RESOLUTION NO. 01-3
A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN
OF GULF STREAM, PALM BEACH COUNTY, FLORIDA,
VACATING AND ABANDONING A PORTION OF THE RIGHT -
OF -WAY COMMONLY KNOWN AS MIDDLE ROAD AS
SHOWN ON THE PLAT OF GULF STREAM COVE, AS
RECORDED IN PLAT BOOK 24, PAGE 185, PUBLIC RECORDS
OF PALM BEACH COUNTY, FLORIDA, AND DEDICATING AN
ALTERNATE RIGHT -OF -WAY
WHEREAS, the owners of the lands abutting the properties hereinafter described have
petitioned the Town to abandon and vacate a portion of the right -of -way commonly known as
Middle Road, over and across the lands more fully hereinafter described; and
WHEREAS, the Town Commission of the Town of Gulf Stream does hereby find and
determine that the necessity for that portion of the said right -of -way is no longer necessary for use
as a right -of -way, nor is it necessary for public use, as long as the alternate right -of -way described
herein is dedicated as a public right -of -way.
NOW THEREFORE BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN
OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, as follows:
That portion of the right -of -way commonly known as Middle Road, as shown on the Plat of
Gulf Stream Cove, more particularly described as follows, to -wit:
PROPOSED ABANDONMENT OF 576.5 SQUARE FEET OF RIGHT -OF -WAY
COMMONLY KNOWN AS MIDDLE ROAD, GULF STREAM COVE, IN THE
TOWN OF GULF STREAM, FLORIDA, ACCORDING TO THE PLAT
THEREOF, AS RECORDED IN PLAT BOOK 24, PAGE 185, OF THE PUBLIC
RECORDS OF PALM BEACH COUNTY, FLORIDA, BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE
NORTHEAST CORNER OF LOT 14 OF SAID GULF STREAM COVE; THENCE
SOUTH 84 059'03" EAST ALONG THE SOUTH LINE OF LOT 13, OF SAID
GULF STREAM COVE A DISTANCE OF 30.00 FEET; THENCE SOUTH
05 °00'57" WEST, A DISTANCE OF 21.73 FEET, TO A POINT ON THE ARC OF
A CIRCULAR CURVE CONCAVE TO THE SOUTH AND TO SAID POINT A
RADIAL LINES BEARS NORTH 32 058'09" EAST; THENCE WESTERLY
ALONG SAID CURVE HAVING A RADIUS OF 32.00 FEET, A CENTRAL
ANGLE OF 55 054'23" AND AN ARC LENGTH OF 31.22 FEET; THENCE
NORTH 05 000'57" EAST, A DISTANCE OF 21.73 FEET TO THE POINT OF
BEGINNING.

84 059'03" EAST, A DISTANCE OF 1.77 FEET TO THE POINT OF CUSP OF A
CIRCULAR CURVE CONCAVE TO THE SOUTHEAST AND TO SAID POINT
A RADIAL LINE BEARS NORTH 05 000'57" EAST; THENCE
SOUTHWESTERLY ALONG SAID CURVE HAVING A RADIUS OF 20.00
FEET A CENTRAL ANGLE OF 90 000'00" TO THE POINT OF BEGINNING.
be and the same is hereby vacated and abandoned.
In substitution for the right -of -way herein abandoned, there is hereby dedicated a new right-
of -way on the following described property:
A PORTION OF LOT 14, GULF STREAM COVE, ACCORDING TO THE PLAT
THEREOF, AS RECORDED IN PLAT BOOK 24, PAGE 185 OF THE PUBLIC
RECORDS OF PALM BEACH COUNTY, FLORIDA, BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHEAST CORNER OF SIAD LOT 14; THENCE
NORTH 05 000'57" WEST, A DISTANCE OF 21.73 FEET TO THE POINT OF
BEGINNING; THENCE CONTINUENORTH 05'00'57" EAST, A DISTANCE OF
28.27 FEET TO A POINT ON A LINE PARALLEL WITH AND 50.00 FEET
NORTH OF THE SOUTH LINE OF SAID LOT 14, THE LAST TWO (2) CALLS
BEING COINCIDENT WITH THE EAST LINE OF SAID LOT 14; THENCE
NORTH 84 049'03" WEST ALONG SAID PARALLEL LINE, A DISTANCE OF
17.00 FEET TO A POINT ON THE ARC OF A CIRCULAR CURVE CONCAVE
TO THE NORTHEAST AND TO SAID POINTA RADIAL LINE BEARS NORTH

HAVING A RADIUS OF 32.00 FET, A CENTAL ANGLE OF 62 °02'49" AND AN

FLORIDA, CONTAINING 342.5 SQUARE FEET MORE OR LESS;

RECORDS OF PALM BEACH COUNTY, FLORIDA, BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHEAST CORNER OF SAID LOT 14; THENCE
NORTH 05 000'57" WEST ALONG THE EAST LINE OF SAID LOT 14, A
DISTANCE OF 50.00 FEET TO THE POINT OF BEGINNING, SAID POINT
ALSO BEING ON A LINE PARALLEL WITH AND 50.00 FEETNORTH OF THE
SOUTH LINE OF SAID LOT 14; THENCE NORTH 84 059'03" WEST ALONG
SAID PARALLEL LINE, A DISTANCE OF 17.00 FEET TO A POINT ON THE
