CITY OF TIFFIN ORDINANCE NO. 2017-407
AN ORDINANCE REZONING LOTS 8-12, 14-18, 20-22 AND 27-29 OF
PART TWO, TIFFIN, IOWA, FROM SINGLE-FAMILY
MEDIUM-HIGH DENSITY RESIDENTIAL DISTRICT (R-1C) TO PLANNED
DEVELOPMENT OVERLAY CONCEPT AND SITE DISTRICT/MULTI-
FAMILY 4-PLEX RESIDENTIAL DISTRICT (OPD/R-4) FOR CENTRAL
PARK CONDOMINIUMS, TIFFIN, IOWA
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose. The purpose of this ordinance is to rezone
property, at the request of the applicant, Hochstedler Building &
Development, known as Lots 8-12, 14-18, 20-22 and 27-
Addition Part Two, Tiffin, Iowa from Single-Family, Medium-High
Density Residential District (R-1C) to Planned Development Overlay
Concept and Site District/Multi-Family 4-Plex Residential District
(OPD/R-4), a 4-lot residential subdivision with 20 multi-family dwellings,
as shown on the attached documents. Such property to be known as
Central Park Condominiums.
Section 2. Amendment. The following legally described
property:
BEGINNING AT THE NORTHEAST CORNER OF LOT 29, REEVE'S ADDITION -
PART TWO, TIFFIN, IOWA, IN ACCORDANCE WITH THE PLAT THEREOF
RECORDED IN PLAT BOOK 37, AT PAGE 43, IN THE RECORDS OF THE
JOHNSON COUNTY RECORDER'S OFFICE; THENCE S00°58'42"E, ALONG
THE EAST LINE OF SAID LOT 29, AND THE EAST LINE OF LOT 28 AND LOT
27, BOTH OF SAID REEVE'S ADDITION - PART TWO, 170.00 FEET, TO THE
SOUTHEAST CORNER OF SAID LOT 27; THENCE S89°01'18"W, ALONG THE
SOUTH LINE OF SAID LOT 27, A DISTANCE OF 120.00 FEET, TO THE
SOUTHWEST CORNER THEREOF; THENCE N00°58'42"W, ALONG THE WEST
LINE OF SAID LOTS 27, 28 AND 29, A DISTANCE OF 171.22 FEET, TO THE
NORTHWEST CORNER OF SAID LOT 29; THENCE N89°36'14"E, ALONG THE
NORTH LINE OF SAID LOT 29, A DISTANCE OF 120.01 FEET, TO SAID POINT
OF BEGINNING. SAID TRACT CONTAINS 0.47 ACRE, (20,473 SQUARE FEET),
AND IS SUBJECT TO EASEMENTS AND RESTRICTIONS OF RECORD.

BEGINNING AT THE NORTHEAST CORNER OF LOT 20, REEVE'S ADDITION -
PART TWO, TIFFIN, IOWA, IN ACCORDANCE WITH THE PLAT THEREOF

BEGINNING. SAID TRACT CONTAINS 1.55 ACRES, (67,569 SQUARE FEET),
AND IS SUBJECT TO EASEMENTS AND RESTRICTIONS OF RECORD.

PART TWO, TIFFIN, IOWA, IN ACCORDANCE WITH THE PLAT THEREOF

JOHNSON COUNTY RECORDER'S OFFICE; THENCE S01°06'12"E, ALONG
THE EAST LINE OF SAID LOT 12, AND THE EAST LINE OF LOTS 11, 10, 9
AND 8, ALL OF SAID REEVE'S ADDITION - PART TWO, 265.00 FEET, TO THE
SOUTHEAST CORNER OF SAID LOT 8; THENCE S88°53'48"W, ALONG THE
SOUTH LINE OF SAID LOT 8, A DISTANCE OF 126.00 FEET; THENCE
N01°06'12"W, 265.00 FEET, TO A POINT ON THE NORTH LINE OF SAID LOT
12; THENCE N88°53'48"E, ALONG SAID NORTH LINE OF LOT 12, A
DISTANCE OF 126.00 FEET, TO SAID POINT OF BEGINNING. SAID TRACT
CONTAINS 0.80 ACRE, (34,715 SQUARE FEET), AND IS SUBJECT TO
EASEMENTS AND RESTRICTIONS OF RECORD.
shall be changed from zoning classification R-1C to Planned
Development Overlay Concept and Site District/Multi-Family 4-Plex
Residential District (OPD/R-4) and further, that the official zoning map
of the City be amended to reflect the change described herein. Approval
of this zoning classification change is subject to Council approval of a
Planned Development Overlay
District Agreement(s) as required by City, Council approval of the
preliminary plat, compliance with the requirements of the Tiffin Zoning
Code - Planned Development Overlay District, and the Developer
executing all easement agreements the City may require.

Section 3. Certification and Recording. Upon passage and approval
of this ordinance, the City Clerk is hereby authorized and directed to
certify a copy of this ordinance and to record the same, at the office of
se,
all as provided by law.
Section 4. Repealer. All ordinances or parts of ordinances in
conflict with the provisions of this Ordinance are hereby repealed.
Section 5. Severability. If any section, provision, or part of this
ordinance shall be adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the ordinance as a whole, or
any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section 6. Effective Date. This ordinance shall be in effect after
its final passage, approval, and posting as provided by law.

Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2017-407, and
moved that it be given its first reading. The motion was seconded by
Councilperson Havens.
Ayes: Upton, Kahler, Ryan, Havens, Bartels
Nays: None.
Five members of the Council being present and having voted "Aye", Mayor
Steve Berner declared the motion carried, and Ordinance No. 2017-407, was
read the first time, discussed, and placed on record.

On the 18 day of July 2017, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Havens introduced Ordinance No. 2017-407, and
moved that it be given its second reading. The motion was seconded by
Councilperson Kahler.
Ayes: Upton, Kahler, Havens.
Nays: None.
Three members of the Council being present and having voted "Aye", Mayor
Steve Berner declared the motion carried, and Ordinance No. 2017-407, was
read the second time and discussed and placed on record.

On the 15 day of August 2017, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Kahler introduced Ordinance No. 2017-407, and

moved that it be given its third and last reading. The motion was seconded by
Councilperson Bartels.

Steve Berner declared the motion carried, and the ordinance was passed and
adopted.

From time to time, CITY OF TIFFIN, IOWA (we, us or Company) may be required by law to
provide to you certain written notices or disclosures. Described below are the terms and
conditions for providing to you such notices and disclosures electronically through the
DocuSign, Inc. (DocuSign) electronic signing system. Please read the information below
carefully and thoroughly, and if you can access this information electronically to your

Getting paper copies
At any time, you may request from us a paper copy of any record provided or made available

Withdrawing your consent
If you decide to receive notices and disclosures from us electronically, you may at any time

Consequences of changing your mind

paper notices or disclosures. To indicate to us that you are changing your mind, you must

of a DocuSign envelope instead of signing it. This will indicate to us that you have withdrawn
your consent to receive required notices and disclosures electronically from us and you will no
longer be able to use the DocuSign system to receive required notices and consents electronically
from us or to sign electronically documents from us.

Unless you tell us otherwise in accordance with the procedures described herein, we will provide
electronically to you through the DocuSign system all required notices, disclosures,
authorizations, acknowledgements, and other documents that are required to be provided or

To request paper copies from CITY OF TIFFIN, IOWA
To request delivery from us of paper copies of the notices and disclosures previously provided

the body of such request you must state your e-mail address, full name, US Postal address, and
telephone number. We will bill you for any fees at that time, if any.
