AN ORDINANCE AMENDING CHAPTER 8 (BUILDING AND BUILDING
REGULATIONS) AND CHAPTER 21 (NUISANCES) OF THE CODE OF THE CITY OF
JEFFERSON, MISSOURI, PERTAINING TO INSURANCE PROCEEDS.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. Chapter 8 (Building and Building Regulations) is amended by the
addition of a new Section 8-95 (Insurance Proceeds) is amended as follows:
See. 8-95. (insurance Proceeds
A. If there are proceeds of an insuranceop lice for damage or loss to a building or other structure
caused by or arising out of an fire, explosion, or other casualty loss, andif the proceeds oavment is
in excess of fiftyep rcent5( o%) of the value of theop licv, then the following procedures shall apply:
The insurer shall withhold from the covered claim payment twenty-fiveep rcent2( 5%) of the
covered claim pavment, and shall paw• such moneys to the City forthe Director of Planning
and Protective Services to deposit into an interest-bearing account. Any named mortgagee
on the insurance olic • shall maintain Vrioritv over an obligation under this section. If a
special tax bill. assessment, or abatement order is issued by the Citv for the expense of
demolition of such building or structure Is,a dangerous building or structurethe money
held b the City shall be applied as toward the same. If there is an excess it shall be paid
by the City to the insured or as the terms of the olicv and endorsements thereto provide.
2. If within one hundred eighty (180) days of the receipt of such insurance moneysthe Citv has
not instituted administrative proceedings or emergency measures as provided for in Chapter
8 or 21 of the Code, then the Director of Planning and Protective Services shall authorize the
release of such proceeds and any interest which has accrued on such proceeds to the insured
under the insuranceoo licv or as the terms of theop lice and endorsements thereto provide.
3. If such building or structure is repaired or demolished pursuant to Chapter 8 or 21 of the
Code without anv expense incurred by the City, then any insurance proceeds paid to the
City and an interest thereon shall be paid to the insured under the insuranceop licv. or as
the terms of theoD licv and endorsements thereto provide.
B. No provision of this section shall be construed to make the City a party to an insurance contract.

Section 2. Chapter 21 (Nuisances) is amended by the deletion of Sec. 21-13,
subparagraph (B)
Section 3. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.
