HomeMy Public PortalAboutOrdinance 3733-8-66 ORDINANCE NO. 3 73 AN ORDINANCE OF TEL CITY OF BEAUMONT, CALIFORNIA, PROVIDING FOR TEE PAYMENT OF SALARIES TO MEMBERS OF THE CITY COUNCIL OF TEL CITY OF BEAUMONT RE- SCINDING AND REPALING ORDINANCE NO.372 AND ALL OTHER ORDINANCES OR PORTIONS THEREOF IN CONFLICT iE RLT^ ITI TEL CITY COUNCIL OF TEL CITY OF BEAUMONT, STATE OF CALIFORNIA, DOES ORDAIfl AS FOLLOWS: SECTIOd 1: PURPOSE. This ordinance is enacted pursuant to Section 36514 of the Gcvernment Code, as added by Chapter 286 of the Statutes of 1965, authorizing the Council to orovide by Ordinance that each member of the Council shall receive a pre- scribed salary the amount of which is based upon the population of the City as determined by estimates mane by the State Depart- ment of Finance. SECTION 2: POPULATION. As of the date of passage of this ordinance, the latest estimate of population of the City of ueaumont made 7 the Department of Finance is 5100. SLCTION 3: SALARIES. Each member of the Council of the City of Leaumont shall receive, as salary, the sum of $150.00 per month, as prescribed in said Section 36514 for cities between 5,000 and 35,000 population, which shall be payable from. and after the operative date of this ordinance at the same time and in the same manner as the salaries are paid. to other officers and: em- ployees of the City of Beaumont. S C"TION 4: IA C'RWAC;_; OR DECREASE. Following any new and later estimate of population made by the Department of Finance placing the City of Deaumont in a population group other than that set forth in Section 3 hereof, the salary hereby payable to each member of the Council shall be increased or decreased ac- cordingly to equal the sum prescribed for that population group in Section 36514 of the Government Code, as added by Chapter 286 of the Statutes of 1965; provided, however, that the salary as Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 so increased or decreased shall become payable only on and after the date upon which one or more members of the Council become eligible therefor by virtue of beginning a new term of office following the next succeeding general municipal election held in the City of Beaumont. SECTION 5: REIMBURSEM,NT. The salaries prescribed herein are and shall be exclusive of any amounts payable to each member of the Council as reimbursement for actual and necessary expenses incurred by him in the performance of official duties for the City of Beaumont. SECTION 6: OPERATIVE DATE. This ordinance shall become operative only on and after the date upon which one or more members of the Council of the City of Beaumont become eligible for the salary prescribed herein by virtue of beginning a new term of office following the general municipal election next succeeding its effective date. SECTION 7: REPEAL OF CONFLICTING ORDINANCES. Ordinance No. 372 and all other ordinances and parts thereof in conflict herewith are hereby rescinded and repealed effective as of the effective date of this ordinance. SECTION 8: URGENCY. This ordinance is hereby declared to b an urgency ordinance and to be necessary for the immediate pre- servation of the public peace, health and safety, and the facts constituting its urgency are hereby stated and declared to be as follows: The City of Beaumont has heretofore enacted its Ordinan No. 372 calling for the payment of salaries to members of the Cit Council in the sum of $75.00 per month and $100.00 per month to the mayor during his tenure in said office; that the said or- dinance is in contravention of Section 36514 of the Government Code of the State of California in that said Section of the Government Code makes it mandatory for salaries to councilmen Page 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 in cities of the size of Beaumont to be in the minimum amount of $150.00 per month and the payment of salaries in a sum other than said amount would be unlawful; and that in order for any salary to be effective in so far as any councilmen are,concerned, this ordinance must be passed and adopted and become effective on or before April 1, 1966. SECTION 9: EFFECTIVE DATE. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be pub- lished once in the Beaumont Gazette, a newspaper of general cir- culation, printed, published and circulated in the City of Beau- mont, and this ordinance shall be in full force and effect im- mediately upon its adoption.
