AN. ORDINANCE OF THE CITY OF BEAUMONT AMENDING
SECTION 1-i AND SECTION 1-w; AND REPEALING SECTIONS IV AND
IV -a OF ORDINANCE NO. 191; REPEALING ORDINANCE
NO. 2L0 EXCEPT SECTION I THEREOF AND ORDINANCE NO. 255,
AND AMENDING SECTION II OF ORDINANCE NO. 280, ALL PERTAIN-
ING TO THE LICENSING FOR THE PURPOSE OF REVENUE ALL AND
EV: ;RY KIND OF BUSINESS CARRIED ON IN SAID CITY, AND PRESCR-
IT3ING PENALTIES FOR THE VIOLATION THEREOF,
THE CITY COUNCIL OF iHE CITY OF BEAUMONT, CALIFORNIA, DOES ORDAIN
AS ,FOLLOWS:
SECTION I: That Ordinances No. 210 except Section I thereof and
Ordinance No, 255 of the City of Beaumont be, and the same are hereby
repealed.
SECTION II: That Section II of Ordinance No. 280 of the City
of Beaumont be, and the same hereby is amended to read as follows, to -
wit:
MISCELLANEOUS LICENSE FEES:
Auctioneers, per year or fraction thereof $600.00
Rooming House business, 3 to 15 rooms, per year 21..00
Rooming House business, 15 rooms or over, per year 36.00
Peddler per year 100.00
Retail Solicitor, per year 50.00
Provided, however, the license fee of such a retail
Solicitor, if his principal place of business shall
be in a community, location or city other than the
City of Beaumont, such fee shall be per year 100.00
Itinerant Vendor, per day 8.00
Circus, per day 50.00
Sideshow, or Carnival, per day 50.00
Fortune Teller, per quarter 300.00
Retail Business, °by vehicle, per year . 1.8.00
Wholesale Business, by vehicle, per year. OOOOO OOOOO 00 12.00
Advertising Vehicle, per day 2.50
On Sale Liquor business, per year 100.00
Coin Operated Machine business, per year 100.00
All other businesses not hereinabove specifically
enumerated, per year 24.00
SECTION III: That Section I -i of Ordinance No. 191 is hereby
amended to read as follows:
For the purpose of this Ordinance "Contractor" shall mean any person
who engages with the owner or lessee, or other person in possession
of any lot or parcel of land, or building, or structure, for the
erection, construction, moving or repair of any building or structure
in the City of Beaumont, or for the doing of any plumbing, wiring,
heating, air conditioning, drainage, irrigation, brick laying, cement
work, paving, sewer work, tile work, Carpenter work, lathing, plaster-
ing, roofing, shingling, landscaping, fencing, interior decorating, or
any other work in connection with any of the building trades in said
city, whether the same be by contract at a fixed price for the whole
or per unit of construction, or upon the cost of labor and material
basis, or upon the cost of construction plus a percentage thereof
basis, or other compensation other than wages.
For the purpose of this Ordinance, "Sub -Contractor" shall mean every
contractor who under a general contractor or another sub -contractor
takes part in the construction, alteration, repair, addition to, or
improvement of any building, highway, road, excavation or other
structure, project, development or improvement, as above set forth.
Before a license is issued to a contractor or sub -contractor as
defined herein, applicant shall file with the City Clerk satisfactory
evidence that such person has a license and compensation insurance
coverage required by the laws of the State of California,
"AUCTIONEER": For the purpose of this ordinance, "Auctioneer" is
defined as any person engaged in the selling at auction any personal
property whatsoever, provided however, the provisions of this
ordinance shall not apply to any person having an established and
permanent place of business in the City of Beaumont, and paying a
license fee to said City therefor, who may auction any goods, wares,
or merchandise for the purpose of winding up the affairs of said bus-
iness, or for the purpose of closing out any special line of goods,
wares, or merchandise or other personal property that may be in his
possession at the commencement of said auction at said place of
business or place where said property is regularly kept without mak-
ing a regular practice of so doing,
That Section I -w of Ordinance No. 191 of the City of Beaumont be,
and the same hereby is amended to read as follows:
"ROOMING HOUSE BUSINESS" shall mean the renting of rooms by the
day, week or month, where three or more rooms are under the same
proprietorship.
SECTION IV: That Sections IV and IV -a of Ordinance No.191
of the City of Beaumont be, and the same are hereby repealed.
SECTION V: That if any section, subsection, sentence, clause
or phrase 4f this Ordinance is for any reason held to be invalid or
unconstitutional by decision of any court of competent jurisdict-
ion, such decision shall not effect the validity of the remaining
;portions of this Ordinance. The City Council of the City of Beaumont
hereby declares that they would have passed this Ordinance and each
section, subsection, sentence, clause, and phrase thereof, irrespect-
ive of the fact that any one or more sections, subsections, sentences,
clauses or phrases be declared invalid or unconstitutional.
SECTION VI: This Ordinance shall become effective and be in
full force and effect thirty (30) days after its adoption, and there-
upon the license fees so charged shall be computed as of the beginning
of the fiscal year for Beaumont, to -wit; July lst, and shall be ad-
justed as of that date so that all license fees shall be due and pay-
able on July lst of each year at the rates hereby established, and
shall be adjusted at the annual rate from and after the effective date
of this ordinance.
SECTION VII: ORDINANCE REPEALED.,All Ordinances or parts of
Ordinances in conflict with the provisions of this Ordinance are
hereby repealed.
SECTION VIII: The City Clerk shall certify to the adoption of
this Ordinance and shall cause the same to be published once within
fifteen (15) days from the date of its passage, in the Beaumont
Gazette, a newspaper of general circulation, printed, published, and
circulated in the City of .Beaumont, and thirty (30) days after its
adoption, this Ordinance shall be in full force and effect.
