AN ORDINANCE OF THE CITY OF BEAUMONT AMENDING
ORDINANCE NO. 327 REQUIRING THE INSTALLATION
OF SIDEWALKS IN ADDITION TO CONCRETE CURBS
AND GUTTERS AS A CONDITION TO THE ISSUANCE OF
A BUILDING PERMIT.
THE CITY COUNCIL OF THE CITY OF BEAUMONT DOES ORDAIN AS
FOLLOWS:
SECTION 1. Section 2 of Ordinance No. 327 which amends
Article 13 of Ordinance 282 by adding section 19 thereto is hereby
amended so that said Section 19 shall read as follows:
SECTION 19. "Requirement for boundary stakes by a
licensed surveyor, installation of concrete curbs and gutters and
sidewalks, or deposit with the City Clerk of the amount of the
City Engineer's cost estimate thereof.
(a) That prior to issuance of a building permit by the
Building Inspector of the City of Beaumont for placing or building
upon any property abutting on a public street in the City of
Beaumont, the applicant for such building permit or the owner of
said property must have boundary stakes placed thereon by a
licensed surveyor.
(b) Such applicant or owner shall install and construct
concrete curbs and gutters and sidewalks on the proximate side of
each public street upon which said lot abuts parallel to the
property along the curb line according to the determination of the
City Engineer. Such curbs and gutters and sidewalks shall meet
the specifications as established by the City Engineer, elevations
therefor shall be in accordance with the direction of the City
Engineer of the City of Beaumont.
(c) Such applicant or owner shall deposit with the City
Clerk of the City of Beaumont a bond (or cash in the amount of the
bond in lieu thereof) in such amount as the City Engineer shall
determine as the estimated cost of the installation of such curbs
and gutters and sidewalks with authority to the City of Beaumont to
install such curbs and gutters and sidewalks as the applicant or
owner fails to so install such curbs and gutters and sidewalks
within a reasonable time after the completion of the construction
contemplated on said lot. In the event that applicant or owner
shall install such curbs and gutters and sidewalks, the City Clerk
shall return the bond or refund the deposit so made upon approval
of such curbs and gutters and sidewalks by the Building Inspector.
(d) In any block the location of the sidewalk shall con-
form with the existing sidewalk on the same side of. the street, or
if no sidewalk exists in the same block placement shall be subject
to approval of the Building Department."
SECTION 2. All other ordinances or parts thereof in conflict
herewith are hereby repealed.
SECTION 3. The City Clerk shall certify to the adoption of
this Ordinance and shall cause the same to be published in the
Record -Gazette, a newspaper of general circulation, in the City of
Beaumont, and this ordinance shall be in full force and effect
thirty days after its adoption.

was duly passed and adopted at a Regular Meeting held on the 10th

AYES: Councilman Haskell, Rodeman, Hightower and Karnes.
NOES: Councilman Kief.
ABSENT: None.
