A GENERAL ORDINANCE MANDATING THE DEPOSIT OF REVENUES FROM
CERTAIN PARKING VIOLATIONS TO THE OFF STREET PARKING FUND
WHEREAS, Indiana Code 36-9-11-19(a) provides that the gross revenues for parking
facilities shall be kept in a fund separate from other funds of the City; and
WHEREAS, Indiana Code 36-9-2-7 grants local governments the power to regulate public
ways; and
WHEREAS, Indiana Code 36-1-3 et al. provides that local governments have whatever
powers they need for the effective operation of government as to local affairs;
and
WHEREAS, it is desirable to deposit the revenue received from parking violations in the
uptown area to the Off Street Parking Fund; and
WHEREAS, the Off Street Parking Fund is used to construct and maintain off street parking
facilities.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond,
Indiana, as follows:
1. That revenues received from parking violations in the uptown area (the area bounded
on the north by North A Street, the south by South A Street, the east by 12' Street, and the west
by 5`' Street) shall be posted to the Off Street Parking Fund.
2. All provisions of this ordinance shall be re-evaluated in 1999.
3. This ordinance shall take effect upon passage.
