HomeMy Public PortalAbout19730328SCMeeting1 1 1 Savannah Beach, Georgia March 28, 1973 A Special Meeting of Council was held this evening at 7:30 p.m. in City Hall for the purpose of: 1. The Second Reading on the Traffic Ordinance 2. To act upon the New Fire Ordinance, the consideration of which was delayed from the Regular Council Meeting of March 21, 1973 3. Adopt a Resolution quit - claiming certain real property back to Mrs. Lilly V. Berry 4. Adopt a Resolution quit - claiming a certain piece of property back to Mr. Hubert K. Ellzey 5. Act upon the application of Mr. T. S. Chu for a Wine and Malt Beverage License for the new 7 -11 Store. 6. Consider a zoning problem at the property known as The Tank which has been encountered by Mr. Charles Masters, proposed purchaser of the property. 7. Approve the purchase of the New Police Car. ($3600.00) The Meeting was presided over by Mayor Allen Hendrix and a quorum of the following Councilmen were present - Edward Towns, Perry Zittrauer, Ernest Hosti, Walter Parker, Earl Anderson and Edward Jung. Visitors at the Meeting were Dave Weitz, Charlie Hill, Jim Aliffi, Fire Chief John Solomon and George Peters. Councilman Parker informed Council that at a Special Meeting on March 12th, an amendment to our Traffic Ordinance was adopted. on First Reading. He stated that certain changes in the flow of traffic on several of our streets was necessary due to the in- stallation of automatic parking equipment in the Sixteenth Street Lot. The principal changes, he stated, were to change the flow of traffic on Eighteenth Street to one -way going East and on Sixteenth Street to one -way going West. Also, to change the flow of the traffic on the Strand between Sixteenth and Eighteenth Streets from its present southerly direction to a northerly direction and remove all parking meters from both sides of this street. He then requested a second and final reading of this amending Ordinance: O R D I N A N C E Following the reading of the Ordinance, Councilman Parker 58. moved its adoption. The motion was seconded by Councilman Hosti and carried by a vote of 4 to 2, Councilmen Zittrauer, Hosti, Parker and Anderson voting for the motion and Councilmen Jung and Towns voting against the motion. City Attorney Bart Shea informed Council that in trying to coordinate the proposed new Fire Ordinance with the existing Zoning Ordinance he finds at least five conflicts. He explained to Council that this was the Ordinance which has been read twice, the second reading being at the Regular Council Meeting of March 21st, 1973, and the consideration of which was delayed until this meeting. He explained these conflicts in detail. The Attorney's recommend- ation was that this Ordinance be referred to a committee of the zoning board in order that they may study it and come up with some- thing that would be compatible with the Zoning Ordinance itself. Mayor Hendrix stated that he would like a committee consisting of Councilman Anderson, Fire Chief John Solomon and headed by the Chairman of the Fire Committee get together and work these conflicts out and at a later date a Special Meeting would be called to adopt it. The Clerk stated that he had received a Resolution from Mr. Edgar R. Terry, Attorney representing Mrs. Lilly V. Berry, requesting that the property known as Lot 31 -A, Ward 3, Savannah Beach, which was sold for taxes and bought in by the City of Savannah. Beach; and, on which all back taxes, charges, penalties, etc., have nocq been paid, be quit - claimed back to her. He then read the Resolution. R E S O L U T I O N Councilman Ed Towns moved that this Resolution be adopted and the property be quit- claimed to Mrs. Berry. This motion was seconded by Councilman Earl Anderson and unanimously carried. A Resolution was read by the Clerk from Mr. W. Jerrold Black, Attorney.for;Mr. Hubert K. Ellzey, requesting that the property known as Lots 3, 4, & 5, and northwestern portion of Lot 10, Block 32, Fort Screven Ward, in the City of Savannah Beach which was sold by the City for past due taxes and on which all back taxes and charges have now been paid, be quit- claimed back to him. R E S O L U T I O N Councilman Perry Zittrauer moved that the Resolution be adopted and the property be quit - claimed back to Mr. Ellzey. This motion was seconded by Councilman Ernest Hosti and unanimously carried. Police Chairman Walter Parker informed Council that an application had been received for a wine and malt beverage license from T. S. Chu for the new 7 -11 store on Inlet Ave., and that following their usual investigation it was the recommendation that 1 59 the license be granted. The motion was seconded by Councilman Zittrauer and unanimously carried. Councilman Parker read a letter from Mr. Arthur Gordon which he stated he had received just today explaining his appreciation for the efforts made in his behalf by the Savannah Beach Police Department since his recent robbery. He pointed out that he was especially grateful for the surveillance of his and other houses in his area. Councilman Parker stated that it was unusual to receive this type letter and he wanted Council to know about it. He then recommended that a new police car be purchased to replace one of our present vehicles and moved that the bid of Dixie Chrysler - Plymouth in the amount of $3600.00 be accepted. This motion was seconded by Councilman Anderson and unanimously carried. Mr. Charlie Hill, a resident, was present at this meeting in the interest of a request by Mr. Charles Masterpolis, proposed purchaser of the property known as The Tank, that this property be continued as commercial. Following Mr. Hill's request, Mayor Hendrix requested that no action be taken on Mr. Masterpolis's request at this meeting in order that we can find out exactly what Mr. Masterpolis has in mind. For the information of Council, Councilman Anderson read the excerpt from our Zoning Ordinance concerning "non- conforming use" which City Attorney Shea stated must be enforced. Mayor Hendrix stated he felt Mr. Masterpolis should present himself before the Planning Commission and outline his request to them and ask that body for a favorable recommendation to City Council. There being no further business, the meeting was adjourned to the next regular or special called meeting. 1.4)410441,604:1 .4)41044,..., MAYO CLERK OF COUNCIL 60: 1 1 1 1 AN ORDINANCE AN ORDINANCE TO AMEND CHAPTER 19, SECTION 19 -4 (3), (4) and (5), RELATING TO TRAFFIC; SECTION 19 -16 PERTAINING TO PARKING METERS ON THE STRAND; TO REPEAL CONFLICTING ORDINANCES; AND FOR OTHER PURPOSES. BE IT ORDAINED by the Mayor and Councilmen of the City of Savannah Beach, Tybee Island, Georgia, in Council duly assembled, and it is hereby ordained by the authority thereof this 29th day of March , 1973 as follows: SECTION I. Section 19 -4, Subsections (3), (4) and (5) of the Code of Ordinances of the City of Savannah Beach, Tybee Island, Georgia is hereby amended as follows: "Section 19 -4. (3) Eighteenth Street shall be a one -way street from Butler Avenue to the Strand, west to east, from March 1 through Labor Day of each calendar year. (4) Sixteenth Street shall be a one -way street, east to west, from the Strand to Butler Avenue. (5) The Strand shall be a one -way street from south to north, from Eighteenth Street to Sixteenth Street." SECTION II. Section 19 -16 "Parking Meters" is hereby amended to read as follows: "Congested traffic area: On the Strand from Fourteenth Street to Fifteenth Street; east of Butler Avenue on the following streets: Third Street, Center Street, Sixth, Seventh, Eighth, Ninth, Tenth, Eleventh, Twelfth, Thirteenth, Four- teenth, Fifteenth, Sixteenth, Seventeenth and Eighteenth Streets; the westernmost boundary of Memorial Park on Jones Street, and the southernmost boundary on Fourth Street; Butler Avenue, eastern and western sides Second through Sixteenth Street." SECTION III. All Ordinances or parts of Ordinances in conflict with this act are hereby repealed. 1973. Summerlin, then Chief of Police of the City of Savannah Beach, Tybee Island, conveyed to the Mayor and Councilmen of the City of Savannah Beach, Lot Thirty - one A (31 -A) Ward Three (3) in the City of Savannah Beach, Tybee Island, Georgia, for past due taxes due the City of Savannah Beach for the year 1962 by Frank Mikell, and WHEREAS, according to all the records available this property was not acquired by Mr. Mikell until February 1, 1968 as will appear by reference to a deed recorded in the office of the Clerk of Superior Court, Chatham County, Georgia, Record Book 93I, folio 55, and WHEREAS, the City of Savannah Beach Real Estate Tax Records shows that all back taxes, penalties, interest and other charges have now been paid on this property which carries the Chatham County Property Identification Number of 483- 17 -05, and WHEREAS, this said property is now in the name of MRS. LILLY V. BERRY and her tax account on this property is on a current basis, said owner is, therefore, petitioning Savannah Beach City Council to quit- claim said property to her, as the rightful owner thereof, and WHEREAS, this same property is a part of several pieces of property which was authorized to be adjusted off of the City records by City Council at its regular council meeting on March 21, 1973 in a house- keeping procedure of uncollectible items, NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCILMEN OF THE CITY OF SAVANNAH BEACH, TYBEE ISLAND, IN COUNCIL ASSEMBLED, that the said property known as Lot Number Thirty -one A (31 -A) Ward Three (3) in the City of Savannah Beach, Tybee Island, Chatham County, Georgia, is herein quit - claimed to MRS. LILLY V. BERRY, as the rightful owner thereof, and the Mayor and Councilmen of the City of Savannah Beach, Tybee Island, are hereby authorized and directed to execute a Quit - Claim Deed to Said LILLY V. BERRY to carry out the purpose of this Resolution.
