HomeMy Public PortalAboutOrdinance 256ORDINANCE NO. 256 AN ORDINA'dCE OF THE CITY COUNCIL OF THE CITY OF BEAU- MONT APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY GENERALLY KNO `va' V AS THE ANNEXATION OF THAT CERTAIN DUMP SITE PND SEVER PLANT. WHEREAS, on the 14th day of February, 1951, the City Coun- cil of the City of Beaumont, California, did, by its own motion, initiate proceedings to annex the uninhabited territory men- tioned herein without requiring a petition therefor, for the reason that said property was and is owned by said City of Beaumont, and at present is being used as a sewer disposal plant and is suitable for a public dump site, and for the fur- ther reason that said city desires to extend to said territory the protection of its police power and the right to exercise municipal jurisdiction thereover; and dHEREAS, the City Council of the City of Beaumont has made a complete investigation and report of the entire matter and proceedings, and did, on or about the 14th day of February, 1951, adopt a resolution proposing the annexation of the afore- said uninhabited territory, to be generally known as the "Annexation of Dump Site and Sewer Plant'; and WHEREAS, the said resolution did fix, determine and de- clare that a hearing would be held on the 14th day of March, 1951, at the hour of 7:30 o'clock P. M., in the Council Cham- bers in the City Hall of the City of Beaumont, which time and place were 'esignated where any person within such territory so proposed to be annexed and having any objection to the pro- posed annexation might object before the City Council and show cause why such territory should not be annexed to the City cf Beaumont; and YRE:- i AS, it was provided in said resolution that the said resolution should be published in the BEA'JOn1' GAZS1'TE, a newspaper of general circulation within the City of Beaumont, -1- ano_ that said resolution was thereafter so published in the LLAT iU I GAZLTTE, as mentioned, in a manner and form and in all other respects as provided oy law; and `a dHLi-tnAS, no oo jectioris or protests of any kind or na- ture wnatscever were made or filed, either written or oral, with said City Council of the City of '_ eaumont, and no pro- tests or oejections of any nature whatsoever were made, either written or oral, at the meeting of the City Council } of the City of Eeaumont on the 14th day of March, 1951, as nereina,eve mentioned, at which meeting the City Council publicly announced that any person, firm or corporation de- siring to protest or object to said annexation might do so at said meeting; and WHEREAS, it appears to the City Council of the City of ieaumont that ehe aforesaid annexation proceedings have been completed and everything performed at this time in accordance with the .nrovisions of Section 35300 et seq. of the Govern- ment Code of the State of California, as amended, and any and all other laws in any way connected. withsaid annexation procedure have been complied with; and WHEREAS, the City Council cf the City of-9eaumont de- sires to approve at this time the annexation of the afore- said uninhabited territory; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BEAU- ,Y,CTT does ordain as follows: Section I: That the City Council does hereby find, de- termine and declare that all of the recitals contained in this ordinance are true and. correct.
