AN ORDINANCE OF THE CITY OF McCALL, A MUNICIPAL CORPORATION OF THE
STATE OF IDAHO, VALLEY COUNTY, IDAHO REPEALING SECTION 6 OF TITLE 5
CHAPTER 8 PENALTIES OF McCALL CITY ORDINANCE NO. 912 AND RE-ENACTING
A NEW SECTION 6 OF TITLE 5 CHAPTER 8 RIGHT TO PURCHASE CONTAINER OF
McCALL CITY CODE TITLE 5 CHAPTER 8 SECTION 6 AND PROVIDING AN
EFFECTIVE DATE.
SECTION 1. That Section 06 of Chapter 8 Title 5 of the McCall City Code is hereby repealed in
its entirety
SECTION 2. That Section 06 of Chapter 8 Title 5 is hereby reenacted to read as follows:
5.08.06: RIGHT TO PURCHASE CONTAINER: Any person, firm, partnership, association,
corporation, company, or organization of any kind, including any owner, occupant, lessee, or
tenant of a premise has the right to purchase from any source a bear -proof Solid Waste container
that is the same brand name and model(s) used by the Approved Solid Waste Management
Contractor. The Approved Solid Waste Management Contractor and the City of McCall shall
not be liable for any theft, loss, or any kind of damage that may occur to any bear -proof Solid
Waste container that is not leased from the Approved Solid Waste Management Contractor.
Before providing services to a subscriber who has chosen to purchase their own container, the
Approved Solid Waste Management Contractor may, in its discretion, require that subscriber
release the contractor in writing from any and all damages to the container that may occur.
SECTION 3. That this Ordinance shall take effect on July 1, 2013.

AN ORDINANCE OF THE CITY OF McCALL, A MUNICIPAL CORPORATION OF THE
STATE OF IDAHO, VALLEY COUNTY, IDAHO REPEALING SECTION 6 OF TITLE 5
CHAPTER 8 PENALTIES OF McCALL CITY ORDINANCE NO. 912 AND RE-ENACTING
A NEW SECTION 6 OF TITLE 5 CHAPTER 8 RIGHT TO PURCHASE CONTAINER OF
McCALL CITY CODE TITLE 5 CHAPTER 8 SECTION 6 AND PROVIDING AN
EFFECTIVE DATE.
This ordinance in particular repeals Title 5 Chapter 8 Section 6 of Ordinance No. 912 to provide
for a new Section 6 to be known as Right to Purchase Container, which allows owners,
occupants, lessees or tenant or any entity to purchase a bear -proof solid waste container of the
same brand name and model that would be used by the Approved Solid Waste Management
Contractor. Additionally, this ordinance provides for the acknowledgment and release of the
Approved Solid Waste Management Contractor and the City of McCall from any liability related
to damage, loss, theft, destruction, of purchased containers.
This ordinance is effective on July 1, 2013
