Section 1. Three copies of the coat: of rules and regulations
known as the Inland Empire Heat ag, i= it Conaitioning, Ventilation,
Refrigeration and ter Conservation Code 1959 Edition, prepared and pub-
lisned by the Inland arnpir : Code Association Inc, having been filed in the
office of the Clerk of the City of Beaulaorlt the saltie is hereby designated
and adopted by reference as the heating, Air Conditioning, Ventilation,
Refrigeration and ',"Dater Conservation Coae for the City of Beaumont,State
of California,
Section 2. Whenever any of the following names or terms are used
in said Heating;, Air Conditioni ng, Ventilation, l?efri enation and Water
Conservation Code, each such name or term shall be deemed and construed
as follows, to -,wit: "City of Beaumont" shall dean the City of Beaumont
iri the County of Riverside, State of California, "City Council" shall
clean the City Council of the City of Beaumont,
Section 3, To provide for ;,he administration and enforcement of
this ordinance the position of Chief Heating Inspector is hereby created,
Saiu Chief Heating Inspector and/or his assistants shall become an inte-
gral part of the department of Building and Safety under the administrat-
ive authority vested in the City Building Officials It shall be the duty
of the Chief Heating Inspector to enforce the provisions of this Code.
Section 4, The Chief Heating Inspector is hereby authorized to
determine the intent and meaning of any provisions of this Code. Such
determination shall be made in writing and a record kept, which record
shall be open to the public. Any determination or decision reached by
the Chief Heating Inspector and concurred in by the City of Beaumont
Building Committee upon gnat
ters which are in dispute, are subject to
review and final decision by the City Council of the City of Beaumont,
Section 5-A. There shall be added to Section 1E-1240, "Schedule of
Fees", the following; the fees for Heating, Air Conditioning, Ventila-
tion, Pefrigeration and Water Conservation on Yew Single Family dwellings
shall be based upon the following flat rate schedule:
1 to 1,000 sq.ft 44.00
1,001 to 1,500 sq.ft 46`000
1,501 to 3,000 s;1.ft 410.00
3,001 to 4,000 s.s.ft 412.00
Section 5-B. No permit shall be required for the installation of,
repair of, or replacement of controls tc each heating appliance or heating,
ventilation, air conditioning or refrigeration system installed by a
recognized incorporated public utility or for use of such corporation in
the distribution, generation, transmission, metering of gas or electricity
or for temporary testing equipment,
Section 6. Penalties for Violation, Any person, firm or corporation
violating any of the provisions of this Ordinance shall be deemed guilty
of a misdemeanor, and upon conviction thereof shall be punishable by
imprisonment in the County Jail for a period of not more than six Months,
or by fine of not more than 41,000.00 or less than 4500,00, Or by both
such fine and imprisonment, provided that rio suspension of sentence or
probation shall be granted to any such violator unless therein included
in the terns thereof that the violator: shall comply with the provisions
which he has been convicted of violating and shall abate and correct the
ilia ai conditions, if any, which ne has brought about by the erection,
construction, construction, enlargement, alteration, repair, movement,
improvement, or conversion of which he has been convicted. The conviction
and punishment of any violator shall not relieve him of liability to be
compelled in appropriate civil or criminal proceedings to correct prohibit-
ed conditions or remove Jronibitea installations. Each such person, firm
or corporation shall be deemed guilty of separate offense for each day, or
portion thereof, aarin; which any violation of any of the provisions of
this Ordinance is
committed, continued, permitted or maintained by such
person, or corporation, and shall be punishable therefor as herein
provided.
Section 7e It is unlawful for any person, firm or corporation, either
as owners, architect, contractor, artisan or otherwise, to do knowingly or
cause or permit
to be done any work as defined in this Code in such manner that
the same shall not conform to all of the provisions of this Code 0
rection 6. .1 ordinances or parts of ordinances which are in
conflict with the provisions of this ordinance are hereby repealed.
Section 9. If any section, sub -section, sentence, clause or
phrase of this ordinance is, for any reason, held to be uncon-
stitutional
ncon--stituti.onal or legally ineffective, such decision shall not affect
the validity of the reiiiaining portions of this ordinance. The City
Council of the City of Beaumont declares that it could have adopted
this ordinance, and each section, sub -section, sentence, clause or
phrase thereof, irrespective of the fact that any one or more
Sections, sub -sections, sentences, clauses or phrases be declared
unconstitutional or leally ineffective.
Section 10. The City Clerk shall certify to the adoption of
this Ordinance arld shall cause the sam to be uablishea in the
Beaumont Gazette, a newspaper of General circulation, printed,
published and circulated in the City of Beaumon, and this ordinance
shall be in full .Force and effect thirty days after its adoption.
