HomeMy Public PortalAbout2021.116 - (10-19-21) RESOLUTION NO. 2021.116 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE MAYOR OR DESIGNEE TO ENTER INTO AN AGREEMENT WITH AT&T AUTHORIZING THE CITY MANAGER TO SIGN CONTRACTS WITH AT&T TO PROVIDE TELECOMMUNICATION SERVICES TO THE CITY OF LYNWOOD THROUGH THE STATE OF CALIFORNIA NEGOTIATED CONTRACT KNOWN AS CALNET NEXTGEN - i WHEREAS, on January 20, 2016, the City signed on with AT&T's Calnet 3 contract pricing for telecommunication services at discounted government rates and this contract will expire on December 31, 2021; and WHEREAS, a new Calnet NextGen contract will take effect on January 1, 2022 and to ensure the City continues to receive discounted rates for telecommunication services and avoid tariff rates, which can be substantially higher than competitively pre-bid rates by the State of California, staff requests the City Council to approve this item and move to the NexGen contract; and WHEREAS,the California Department of Technology,has been competitively bidding on telecommunication services through state awarded contracts known as the California Network and Telecommunication (CALNET) program since 1998 and the City of Lynwood has been piggy-backing on this contract since 2002 to take advantage of the discounted pricing for telecommunication services; and WHEREAS, CALNET NextGen offers a wide variety of services, including long distance, trunk lines, internet, fiber optic, data lines, and wireless lines at discounted rate; and WHEREAS, the Lynwood Municipal Code § 6-3.9 requires that professional service contracts exceeding $25,000.00 must be procured via an RFP process unless the Council finds that the contract approval is exempt for the RFP process pursuant to LMC § 6-3.13; and WHEREAS, accordingly, approval of the AT&T CalNet NextGen agreement requires a City Council vote of 4/5 of the members. Since the State of California competitively bid on these services, it would be more economical and efficient for the City to use this contract; and WHEREAS, in order to stay within the budget approved for Fiscal Year 2021-2023 by taking advantage of competitively pre-bid rates by the State of California, staff requests approval of this item. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY RESOLVE AND DETERMINE AS FOLLOWS: Section 1. The City Council for the City of Lynwood finds and declares that the foregoing recitals are true and correct, and incorporates said recitals fully into this Resolution as substantive findings. Section 2. That the City Council of the City of Lynwood approves and authorizes the Mayor or designee to enter into an agreement with AT&T authorizing the City Manager to sign contracts approved as to form by the City Attorney with AT&T to provide telecommunication services to the City of Lynwood through the State of California negotiated contract known as CALNET NextGen. Section 3. This resolution shall go into effect immediately upon its adoption. PASSED, APPROVED and ADOPTED this 19th day of October, 2021. ,,, /4F ' -1.
