The regular monthly meeting of Savannah Beach City
Council was held at 3:00 P.M. this afternoon at City Hall with
Mayor Allen Hendrix presiding and a quorum of the following
councilmen present: Edward Towns, Ernest Hosti, Walter Parker,
Earl Anderson and Edward Jung.
VISITORS AND PETITIONERS in attendance at the meeting
were: Mrs. J. O. South, Mr. Fred DeBorde, and Mr. Richard Grosse.
The meeting was opened with the Invocation by Councilman
Parker, followed by the Pledge of Allegiance to the Flag.
THE MINUTES of the Meeting of July 18, 1973 were approved
as written.
Mrs. J. O. South, a resident of the beach in the area
of Tilton and Second Avenue, appeared before council to make an
appeal for the replacement of the steps over the sea wall and
rocks in the vicinity of her house. She presented council with a
petition of nineteen names requesting that this be done as quickly
as possible. Mayor Hendrix asked Councilman Hosti to check into
this and see if he couldn't get some help for her.
Mr. Fred DeBorde appeared before council to complain
about the poor condition of North Jones Avenue. He stated that
when the ditch was dug for the new sewer line which was run down
the side of the street, the job of restoring the street was
not properly done and the street was now in a bad state. He said
that any car that gets off the street usually gets stuck. Mayor
Hendrix asked Mr. DeBorde to bear with us and we would make every
effort to correct the situation.
Mr. Richard Grosse appeared before council requesting
that signs warning against swimming in the area of Battery Point
due to the danger of rough waters, barnacles, etc. Mayor Hendrix
said this would be done and in addition some signs prohibiting
the picking of sea oats would also be placed in the area.
Bills for the various departments for the Month of July
were approved for payment.
Mr. John Wright Jones, attorney, appeared before council

on behalf of Mr. D. D. Hudson who has filed an application with
the City ofr a retail liquor, wine and beer license. Mr. Jones
stated that, as he recalled, a number of bars were closed last
year and he now understands that all of them with the exception
of the Novelty Bar have had their licenses restored. He stated
further that Mr. McCarroll was the former licensee of the Novelty
Bar and that he did not represent him. He said he represented
Mr. D. D. Hudson, a new applicant for a license at this location.
Mr. Jones stated further that if the City of Savannah Beach refuses
to allow this person to have a license it would be depriving him
of his property without due process of law, which he stated
was unconstitutional. Mr. Dave Weitz appeared as a character
witness for Mr. Hudson. He stated that he operated the business
next door to the Novelty Bar and he was not aware of anything
wrong or illegal with the operation of this business. Mr. Dave
Hudson also appeared in his own behalf and stated that he would
be the proprietor and sole owner of this business; and, that Mr.
McCarroll would be the landlord only and would have no monetary
interest in the business. Police Commissioner Walter Parker
stated that he and the Police Committee were investigating this
matter thoroughly for several reasons, one of which was the fact
that the Revenue Commissioner allowed the rest of the bars to
re -open but did not allow the Novelty Bar to re -open. He stated
further that his committee wanted to know the reasons for this and
what type people we were dealing with. He said, therefore,
that they wanted to get some answers before they arrived at a
decision.
Mayor Hendrix stated that unless council wanted to do
otherwise, he felt we should continue with this investigation
and whatever the findingszhight be we would call a Special Meeting
of Council and either approve or disapprove of this license. The
Mayor continued saying that this would probably be done within a
couple of weeks.
Mayor Hendrix informed council that we now have two bids
from companies to perform service and maintenance work on our
water tank and, since they both seemed kind of high, we were
requesting Mr. McClellan of Atlantic Tank and Tower Company of
Decatur to come down, make an inspection and a proposal to do
this work.
Council instructed the City Clerk to get in touch with
Councilman Zittrauer and request him to get his committee
together with the parties involved in the proposed swap of the
American Legion building for the old fire house building and get
the feelings of all parties concerned so that when the swap is
made it will be a good one.

Mayor Hendrix informed council that beginning Monday,
August 20th, we would have a truck with a dog cage on it and we
would have a police officer in the area who would be making cases
against people with dogs on the beach even if they are on a leash.
He also stated that loose dogs would be taken to the dog pound
and kept for two days after which they would be taken to Savannah.
Councilman Anderson reported that his committee had
determined that the fence encroachment of Mr. Dwight Davis at
10th and Butler Avenue should be removed. Mayor Hendrix then
instructed the clerk to write the usual letter informing Mr.
Davis of this action by Council.
Mayor Hendrix announced the resignation of. Mr. A. P. Solomon
as Building Inspector, effective August 31, 1973 and of Mrs. Louise
Sasser as Secretary of the Savannah Beach Planning Commission.
Councilman Earl Anderson moved that these resignations be accepted
with regret and that a suitable letter be written to them
expressing the gratification of city council for their excellent .
work for the City. The motion was seconded by Councilman Hosti
and unanimously carried.
Mayor Hendrix read a letter he had written to Senator
Roscoe Dean, thanking him on behalf of the City of Savannah Beach for
bringing his Senatorial Committee to our city and holding a public
hearing on the proposed legislation for the preservation of the
sand dunes. He also read a letter from Senator Dean thanking
everyone who was involved in the excellent preparations for these
hearings.
Councilman Edward Jung made reference to our Ordinance to
supplement the provisions of Section 44, Recorders Court, City of
Savannah Beach; and, in particular the provision that the Mayor or
any member of City Council designated by the Mayor, shall have all
the power and duties of the elected Recorder, in his absence, and
moved that the letter of August 15, 1973 written by the Mayor and
addressed to the Clerk of Council, vesting this authority in Councilmen
Earl Anderson, Ernest C. Hosti, Edward Jung, Walter W. Parker,
Edward W. Towns and Perry A. Zittrauer, Jr. be approved and he so
moved. The motion was seconded by Councilman Anderson and unanimously
approved.

Prior to closing the meeting, Mayor Hendrix read a copy
of a letter dated March 24, 1952 from Mayor Edward A. Dutton to
Dr. Samuel F. Rosen in which Mayor Dutton recognized the great
need for a sidewalk on the east side of Butler Avenue from
16th to 19th Streets and told Dr. Rosen that this sidewalk would
be put in before the opening of the summer season. Mayor Hendrix
stated that this was a dangerous area and we should make every
effort to put in this sidewalk. He-then requested Councilman Hosti
to check into this and try to get a sidewalk for this area.
There being no further business, the meeting was adjourned
to the next regular or special called meeting.

In accordance with the provisions of Section 44
of the Georgia Laws, 1970, page 2080 et. seq. as supplemented
by an Ordinance enacted by the Council of the Municipality
on April 22, 1970, in the absence or disqualification of
Fred S. Clark, elected Recorder of the Recorder's Court
of the City of Savannah Beach, Tybee Island, in addition to
the undersigned, as Mayor, I hereby appoint the following
members of Council as Judge of such Recorder's Court of the
Municipality:
Earl R. Anderson
Ernest C. Hosti
Edward Jung
Walter W. Parker
Edward W. Towns
Perry A. Zittrauer, Jr.
Each of whom shall have full power and authority to serve in
the absence or disqualification of the elected Recorder, to
issue criminal warrants, hold preliminary hearings and
trials, affix bonds, commit such offenders to jail, prescribe
acceptable cash bonds, and to do and perform any other act
necessary to assure the continuing operation of the Recorder's
Court in the absence or disqualification of the elected
Recorder.

The regular monthly meeting of Savannah Beach City Council
was held this afternoon at 3:00 P.M. in City Hall with Mayor Allen
Hendrix presiding and the following councilmen present: Edw. Towns,
Perry Zittrauer, Ernest Hosti, Earl Anderson and Edward Jung. Fred
Clark, City Attorney, was also present.
VISITORS and PETITIONERS: Visitors and Petitioners present
at the meeting were L. E. Elliott, City Marshal, Donnie Anderson,
Savannah Beach Police Officer, James Brown, Lucy Patterson,
Reverend Van Horn of the Savannah Beach Methodist Church, Mr. Robert
Williams of the Tides Motel, Mr. Bill Wong, Mr. Henry Glisson
Mr. Dave Hudson, Mr. John Wright Jones, Attorney; Mr. Jim Fabrikant,
Mr. Charles Petersen, Mr. Reginald Haupt, Jr., Attorney and Mr.
Marvin Hirsch, former Savannah Beach Police Officer.
The Invocation was pronounced by the Rev. Van Horn and this
was followed by the Pledge of Allegiance to the Flag.
The Minutes of the special council meeting of July 26th and
the regular council meeting of August 15, 1973 were approved as
written.
Mr. Bob Williams, new owner of the Tides Motel, appeared
before council for the purpose of appealing the amount of water usage
shown on his water billing for the past season, more specifically,
for the months of June, July and August. Mr. Williams stated
that he took over the motel in April and his water billing for the
months of April and May were apparently consistent with what he
felt they should be; and, also compatible with the billings for the
previous year. However, he said, beginning with the June, 1973 billing
they became completely unreasonable. He stated that he had 26 apart-
ment units in his main building and they used up 845,000 gallons of
water for the month of June which he stated was completely out of
line with the usage of the motel for the same period the previous
year under the former owner. He stated further that July and
August likewise were completely out of line with the comparative
period for last year. Mr. Williams stated further there was no
way that amount of water could have been used or leaked out without
someone knowing about it. Mayor Hendrix requested the Water
Committee to meet with Mr. Williams immediately after the regular
meeting and make an effort to clear up this situation.

Mrs. Virginia Sanders, Commander of the. American Legion
Post #154 Auxilliary of Savannah Beach, appeared before council
on behalf of a project that has been undertaken by herself and
her husband. She informed council that her husband was Commander
of Post #154, Savannah Beach American Legion and together they .
were a team dedicated to the improvement and betterment of this
local American Legion Post and to the progress of the city of
Savannah Beach. She explained in detail the plans they had to
accomplish these aims, among which was a complete renovation of
the old deteriorated roof, new windows and bath rooms. She said
that their ultimate goal was to make the building into a combination
American Legion POst and a gym for the children on the island in
order that they may have a nice place to hold their various indoor
sports. In answer to a question from councilman Towns as to
whether or not she was in favor of swapping the present building for
the old fire house, she stated that she certainly was not and
due mainly to the fact that many old members of the Eighth Infantry
came back once a year to meet together in this building that they
consider home.
Councilman Zittrauer reminded Mrs. Sanders that there was
an agreement between the Legion Post and the City of Savannah
Beach and asked her if she was familiar with it. She stated that
she was familiar with the terms of the agreement and even had a
copy of it. Mr. Zittrauer said that this was fine because when our
people go there to play basket ball he would like them to be able
to play. And he also stated that he wanted it understood that
local organizations had priority over anyone else. Mrs. Lucy
Patterson reminded council that it was more important to have a
place for the children to play than to have areal pretty place.
At this time, Judge Fred Clark administered the oath of office
to Mr. James C. Brown, newly appointed Savannah:. Beach Police Officer.

Bills for the various departments for the month of August
were approved for payment.
Mr. John Wright Jones, attorney for Mr. Dave Hudson who
is an applicant for a retail liquor license at the location on
Sixteenth Street known as the Novelty Bar, appeared before council
again to request some action on this application. Mr. Jones
informed council that yesterday Mr. Tommie McCarroll was convicted
of certain charges in the operation of this bar but that Mr. Hudson
was not charged, tried or convicted. Mr. Jones reminded council
that they could not legally deprive a person of his constitutional
right {o utilize his property for the purpose for which it was
developed and built. Mr. Jones stated further that both he and Mr.
Hudson were prepared to answer any questions that the Mayor or any
Councilmen would like to ask them.

Councilman Jung asked Mayor Hendrix if the investigation
of Mr. Hudson had revealed anything. Mayor Hendrix stated that
Mr. Parker was ill and was not able to be present today and could
not, therefore, substantiate the findings of the investigation.
Mr. Jung then stated that since nothing had been presented against
the applicant and substantiated, he moved that this license
be granted. The motion was seconded by Councilman Zittrauer
and carried by a vote of four to one. Councilmen Jung, Towns,
Zittrauer and Anderson voted FOR the motion and Councilman Hosti
voted AGAINST the motion.
With reference to the proposed swap of buildings by the
American Legion Post - their present building for the old fire house.
Mayor Hendrix asked if there was any more discussion on this proposal.
Councilman Zittrauer stated that after lengthy discussion with all
the parties involved he moved that the American Legion Post stay
in their present location. The motion was seconded by Councilman
Towns and unanimously carried.
Mayor Hendrix stated that the item on the agenda dealing
with personnel policies would be passed until the next council
meeting due to the illness of Mr. Parker who was going to present
the proposal.
Councilman Hosti moved that the garbage pick -up charges for
outside the city limits be increased as follows:
RESIDENTIAL - $5.00 per Month or $60.00 per year ..
COMMERCIAL - $10.00 per Month or $120.00 per year
BREEZY POINT TRAILER PARK - $5.00 per Lot per Month
This motion was seconded by Councilman Jung and unanimously carried. I
The Clerk read a letter from the auditing firm of Haskins
and Sells which firm performed the recent audit of the City's books
in which Mr. Rodney Wall, a member of that firm, stated that due to
the fact that the time required for their examination of our books
was in excess of the time used in arriving at their proposed fee
of $4700.00 they were submitting a final fee of $6,500.00. Mr. Wall
stated that this billing represented their original estimate of
$4,700 plus charges for the additional work outlined in the letter ..
amounting to $1800.00. The Clerk pointed out to Council that, in
their original proposal, Haskins and Sells proposed a fee of $4700
for the total job as outlined and in the event the total charges
were less, the City would receive the benefit of the reduction.

The Clerk also informed Council that, in the interest of saving
' time, the councilmen that could be reached were polled and they
unanimously agreed that we should hold Haskins & Sells to the
proposed rate we had agreed to which was $4700.00 and that a letter
to this effect be sent to them along with their check for the
services. The Clerk stated that this had been done and read the
letter sent to the auditing firm. Councilman Anderson moved that
this letter be approved. The motion was seconded by Councilman
Zittrauer and unanimously approved.
Councilman Anderson informed Council that he had received
word from the Leary Tank Company that they would like to revise
their bid proposal for maintenance work on our water tank and
requested that action on these bids be helf off until the Leary
proposal could be received. Council gave him permission to hold
off the awarding of this contract.
A proposed letter to be sent out to all water- takers over the
signature of the City Clerk advising that as of October 11th
all accounts in arrears two or more months would be cut off without
further notice was approved by Council.
L E T T E R
Councilman Earl Anderson, Commissioner of Water and Sewer,
announced the resignation of Mr. 3. W. Bunkley, certified operator
of our Sewage Treatment Plant, effective October 1, 1973 and moved
that S. R. Kent, present Superintendent of our Wastewater Collec-
tion System, be appointed Superintendent over the Treatment Plant
also. The motion was seconded by Councilman Ed. Towns and unanimously
carried.
_Councilman Anderson informed Council that in the future
all adjustments of water -sewer charges would be made -by the Water -
Sewer Committee.
COMMUNICATIONS: Under communications, the Clerk read a
letter from Mrs. Sara C. Minchew, Principal of Tybee Elementary
School which was addressed to Mrs. Mary Ginn of Emergency Medical
Services, expressing her appreciation for the help rendered by
the staff of E.M.S. on the occasion of a sick child in the school.
Mr. L. E. Elliott, City Marshal, gave a report on his collections
as follows:

With reference to the request of Mr. Reginald Haupt, for
a hearing before Council for his client, Mr. Marvin Hirsch,
former Savannah Beach Police Officer, Mayor Hendrix stated that
he would like to conduct the hearing in an executive session,
unless Mr. Haupt deemed otherwise. Mr. Haupt had no objections
to this.
Councilman Perry A. Zittrauer, Jr. announced to Council
that, effective this date, he wished to submit his resignation
from Council for personal reasons and because he felt that he did
not have the time to give to the job. He also stated that tomorrow
he would submit this in writing but he wanted it to take effect as
of today. Councilman Earl Anderson moved that Mr. Zittrauer's
resignation be accepted reluctantly and that Mr. Robert F. Cary
be.appointed councilman to replace him. Mayor Hendrix stated that
this motion was not acceptable to the chair because it was a double
motion. Councilman Anderson then moved that Mr. Zittrauer's
resignation be accepted reluctantly. The motion was seconded by
Councilman Jung and unanimously carried.
Councilman Anderson then began another motion but before he
completed it Mayor Hendrix rapped the gavel and declared the meeting
adjourned. Councilman Anderson stated that the meeting was not
adjourned. Mayor Hendrix stated that it was adjourned as far as
he was concerned. There was no further business conducted.

NOTE: After adjourning the Meeting, Mayor Hendrix left the room.
Councilman Anderson then asked City Attorney Fred Clark if he
was ruling that the meeting was legally adjourned. Attorney
Clark answered that he was not making any ruling but that it
was his interpretation that the meeting was adjourned. He
stated further that since there were no rules to go by, he
felt that the person in charge of the meeting began the meeting
and should have the right to end it.

A Special called meeting of City Council was held this
evening at 8:00 P. M. for the purpose of:
(1) Changing the personnel and chairmanship of
some of the standing committees
(2) Adopting Resolution concerning our participation
in Metropolitan Planning Commission program for
solid waste disposal.
The meeting was presided over by Mayor Hendrix and a quorum
consisting of the following councilmen was present: Edward Towns,
Ernest Hosti, Walter Parker, Earl Anderson, Edward Jung. City`
Attorney Fred Clark was also present.
The meeting was formally opened by Mayor Hendrix. The Mayor
then read his new committee appointments as follows:

Councilmen Hosti then read a proposed plan of the Metropolitan
Planning Commission for Solid Waste Disposal and moved that the
following Resolution authorizing our participation in this program
be. adopted:

The motion was seconded by Councilman Jung and unanimously
adopted.
There being no further business the meeting was adjourned to
the next regular or special called meeting.

R E S O L U T I O N
COUNTY OF CHATHAM )
WHEREAS, the City of Savannah Beach, Tybee Island,
Georgia, is desirous of participating in the Solid Waste
Management Plan involving all governing bodies in Chatham
County, Georgia; and
WHEREAS, in order to participate in said Plan and
program it is necessary for the Mayor of Savannah Beach, Tybee
Island, Georgia, to execute a commitment letter agreeing that
the proposal submitted is indeed the proposal of the City of
Savannah Beach, Tybee Island, Georgia, and its governing body,
and to take such other action as is necessary to comply with
the requirements of the Plan and the program fully recognizing
that the City of Savannah Beach, Tybee Island, has the option
of withdrawing from the proposal at any time provided it is
included in another proposal or develops its own proposal in
compliance with the Rules and Regulations of the Solid Waste
Management Act, Section .03(1).
NOW, THEREFORE, be it resolved that the City of
Savannah Beach, Tybee Island, in Council assembled hereby
authorizes the Mayor of said municipality to take such action
as is necessary to enable the said municipality to participate
fully in the said Plan.
The within Resolution is HEREBY ADOPTED AND APPROVED THIS
10th day of October , 1973.
