Brief description of the project as it relates to the zoning relief requested —Include existing dimensions, proposed dimensions, and any non -conformities that exist: Amendment to SPF #97-35 to construct a one-story 1,884 sf addition to an existing 1,111 sf building. The SPF was originally required due to the pre-existing nonconforming rear setback. Is the proposed change substantially more detrimental than the existing non -conforming use, structure, or building to the neighborhood? YES/NO, Explain why. NO. The nonconformity relates to the building which lacks the required 20' rear setback. The Board of Appeals found the change in use (to an eating place) to be an improvement to the neighborhood notwithstanding the nonconformity. The existing change in use as an Eating Place with less than 4000 sf of building area is allowed by right in the Limited Business (LB) district under WZO section 5.01.3.1. On -site accessory parking (21 spaces) is sufficient to meet the requirement (1/4) for increased seating capacity from 34 to 84 seats. The net effect of the building addition, which does not exacerbate the nonconformity, is a by -right use that complies with all of the underlying dimensional controls/standards in the LB district, including front setback, building coverage, impervious coverage, open space, height, floor area ratio and parking spaces.
