1 O V The Council of the City of Medina met in regular session on Tuesday, March 1, 1977 at
7:35 P.M.
Members present: Mayor, Wayne Neddermeyer; Councilmembers, Nancy Laurent, William Reiser,
Arthur Theis, Thomas Crosby; Clerk, Donna Roehl; Attorney, Richard Schieffer
Planning and Zoning Administrator, Anne Dorweiler.
Motion by Arthur Theis, seconded by Thomas Crosby to approve the minutes of February 8,
1977, as presented.
Motion carried unanimously
Thomas Crosby asked that the following additions or corrections be made to the minutes of
February 15, 1977 minutes: Page 103, Item 6, Midland Nursery, change by adding "in the res-
olution" at the end of the motion sentence.
Page 105, Item 18, corr-ct spelling to "retroactive."
Motion by Thomas Crosby, seconded by Arthur Theis to approve the minutes of February 15, 1977,
as corrected.
Motion carried unanimously
1. COLONIAL DRIVE IN THEATRE
Mr. Braverman of Northwest Cinema Corporation stated that they had attempted to have someone
remove the hazardous sewage treatment plant but as no one would do the work they would now do
the work as outlined in the letter by the City Engineer.
Attorney, Randy Blohm, asked if council could issue a license after the work was done and in-
spected by the city engineer.
Mr. Lebowitz of Northwest stated that if weather permitted they would like to open for business
before the next council meeting and if ground conditions do not permit they may not have the
work completed by that meeting.
Discussion of charging fees for attorney and engineer for their work on this problem.
Motion by Thomas Crosby, seconded by Arthur Theis, to instruct the clerk to issue a license to
Colonial Drive In Theatre for 1977, upon completion, to city engineers satisfaction, of
items contained in engineers letter dated February 28, 1977.
Motion carried unanimously
Mr. Lebowitz asked for a reduction in the license fee as Medina's fee is $200 higher than
any other community.
Police Chief Hoover stated that he would like to see a complete season of a better record
than previous years. He listed the number of calls Medina and Hennepin County police had to
make to the theatre.
Wayne Neddermeyer stated that they have been willingly avoiding correcting problems for many
seasons.
Thomas Crosby stated that as a member of the fee study group he had felt that the fee was high
but it appeared that police activity and other problems had warranted the fee.
Mr. Lebowitz was told to again make his request before the budget for 1978 was finalized.
2. CHARLES PANGIER
Mr. Pangier stated that as he could not purchase the vacan lot from his neighbor he was re-
questing consolidation of his 3 lots into 2 parcels.
Richard Schieffer read and explained the prepared resolution allowing for consolidation.
Discussion of the assessing process for sewer and water service. Richard Schieffer stated
that he would prepare a resolution regarding the additional sewer and water assessments.
Thomas Crosby felt that a $50.00 fee for administration should be charged.
Motion by Thomas Crosby, seconded by William Reiser to approve Resolution 77-9 allowing for
lot consolidation of Charles Pangier, deleting items 2 and 3 and charging a $50.00 fee.
Motion carried unanimously
Discussion of what needs to be done before Mr. Pangier may secure a building permit.
Richard Schieffer stated that Mr. Pangier should submit the applications for variances.
Mr. Pangier explained the set backs hewould be asking for and asked that council members
look at the area.
3. SYLVIA RUDOLPH
rWayne Neddermeyer asked that minutes of February 15, 1977 Item 18, Page 105, Wages of Sylvia
Rudolph be change to indicate an increase to 3.75 per hour.
4. VOCATIONAL TECHNICAL SCHOOL 107
Thomas Crosby asked if Council wished to hold a public hearing to discuss Planning Comm-
ission recommendations regarding a Vo Tech school in an R A district, (Item B-4 of Planning
Commission report. He felt that any discussion should reflect all R A districts of the city
and not this particular location only. He asked if Vo Tech would be presenting any information
at the herring.
John Lobben of Vo Tech stated that they would not have a lengthy presentation and geve to
council copies of studies that have been completed: Traffic, environmental concerns and site
feasibility.
Motion by Arthur Theis, sec'mded by William Reiser to hold a special meeting and public hearing
on Tuesday, March 29, 1977 at 8:00 P.M. for consideration of the Vo Tech issue.
Motion carried unanimously
5. 'WO LEVER
Discussion of request to pay an additional $106.00 for mileage over the $50.00 per month all-
owed in resolution 76-22. Mr. Leuer has computed his mileage and found it to be over the
scheduled amount.
Richard Schieffer stated that the council would not be permitted to pay an additional amount
as a provision was not included in the resolution.
Regarding payment to Leonard Leuer for his time away from him regualr work to correct a
problem at Independence Beach; council felt that pay must be consistent with wages regularly
paid to city employees for such work.
6. JUBERT - SIPE MILEAGE
Motion by Thomas Crosby, seconded by Wayne Neddermeyer to pay Emil Jubert and Bernice Sipe
each $4.00 or 10 cents per mile for attendance at the Planning and Zoning Institute.
Motion carried unanimously
7. ROAD POSTING
Motion by Nancy Laurent, seconded by Arthur Theis to post the city roads, as of March 10, 1977
with the exception of Sioux Drive and Arrowhead Drive to the end of the blacktop and remove
posting when road surface permits.
Motion carried unanimously
8. ROAD MATERIAL BIDS
Motion by Nancy Laurent, seconded by Thomas Crosby to advertize for bids for various road
materials on April 5, 19?7; bids to be opened at 10:00 A.M. and presented to council for
consideration at 8:00 P.M. of same day.
Motion carried unanimously
9. ROAD EQUIPMENT INSURANCE
Motion by Nancy Laurent, seconded by William Reiser to adopt Resolution 77-10 regarding
payment of additional insurance premium for road equipment.
Motion carried unanimously
10. BACKHOE PURCHASE
Nancy Laurent explained the need for a backhoe for use on the roads. She presented information
regarding rent that hhd been paid during 1976, amount that had been budgeted for equipment
purchases and suggestions for borrowing additional money. She stated the cost would be approx-
imately $31,000 and that over a period of years it would pay for itself.
Nancy Laurent explained that the budget for 1977 had indicated the purchase of equipment but
not the payment of the total amount during 1977.
Wayne Neddermeyer explained that previously purchases have been made by paying for one half
of the purchase price in each of 2 years and that Revenue Sharing funds were also used.
Motion by Nancy Laurent, seconded by Arthur Theis to instruct City Clerk to advertize for bids
on purchase of backhoe for April 5, 1977 at 10:00 P.M., bids to be considered by Council at
8:00 P.M. of same day and to include a service contract portion as an option to the bidding.
Motion catried unanimously
11. MINNESOTA DEPARTMENT OF TRANSPORTATION
Nancy Laurent stated that she has been asked for input on various matters by the Department of
Transportation. Discussion of items to include: upgrading of Highway 12 and an improved basis
for County State Aid road funds.
108 12. MINNEHAHA CREEK WATERSHED PROJECTS
Nancy Laurent stated that John Holmquist, engineer for the Watershed District had suggested that
Medina apply for funds for a culvert and ditch cleaning project on Deer Hill and Willow Dr. The
estimated cost would be $1500.00. The ditch cleaning project on Tamarack Dr. he felt, would
not be approved.
Motion by Nancy Laurent, seconded by Arthur Theis to instruct the City engineer to submit
a request to Minnehaha Creek Watershed District for approval of ditching project on Deer
Hill and Willow Dr. funds to be appropriated from the Watershed Districts 1977 program.
Motion carried unanimously
13. DARREL FARR
Gloria Kielty of Mr. Farrl's office explained their request to enter into lot reservations with
prospective customers before plat approval. Wayne Neddermeyer felt that plans should be approved
before selling. Ms. Kielty explained that plans would the submitted to the Planning Commission
on March 8th and that Anne Dorweiler had been working with them. Council agreed that normal
platting procedures should be followed and that ordinance should not be waived.
14. ANNE DORWEILER
Letter of resignation from Anne Dorweiler was read. Ms. Dorweiler stated that she would be
available on a limited basis to discuss projects she has worked on, but after March 14th any
thing new ould need to be handled by someone else, She had no one to recommend as a replacement.
Discussion of various projects that she has been working on.
Thomas Crosby discus^ed the possibility of the Planning Commission handling some matters and
he will ask Dean Lund of the League of Minnesota. Cities to attend the April 5th meeting to
present indormation on hiring a replacement or a city manager.
Steve Pflaum stated that Medina should be greatful for the workAnne has done and would hope
that she would be available on a private basis.
Motion by Thomas Crosby, seconded by Arthur Theis to accept the resignation of Anne Dorweiler
and acknowledge, with thanks, her 11 years service on the Planning Commission and 4 years as
Planning and Zoning Administrator.
Motion carried unanimously
15. BILLS
Motion by Thomas Crosby, seconded by William Reiser to pay the bills; Order checks # 6549-
6599 in the amount of $12,626.44 and Payroll # 4410 - 4433 in the amount of $5373.78.
Motion carried unanimously
16. PLANNING COMMISSION MEMBERS
Letter of resignation from chairman Robert Linkenheil, was read.
Motion by Wayne Neddermeyer, seconded by Arthur Theis to accept Mr. Linkenheil's resignation
with regrets and thanks for the work he has done while a member of the Planning Commission.
Motion carried unanimously
Motion by Arthurn Theis,seconded by Nancy Laurent to appoint Wayne Anderson to a 3 year term
on the Planning Commission.
Motion carried unanimously
Motion by Nancy Laurent, seconded by William Reiser to reappoint George Wyse and Bernice Sipe
to the Planning Commission for 3 year terms, each.
Motion carried unanimously
Motion by William Reiser, seconded by Arthur Theis to appoint Jack Wahlfors to a 2 year term
on the Planning Commission.
Motion carried unanimously
Members decided to table the appointment of a member to fill the unexpired 2 year term of
Robert Linkenheil
17. CIGARETTE LICENSES
Motion by William Reiser, seconded by. Arthur Theis to approve the issuance of a cigarette
license to Don Mayer Inc. for 1977.
Motion carried unanimously

18. JAIL SERVICE
Richard Schieffer explained the $30.00 per day jail charges paid by each municipality.
Discussion regarding legislation that would make jail service a county wide expense and whether
Minneapolis jail expenses would then be included in the aggregate charges.
19. MINNEHAHA CREEK WATERSHED DISTRICT
William Reiser stated that he would act as the contact person with the watershed district
regarding the proposed improvement project being planned by them.
20. DRIVEWAY PERMITS
Discussion of application for driveway onto Willow Dr. Ron Duran stated that he would need
to consult with the engineer as to the correct placement of the driveway.
21. PERSONNEL POLICY MEETING
Motion by Nancy Laurent, seconced by William Reiser to hold a meeting to discuss various
work regulations for employees, on Tuesday, March 8, 1977 at 8:00 P.M.
