HomeMy Public PortalAbout19730321CCMeeting1 1 1 4 Savannah Beach, Georgia March 21, 1973 The regular monthly meeting of City Council was held today in the Council Room of Savannah Beach City Hall at 3:00 p.m. with Mayor Allen Hendrix presiding and the following Councilmen in attendance: Edward Towns, Perry A. Zittrauer, Jr., Ernest Hosti, Earl Anderson, and Edward Jung. Councilman Walter Parker was absent. Also present at the meeting were City Attorney Bart E. Shea, Chief. of Police John Price and Mr, L. E. Elliott, City Marshal. Visitors and petitioners;present: Mr. Dwight Davis, Mr. George Peters, Mr. John Ohsiek, Mr. Richard. Grosse, Mr. Weis Snell, Mr. William S. Lovell, Mrs. Ernest Hosti, Mrs. Amorette Zittrauer, Mr. Henry Buckley, Mr. T. S. Chu, Mr. Duane Hatch, Mr. David Weitz, Mr. Langdon Cooper, Mrs. Rebecca Robinson and Mrs. Katherine Kelly, of the Humane Society. The Meeting was opened with the invocation by Mr. L. E. Elliott; followed by the Pledge of Allegiance to the Flag. The Minutes of the Regular Meeting of February 21, and the Special Council Meeting of March 12th were approved as written. Mr. Duane Hatch appeared before Council to request some relief on a drainage problem. Council agreed to try to give him some assistance. Mr. David Sipple, attorney, representing .a group of property owners on 13th Street between Butler Ave, and the Strand appeared before Council to protest the building of condominiums in this area. He stated, however, that after talking to Councilman Earl Anderson . prior to the meeting, he felt their differences could be worked out. Mrs. Katherine Kelly of Savannah - Chatham County Humane Society appeared before Counciltto discuss a mutual problem - dogs running loose and the danger of rabies. Mrs. Kelly explained the problem to Council in detail and was assured by Mayor Hendrix that Council and the Police Department would give her their 100% cooperation. Councilman Zittrauer interjected that if no publicity was given the visit of the Humane Society truck, he feels they would be more successful. Mrs. Kelly assured Council that if we see that these stray dogs are penned up, they will come and get them. Mr. Dave Weitz appeared before Council to protest the re- routing of the flow of traffic from West to East; to East to West. Mayor Hendrix stated that this question would come up for a vote at a Special Council Meeting to be held on March 28th and everyone was invited to be present. 50. Mr. Dwight Davis, together with a group representing the Savannah Beach Taxpayers Association, appeared before Council requesting certain changes in our Water and Sewer Ordinance regarding charges, amounts of water allowed, etc. He stated that they would like to be able to pay water bills on an annual basis. He stated further that the Taxpayers Association wanted to know what Council would propose in regard to the total gallons per year. He stated further that the City would be getting the majority of its water bills in one lump sum during the month of May. He then requested that Mr. Peters read a letter written to the Mayor and Council in regard to this. This letter requested an annual payment as an optional plan for those who wanted to use this method.- "The letter further stated that this would not decrease water and sewer revenue appre- ciably. Mayor Hendrix stated that Councilman Earl Anderson was in charge of water and sewer and that he would like to appoint him chairman of a committee to look into this. On that committee he stated he would like to have Councilman Towns and also Mr. Lee Berry, a citizen who was concerned with this problem. He said he would like for this Committee to get together soon. Mayor Hendrix requested Councilman Anderson to report back on this at the April Council Meeting. Mr. William S. Lovell also spoke on behalf of lower water rates. Mr. Richard Grosse proposed a new method of collecting parking charges which would not only eliminate all parking meters but numerous other problems as well. He said his program was simply a sticker which would sell for $10.00 and entitle anyone who paid for it to park anywhere on the beach at any time. Mayor Hendrix stated that this information would be put on record for future use. Mr. Weis Snell, curator of Tybee Museum, appeard before Council to get some help from them in protecting some of the Museum's - valuable articles from the ravages of dampness and deterioration. He recommended that a little room be built around the gun case. Councilman Hosti assured Mr. Snell this would be done immediately. Mrs. Jackie Brown petitioned Council to remove the dilapidated building next to the Community House for the safety of the children in the area. Mayor Hendrix advised Mrs. Brown that plans were already in motion to have this done. Bills for the various departments were approved for payment. Mayor Hendrix called for the se6ond reading of the fire ordinance. Councilman Anderson moved that the actual reading be dispensed with. Attorney Shea stated that this amendment was being referred to as a "fire limits" Ordinance; whereas, it actually was an 1 1 1 1 Ordinance adopting the Fire Prevention Code, excepting some specific local modifications. He stated further that the "fire limits" was an area type ordinance and those spelled out in the little green book were still in effect. He stated further that with this mind, it might be well to read this Ordinance again. Following the reading, City Attorney Shea recommended that, due to certin conflicts in this ordinance, that consideration of it be delayed until the March 28th Special Meeting of Council. This was agreed to by all and so ordered by the Mayor. Attorney Shea stated that at our January Meeting in Atlanta with Mr. Joe Tanner, Director, Department of Natural Resources, and his staff, at which we presented a proposed contract between U. S. Corps of Engineers and, as suggested by them, with the Georgia Department of Natural Resources. Attorney Shea stated that what that proposed contract did was to make the State Department of Natural Resources the local Sponsor or the Assuror of prftardly the maintenance funds under this beach erosion control. The first three years of maintenance, he said were included within the initial appropriation being received from the State and Federal Governments. But after that period of time, he said, we have seven years of maintenance for which someone is going to have to pay the bill. At that meeting in Atlanta we asked the Department of Natural Resources to take on that responsibility. They, in effect, said that they could not do it and requested that the City be the Sponsor and that this proposed contract be changed to a contract between the United States Government and the City of Savannah Beach, Georgia. Mr. Shea stated that he did not feel that the City of Savannah Beach was in position financially this year, or any other year, to guarantee forty or fifty thousand dollars each year maintenance funds for the groin. It will pro- bably be a case of having to go back to the State, he said. And, he said, if the Department of Natural Resources had elected to be the Assuror, they too would have had to go back to the State for more money due to the fact that they do not have any income orrfunds; and they have to make up a budget and get it funded . each year to finance their particular programs. Mr. Shea stated that he, therefore, needed the authorization of Council to re- draw this contract.making the City of Savannah Beach the local sponsor, assuring the payment of these funds by the City over the ten - yearperiod of the contract. Mayor Hendrix requested immediate action on this due to its involvement with the E.I.S. (Environmental Impact Statement) and G.D.M. (General Design Memorandum). The attorney was asked by Councilman Anderson if this Council could legally sign a contract for ten years, thereby committing future Councils. Attorney Shea stated that he did have reserva- tions about signing such a contract and that he had previously expressed these reservations in Mr. Tanner's office but there was a possibility that in dealing with the Federal Government or 52 ano:ter government agency as opposed to dealing with a private individual, we can. He said the big question is whether or not we can finance it. A motion was made by Councilman Anderson that the City Attorney be instructed to draw up a new contract with the United States Government, showing the City of Savannah Beach as local Sponsor. This motion was seconded by Councilman Jung. The motion was unanimously carried. City Attorney Shea stated that Petition to Council, a Resolution and a Quit Claim had been received from attorneys representing four property owners of certain pieces of property which had been sold for taxes and bought in by the City; and, on which all back taxes, charges, etc. have now been paid. And requesting that the City quit -claim this property back to them. The four Resolutions were then read by the Attorney and acted upon by Council as follows: 1. William J. Dukes - Lots 246 and 255, Ward 1, Savannah Beach, Georgia Taxes for years 1965 and 1966 - $9.33 RESOLUTION Councilman Jung moved that the Resolution be adopted and the Mayor be authorized to execute Quit Claim. It was seconded by Councilman Towns and unanimously carried. 2. John H. Crawford, Jr. - Lots 27 and 28, Fort Ward, Savannah Beach, Georgia Taxes for year 1967 - $26.90 RESOLUTION Councilman Jung moved that the Resolution be adopted and the Mayor be authorized to execute Quit Claim. It was seconded by Council- man Anderson and unanimously carried. 3. ;=Dean C. Dunham - Lot 7, Block 19, Fort Ward, Savannah Beach, Georgia Taxes for year 1971 - $493.06 RESOLUTION Councilman Jung moved that the Resolution be adopted and that the Mayor be authorized to execute Quit Claim. It was seconded by Councilman Zittrauer and unanimously carried. 537 4. Clint McDade - Lot 20, Horse Pen Hammock, Fort Ward, Savannah Beach, Georgia Taxes for years 1963, 1964, 1965 and 1966 - $76.17 RESOLUTION Councilman Jung moved that the Resolution be adopted and the Mayor be-authorized to execute Quit Claim Deed. Councilman Anderson seconded the motion and it was unanimously carried. Councilman Jung stated that several meetings ago he was presented with a list of old Tax Deeds still outstanding on City records. These are the result of a Tax Fi Fas levied on the property by the City during the years 1962 through 1967, he said. He was instructed by Council to have his committee investigate these and if they found that the Tax Deed still outstanding was in error or if it was felt that they were uncollectabl-euto make their recommendations to be adjusted off. Councilman Jung stated that each one of these amounts have been investigated and it was found that they were either not owed or they were real small amounts and were not able to be collected. He stated that since these items have now been outstanding on our books for almost ten years, they should now be handled as they would be by any good business, and adjusted off our records. The motion was seconded by Councilman Towns and unanimously carried. Councilman Hosti moved that Department of Public Works employees salary be given an over -all increase amounting to a $96.00 increase in the Department's weekly payroll. Councilman Anderson requested an a eridment to the original motion. This amended motion was seconded by Councilman Jung and unanimously carried. Councilman Towns stated that the present pay scale for our full - time fireman was $100.00 per week and that he wished to make a recommendation that this salary be increased to $125.00 stating that $150.00 per week had been requested by one contact through the Fire Department. Mayor Hendrix stated that this would be for a 40 -hour week. Councilman Towns then moved that in the event we can find a qualified man to replace Hank Buckley, who will be leaving for other employment -on April 1st, that the salary be $125.00 for a 40 -hour work week with the duties to be spelled out The motion was seconded by Councilman Anderson and unanimously carried. Councilman Towns stated that he had been contacted by Mrs. Mary Ginn, Director, of Emergency Medical Services of Chatham County and following a meeting of her group, it had been decided to put a station at the Beach manned by two or three employees. He said 1 Mrs. Ginn had informed him that this would be for the summer months and, in all prabability, they would move in to Wilmington for the winter months. Councilman Towns stated that in order for us to get the services of E.M.S., we must go on record with a Resolution to provide a place for the equipment and living quarters for a two or three man crew. He stated that thelliving quarters would probably consist of sleeping quarters, bathroom and kitchenette. He said it would be necessary for us to provide this in order to get their services. Mayor Hendrix stated he felt we need to know exactly what is expected of us and what we can expect from E.M.S. .A motion was made by Councilman Towns that the necessary accomations be provided for them within our financial limitations. The motion was seconded by Councilman Zittrauer and unanimously carried. Mayor Hendrix stated that an application for a wine and malt beverage license, had been received from T. S. Chu, Inlet Ave. 7 -11 Store and since the Police Commissioner was: =out of town and would not return until next Wednesday, it will be acted upon at that time since there doesn't seem to be any particular hurry for it. Mayor Hendrix reminded Council members of the Tybee Spring Festival coming.uptog April 29th; informed them of his meeting with Mr. Patrick Walsh regarding mail delivery. He also called attention to a letter from Mrs. Charles Peterson regarding loose horses. The Mayor reminded Council of our Ordinance which does not allow horses within the city limits. Mayor Hendrix stated that some action must be taken by Council to elimate the unsafe building adjacent to the Community House and at the same time make some provision for restrooms and a concession stand in the park. He recommended that the old build- ing be moved as soon as possible and that we begin immediately constructing a new building. After a discussion, a motion was made by Councilman Jung that a capital expenditure be made from Federal Revenue Sharing Funds and we proceed with the new building immediately, the building to bb under the supervision of Recreation Chairman Zittrauer and the cost of the construction not to exceed $4,500.00. It was seconded by Councilman Anderson and unanimously carried. Mr. Langdon Cooper, a visitor at the meeting complained that the City was turning raw sewage into a canal only a block from his house and that he did not want Typhoid in his house and that he was getting fed up with the situation. Mayor Hendrix told Mr. Cooper that he could understand the complaint and that every- thing possible was being done to alleviate the condition and that we were doing the best we could to hold the old system together until our new facilities were completed. Councilman Anderson, who is in charge of the Sewer Department, assured 1 1 1 Mr. Cooper that we were right now in the process of moving this effluent out and he should get some immediate relief Police Chief John Price said he wanted to thank all the citizens who took part or helped with the bicycle races on last Saturday. He also requested that a letter be written to Chief Al. St. Lawrence of the Chatham County Police Department and Lt. Beverly of the Georgia State Patrol thanking them for their cooperation and help in making this event such a tremendous success. There being no further business the meeting was adjourned to the next regular or special called meeting. MAYOR CITY CLERK 56 1 1 STATE OF GEORGIA ) COUNTY OF CHATHAM ) RESOLUTION WHEREAS, on November 7, 1967, the Chief of Police as Ex- Officio Tax Collector of Savannah Beach, Tybee Island, Chatham County, Georgia conveyed to the City of Savannah Beach certain property known as Lot 246 and 255, Ward 1, Chatham County, Georgia, for past due taxes amounting to $9.33 due the City of Savannah Beach for the years 1965 and 1966, by William J. Dukes; and WHEREAS, William J. Dukes has redeemed said property by paying $9.33 representing all taxes due the City of Savannah Beach for the years 1965 and 1966, together with all costs attendant to said tax sale pursuant to authorization of the Mayor and Councilmen of the City 6f Shvamnaj Bach on March 21, 1973; and WHEREAS, by virtue of said redemption the said WILLIAM J. DUKES by virtue of aforesaid payment, is entitled to a Quit Claim Deed for said property, he being the rightful owner thereof. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCILMEN OF THE CITY OF SAVANNAH BEACH, IN COUNCIL ASSEMBLED THAT said property known as Lots 246 and 255, Ward One, Savannah Beach, Tybee Island, Chatham County, Georgia, is hereby quitclaimed to the said WILLIAM J. DUKES as the rightful owner thereof and the MAYOR of the CITY OF SAVANNAH BEACH is hereby authorized and directed to execute a Quit Claim Deed to the Said WILLIAM J. DUKES to Carry out the purposes of this Resolution. The within Resolution is HEREBY ADOPTED AND APPROVED THIS 21st day of March, 1973. Crawford, Jr.; and WHEREAS, John H. Crawford, Jr., has redeemed said property by paying $26.90 March 27, 1969 representing all taxes due the City at that time for 1968, together with all costs attendant to said tax sale pursuant to authorization of the Mayor and Councilmen of the City of Savannah Beach on March 21, 1973; and WHEREAS, by virtue of said redemption the said John H. Crawford, Jr., by virtue of aforesaid payment, is entitled to a Quit Claim Deed for said property, he being the rightful owner thereof. DUNHAM, has redeemed said property by paying all taxes due to the City of Savannah Beach, Tybee Island for said year and all other taxes due through the year 1972, together with all costs attendant to said sale; and WHEREAS, by virtue of said redemption, the said owner has petitioned the Mayor and Councilmen of the City of Savannah Beach, Tybee Island to quit -claim said property to said DEAN C. DUNHAM, as the rightful owner thereof. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCILMEN OF THE CITY OF SAVANNAH BEACH, IN COUNCIL ASSEMBLED THAT said property known as Lot 20, HPH, Fort Ward, Savannah Beach, Chatham County, Tybee Island, Georgia, is hereby Quit Claimed to the said Clint McDade as the rightful owner thereof and the MAYOR OF THE CITY OF SAVANNAH BEACH is hereby authorized and directed to execute a Quit Claim Deed to the said Clint McDade to carry out the purposes of this Resolution.
