
will satisfy the requirements of this Section for a given property and occupants thereof. Any
container leased for a property pursuant to this section must be of sufficient size to reasonably
accommodate all Solid Waste created by the activities upon such property during any given one -
week period.
SECTION 2. That this Ordinance shall take effect on July 1, 2013.
SECTION 3. If any provisions of this Ordinance shall be deemed illegal or
unenforceable, such determination shall not operate to invalidate the remaining provisions of this
Ordinance.

This ordinance in particular amends Ordinance No. 912 to provide for amendments to Title 5
Chapter 8 Section 5 to require bear -proof containers for proper disposal of any solid waste,
garbage, or refuse that is placed outside a secured enclosed structure.
This ordinance is effective on July 1, 2013
