A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM,
FLORIDA, WHICH SUPERSEDES RESOLUTION 98 -12, ESTABLISHING FEES FOR
THE PROCESSING OF APPLICATIONS FOR DEVELOPMENT APPROVAL;
PROVIDING FOR THE RECOVERY OF DIRECT COSTS ASSOCIATED WITH THE
PROCESSING OF SAID APPLICATIONS, PROVIDING FOR A WAIVER OF SUCH
FEES AND EXPENSES; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
WHEREAS, the Town of Gulf Stream Zoning Code requires applications be
submitted for various land development proposals and provides for the
processing, review and final disposition of such applications; and
WHEREAS, the Town staff is required to expend in time performing
certain duties in processing applications for development approval; and
WHEREAS, the Town may incur additional direct materials and
professional review expense in processing applications for development
approval; and
WHEREAS, the Town Commission believes those submitting applications
for development approval should share in the costs of processing such
applications; and
WHEREAS, the Town periodically revises its fee schedules to more
accurately reflect the cost of processing applications.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, FLORIDA THAT:
Section 1. Application Fees: The following fees are hereby
established for applications for development approval as necessary to
partially off -set the costs of Town staff time and related overhead
expenses:

Section 2. Recoverable Direct Expenses: In addition to the application
fees provided for in section 1, applicants shall reimburse the Town for all
direct expenses associated with processing the application These expenses
shall include, but are not limited to: advertising, postage,
copying /duplicating, recording fees, mileage, signs /postings and similar
materials costs. In addition, applicants shall reimburse the Town for any
and all professional review fees incurred including, but not limited to:
attorneys, engineers, architects, landscape architects, planners,
environmentalists, surveyors, utility contractors, building contractors,
and other professionals who may be called upon by the Town to review and
comment on an application. Use and selection of outside professionals to
review applications shall be at the sole discretion of the Town.
Within sixty (60) days of final action on an application, the Town shall
submit an itemized bill to the applicant which shall include all
recoverable direct expenses incurred in processing the application which
bill shall be due in full within thirty (30) days of receipt, provided
however, that the Town shall not process or grant other development permits
or approvals involving the subject property until the bill is paid in full.
Section 3. Waiver of Fees and Expenses: The Town Commission may waive
all or part of the required fees and expenses upon a finding that such a
waiver is in the public interest of the residents of Gulf Stream or that
the fees and expenses pose an undue hardship on the applicant. Motions to
approve such waivers shall require three (3) affirmative votes for passage.
The Town Manager may adjust fees upon demonstration that charging the full
amount would exceed Town costs in processing the application.
Section 4. Refund Requests: If an application is withdrawn before
staff review has been conducted, the applicant may request in writing a
refund of 500 of fees paid. Applications withdrawn after notices have been
mailed are not entitled to a refund.
Section 5. Effective Date:
immediately upon passage.
