HomeMy Public PortalAboutOrdinance 441ORDINANCE NO. 441___ AN ORDINANCE OF THE CITY OF BEAUMONT FIXING THE AMOUNT OF MONEY NECESSARY TO BE RAISED BY TAXATION UPON THE TAXABLE PROPERTY IN THE CITY OF BEAUMONT FOR THE FISCAL YEAR 1972- 1973. THE CITY COUNCIL OF TUE CITY OF BEAI3MONT DOES HEREBY ORDAIN AS FOLLOWS; to -wit: SECTION 16 That the amount of money necessary to be raised by taxation upon the taxable property in the City of Beaumont exclusive of all sums to be raised to pay the bonded and interest indebtedness of the City of Beaumont, for the General Fund as a revenue to carry on the various departments of government of the City of Beaumont for the fiscal year 1972-73 is hereby fixed at $ 107 038.51 ; And the amount to be raised to pay tha Bonded and Interest INdebtedness of the City of Beaumont for the fiscal year 1972-73 is hereby fixed at $ 11 774624 ; And the amount to be raised for the Lighting Maintenance Fund of the City of Beaumont for the fiscal year 1972-73 is hereby fixed at $ 30 697.45 ; And the amount to be raised for the Public Parks and Recreation Fund of the City of Beaumont for the fiscal year 1972-73 is hereby fixed at $ 19 266.93 ; And the amount to be raised for the Civil Defense Fund for the City of Beaumont for the fiscal year 1972-73 is hereby fixed at $ 5 351693 ; And the amount to be raised for the Storm Drain and Flood Control Fund for the City of Beaumont for the fiscal year 1972-73 is hereby fixed at $1196125 ; And the amount to be raised for the Planning Fund for the City of Beaumont for the fiscal year 1972-73 is hereby fixed at $ 20 337632 ; And the amount to be raised for the Public Employees Retirement Fund for the City of Beaumont for the fiscal_ year 1972-73 is herby fixed at $ 41,,745.02 SECTION 2. This Ordinance is hereby declared to be an urgency Ordinance, and to be necessary for the immediate preservation of the public peace, health and safety and the facts constituting its urgency are hereby stated and declared to be as follows: It is required by law that an ordinance be adopted fixing the amount of money necessary to be raised by taxation upon the taxable property in the City of Beaumont as a revenue to carry on the various departments of the government of the City of Beaumont and to pay its bonded and other indebtedness and expenses for the fiscal year 1972-73, and that no later than the last Tuesday in August the rate of tax be fixed; and there will not be sufficient time elapse between the time of the adoption of this Ordinance and the last Tuesday in August of this year to have it in effect by said last Tuesday in August of this year to enable its passage otherwise than as an urgency ordinance and be in effect in order to comply w:? th the law with reference o the e i xing of the rate of taxes of said City of Beaumont for the fiscal year 1972-73; and if said rate is not fixed the City of Beaumont will be without funds with which to operate its various departments of government, and to pay its bonded and other indebtedness and expenses,, upon which depends the public health, peace and safety. SECTION 3, The City Clerk shall certify to the. adoption of this Ordinance, and shall cause the same to be published once in the Daily Record -Gazette, a newspaper of general circulation in the City of Beaumont, and it shall be in full force and effec immediately upon its adoption. City Clerk ORDINANCE NO. 440 AN ORDINANCE OF THE CITY OF BEAUMONT AMENDING SECTION 7-i OR ORDINANCE NO. 333 TO MAKE PROVISION FOR BASING THE LICENSE FEE FOR THE OPERATION OF COIN-OPERATED VENDING MACHINES DISPENSING TANGIBLE PERSONAL PROPERTY UPON THE LICENSEE'S ENTIRE GROSS RECEIPTS ATTRIBUTABLE TO SUCH BUSINESS ACTIVITIES AND REPEALING ALL ORDINANCES AND PARTS THEREOF IN CONFLICT HEREWITH. The City Council of the City of Beaumont does hereby ordain as follows: Section 1. Section 7-i of Ordinance No. 333 is hereby amended by adding thereto subsections 7-i (a), (b), (c), (d), and (e), as follows: 7-i (a) Every individual or firm engaged exclusively in the business of renting, leasing or operating coin-operated vending machines dispensing tangible personal property within the city shall pay a license tax based upon gross receipts in accordance with the following schedule; !1 } GROSS RECEIPTS $0 to 2,499.99 2,500.00 to 4,999.99 5,000.00 to 7,499.99 7,500.00 to 9,999.99 10,000.00 to 14,999.99 15,000.00 to 19,999.99 20,000.00 and up PER YEAR $ 15.00 25.00 30.00 40.00 60.00 80.00 100.00 For the purpose of this section the license tax shall be based on the entire gross receipts which are directly attributable to the business activities conducted within the city. 7-i (b) "Gross Receipts" shall mean and include the total amount of sale price of all sales and the total amount charged or received for tangible personal property including but not in limitation of the foregoing, all goods, wares and/or merchandise vended without deduction therefrom any sum or sums whatsoever for any reason at all. 7-i (c) Any such license for the conduct of a vending machine business as above defined and set forth may be revoked for failure of the licensee to report to the city the gross receipts from such machines. The licensee shall furnish to the city an audit of the business of such licensee and the city may require such licensee to submit a copy of state sales and use tax returns filed relative to such machines. 7-i (d) The annual gross receipts upon which said rates are based shall be the annual gross receipts for the calendar year immediately preceding the license year for business done within the City of Beaumont, excepting for a new business which had no gross receipts for the immediately preceding year. Such new business shall estimate its gross receipts and pay the license fee as set forth in Section 7-i (a) based upon such estimate. This amount, however, shall be tentative only and such licensee shall within thirty days after the expiration of the period for which such license was issued furnish the city clerk on a form to be furnished by the city clerk executed under penalty of perjury showing the actual gross receipts during the period of such license and the license tax for such period shall be finally ascertained and paid within thirty days of the close of the year for which such license was issued. If not so paid within said thirty day period there shall be 10 per cent penalty added thereto. In the event the amount paid as an estimate is in excess of the amount actually found to be due, the city clerk shall either credit the excess amount paid against the amount due for the license for the ensuing year, or the said excess shall be refunded. The city clerk shall not issue a license to any person, firm or corporation until the proposed licensee shall have furnished to the city clerk the written statement and have paid the license tax herein provided to be paid. All information furnished and secured by the City in pursuance of this ordinance shall be kept confidential. 7-i (e) The license fee imposed by this ordinance is solely to raise --revenue for municipal -purposes, and is not intended to be for regulatory purposes. SECTION 2. This ordinance shall not be applicable to merchants licensed under another category and who own and operate their own vending machines dispensing tangible personal property. SECTION 3. All other ordinances or parts thereof in conflict herewith are hereby repealed. SECTION 4. This ordinance shall be effective immediately pursuant to Section 36937 of the California Government Code in that it is an ordinance relating to taxes for the usual and current expenses of the city. SECTION 5. The city clerk shall certify to the adoption of this ordinance and cause the same to be published once in the // // // // // // Record -Gazette, a newspaper of general circulation, printed and published in the City of Beaumont.
