Savannah Beach, Georgia
April 16, 1973
A Special Meeting of Council was held this evening at
7:30 p.m., in City Hall for the following purposes:
1. Authorizing Mayor Hendrix to execute another Letter
of Intent accepting the responsibility of Local
Sponsor of Tybee Island, Georgia, Beach Erosion
Control Project on behalf of the City of Savannah
Beach.
2. Approving a City Contract with the State Highway
Department covering the paving of certain streets
and authorize the Mayor to execute same.
This Meeting was presided over by Mayor Allen Hendrix and
a quorum of the following Councilmen was present: Edward Towns,
Walter Parker and Earl Anderson. Councilmen Edward Jung, Ernest
Hosti and Perry Zittrauer were absent. Also present at the
Meeting was Mr. Paul Ramee, City Engineer.
The Meeting was opened by Mayor Hendrix and turned over to
Col. Paul Ramee who brought Council up to date on our Beach Erosion
Control Project and reported on a recent meeting he and City
Attorney Fred Clark had with the Corps of Engineers. He also
explained why it was necessary to execute another Letter of Intent
to the Corps of Engineers and revise the figures in it.
Following this discussion, Councilman Earl Anderson moved
that the Mayor be authorized to execute a new Letter to the Corps.
of Engineers agreeing to act as local sponsor for the Tybee Island,
Georgia, Beach Erosion Control Project, as requested by them and
that the following Resolution be adopted:

The motion was seconded by Councilman Towns and unanimously
carried.
Councilman Anderson then moved that the Letter of Intent,
as authorized by the Resolution, be sent to the Corps of Engineers
and a copy of same incorporated in these minutes. This motion was
seconded by Councilman Towns and unanimously carried.
L E T T E R O F I N T E N T
Mayor Hendrix informed Council that the Paving Contract
from the State Highway Department had been received and needed the
approval of Council. He explained in detail the various elements
of the Contract following which a motion was made by Councilman
Parker that this contract be approved and the Mayor be authorized
to execute same. It was seconded by Councilman Anderson and
unanimously carried.
There being no further business the meeting was adjourned to
the next regular meeting or special called meeting..

R E S O L U T I O N
WHEREAS, The City of Savannah Beach, Tybee Island, Georgia,
has been asked to serve as local sponsor for the Tybee Island,
Georgia, Beach Erosion Control Project, as requested by the U. S.
Corps of Engineers; and
WHEREAS, the Municipality has the capability to furnish the
non - federal cooperation required by the Resolutions authorizing
the said project; and
WHEREAS, the U. S. Corps of Engineers has requested the
Mayor of the City of Savannah Beach to agree to act as local sponsor
for the said Project, by having the Mayor sign the said Resolution.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY OF SAVANNAH
BEACH in Council Assembled agrees to act as sponsor and as such
agrees as follows:
The sponsor agrees that if the government shall commence
construction of such project in accordance with House Document No.
92 -105, 92nd Congress, 1st Session, then the sponsor shall fulfill
the requirements of the non - federal cooperation as follows:
a. Provide without cost to the government all lands,
easements, and rights -of -way required for construction and
subsequent nourishment of the Project.
b. Accomplish without cost to the Government and in
accordance with the provisions of Section 207, Public Law 91 -646,
91st Congress approved January 2, 1971, all relocations and
alterations to sewage and drainage facilities, buildings or
residences, streets, utilities and other structures necessary for
Project construction and operations.
c. Contribute in cash 51 percent of the first cost,
including the cost for construction, engineering and design, and
administration, excluding the cost of lands, easements, rights -of-
way, and relocations, of all items of work to be provided by
the Government, which contribution by the sponsor is presently
estimated as $1,636,000.00. Such 51 percent is to be paid in a
lump sum prior to start of construction or in installments prior
to the start of pertinent work items in accordance with
construction schedules as required by the Chief of Engineers.
Final apportionment of costs will be made after the actual costs
have been determined.
d. Contribute in cash 51 percent of costs which includes
beach monitoring and nourishment for the first 10 years of Project

life now estimated at $74,300.00 annually, such nourishment cost
for the first three years of the Project estimated at $139,000.00,
to be provided by the Sponsor for advance nourishment at the time
of first construction, and following contributions to be made prior
to each nourishment operation. Final apportionment of cost will be
made after the actual costs have been determined.
e. Provide maintenance and repair to the groins, and provide,
after the first 10 years of Project life,periodic nourishment of the
restored beach as may be required to serve the intended purposes
during the life of the Project.
f. Hold and save the Government free from claims and /or
damages that may result from construction, maintenance, and
nourishment of the project.
g. Control water pollution to the extent necessary to safe-
guard the health of the bathers.
h. Provide without cost to the Government access and
facilities necessary for realization of the public benefits upon
which Federal participation is based and maintain continued public
use of the beach and administer it for public use during the life
of the Project; and
i. Furnish lands for beach access and parking, satisfactory
to the Government, for the reach from First Street to the terminal
groin, prior to start of construction.
In addition to the foregoing, sponsor will secure, if such
be required, the necessary rights in adjacent lands for the
Government to enter upon, at reasonable times and in a reasonable
manner, for access to the Project for the purpose of inspection,
and for the purpose of operating, repairing and maintaining the
Project.
IN WITNESS WHEREOF, The City of Savannah Beach has attested
this Resolution by the signature and seal of the duly authorized
officers this 16th day of April, 1973.
