A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
APPROVING A FOURTH AMENDMENT TO NATIONWIDE
ENVIRONMENTAL SERVICES AGREEMENT FOR GRAFFITI
ABATEMENT SERVICES IN A FORM APPROVED BY THE CITY
ATTORNEY •
WHEREAS, on February 15, 2011, the City entered into agreement with
Nationwide Environmental Services, a division of Joe's Sweeping, Inc., a California
corporation ("NES"), for graffiti abatement services ("Master Agreement"); and
WHEREAS, the Master Agreement provide for a one-year term from April 1,
2011 through March 31, 2012; and
WHEREAS, the Master Agreement provided for a one-person crew to provide
graffiti abatement services 8 hours per day on Friday, Saturday and Sunday; and
WHEREAS, on March 20, 2012, the City approved a First Amendment to the
Master Agreement for a seven-year term from April 1, 2012 through March 31, 2019;
and
WHEREAS, on October 4, 2016, the City approved a Second Amendment to the
Master Agreement revising the scope of services. The revised scope of services
included a two-person staffing crew; and
WHEREAS, in 2017, due to increased levels of graffiti plaguing the community,
the City requested a proposal from NES to provide six days a week graffiti abatement
services
WHEREAS, on December 19, 2017, the City approved a Third Amendment to
the Master Services Agreement commencing on July 1, 2018 and expiring on June 30,
2025; and
WHEREAS, in an effort to assist the City with organizational finance
opportunities in response to financial challenges the City has experienced as a result of
the COVID-19 pandemic, NES has offered to lower its annual contract costs by $24,000
in exchange for a contract extension via an amendment; and
WHEREAS, the Fourth Amendment to the NES Graffiti Abatement Services
Agreement provides for a $24,000 annual reduction in contract costs and extends the
term for five-years with an automatic annual renewal commencing on October 1, 2021.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS:

Section 1. The City Council for the City of Lynwood finds and declares that the
foregoing recitals are true and correct, and incorporates said recitals fully into this
resolution as substantive findings.
Section 2. That the City Council authorizes the Mayor to execute the Fourth
Amendment to the Nationwide Environmental Services Graffiti Abatement Services
Agreement attached hereto as Exhibit A.
Section 3. That the Fourth Amendment shall be approved and finalized in a
form approved by the City Attorney.
Section 4. That this resolution shall take effect immediately upon its adoption.
