AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A PRELIMINARY
PUD PLAN FOR PROPERTY LOCATED AT 2725 MERCHANTS DRIVE; DESCRIBED AS LOTS
26 AND 27 OF BAX'S COMMERCIAL PROPERTY SUBDIVISION, JEFFERSON CITY, COLE
COUNTY, MISSOURI
WHEREAS, SACA LLC, owner of the real estate hereinafter described, having submitted a
Preliminary PUD Plan of said real estate, Lots 26 and 27 of Bax's Commercial
Property Subdivision, Jefferson City, Cole County, Missouri; and
WHEREAS, it appears that the procedures set forth in the Zoning Code relating to Planned
Unit Developments have in all matters been complied with, as said property owner
submitted to the Planning and Zoning Commission and City Council a Preliminary
PUD Plan for the above referenced property.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Preliminary PUD Plan, on file as Case No. P14007 in the Jefferson City
Planning Division, is hereby approved for the land referenced above. An underlying zoning district
of M-2 is established for the purpose of determining permitted uses with adult daycare added as a
permitted use.
SECTION 2. Common Areas and Public Land. No common areas are proposed and no
lands are dedicated to public use with this PUD Plan.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

zoning matters on Monday, June 16, 2014 at 6:00p.m. in the Council Chamber of the John G. Christy

Case No. P14007 – 2725 Merchants Drive, Rezoning from M -2 to PUD and Preliminary PUD
Plan. Application filed by SACA LLC, property owner, Jason Forrest, authorized representative,
on behalf of Danielle Schwartz, applicant, for a rezoning of 1.1 acres from M-2 General Industrial
to PUD Planned Unit Development and a Preliminary PUD Plan for use of a portion of the existing
building as an adult daycare. The property is located on the south side of Merchants Drive 650
feet east of Commerce Drive and is described as Lots 26 and 27 of Baxs Commercial Property
Subdivision, Jefferson City, Missouri (Matt Rimiller, Architectural Consultant).
Ms. Cotten arrived at 5:25 p.m.
Mr. Barron described the proposal and explained that the applicant is requesting a rezoning from
M-2 General Industrial to PUD Planned Unit Development and a Preliminary PUD Plan in order to
accommodate a mixed use building that would contain a 2,350 square foot adult day care, a 15,800
square foot warehouse, and 5,500 square feet of office space. He stated that this development
proposal is unique in the sense that the mix of proposed uses, adult daycare and medical supply
warehouse/distributer, is not typically found together and is not listed as a permitted use in the
same zoning district. Mr. Barron explained that the proposed use as an adult daycare would not be
out of character with existing uses in the area. Mr. Barron clarified that the underlying zoning district
will be M-2 with the addition of an adult daycare as a permitted use.
Ms. Danielle Schwartz, 1908 Whitney Woods Drive, spoke regarding this request and explained
that she is a speech pathologist and owns Speak Easy, which specializes in providing therapy
services to adults and children with developmental disabilities. Ms. Schwartz stated that through her
practice she has seen a growing need for a day service that provides care for adults with
disabilities. Ms. Schwartz explained that Day Solutions will provide care during the day, therapy
services and on the job training. She stated that Rehab Specialty Medical will occupy a portion of
the building as well. Ms. Schwartz explained that she has received the required certifications and is
moving forward with licensing. She stated that even though they are licensed for 24 individuals they
will start with 12 to 15 individuals.

Mr. Jim Casey, Cole County Residential Services, 1908 Boggs Creek Road, spoke in favor of this
request.
No one spoke in opposition to this request.
Correspondence in support of this request was received from Mr. Jim Casey, 1908 Boggs Creek
Road.
Mr. Lester moved and Mr. Nunn seconded to recommend approval to rezone the property from
M-2 to PUD, to the City Council. The motion passed 7-0 with the following votes:

Abstain: Deeken
Mr. Lester moved and Mr. George seconded to recommend approval of the Preliminary PUD

a. The proposed development by SACA LLC consists of renovating an existing 24,700
square foot building. The renovations include approximately 5,500 square feet of office
space, a 15,800 square foot warehouse space, a 2,350 square foot adult daycare, and a
possible future retail showroom. The office, warehouse, and showroom are associated
with a medical supply and equipment business. The adult daycare will be used as a day
habilitation program for adults with disabilities. The daycare program will be licensed by
the Department of Mental Health and staffed accordingly. The proposed day
habilitation will have its own entrance, but will be located inside the preexisting
structure. Permitted uses for the property are proposed as all permitted uses of the M-
2 zoning district plus adult daycares.
b. No building addition or site modifications are proposed. Building Plans detailing the
proposed construction inside the existing building have been submitted to the City.
c. A preliminary plat is not needed for this submittal.
d. There are no covenants, conditions or restrictions included as part of this proposal.
e. Traffic impact for the proposed use is minimal and a site specific traffic impact study is
not required.
f. Signage details are not finalized at this time; however all signage will follow City of
Jefferson code requirements for the M-2 zoning district.
g. No landscaping or screening is required for this project.
h. No new parking lot lighting is required. Lighting should be limited to building mounted
security lighting. All lighting will follow City of Jefferson code requirements for the M-2
zoning district.
i. Filing fees are attached and are calculated as follows:

Nature of Request

This development proposal is unique in the sense that the mix of proposed uses (adult daycare and
medical supply warehouse/distributer) is not typically found together and is not listed as a permitted use
in the same zoning district. The PUD zoning district is a useful tool in terms of accommodating these
types of unique development proposals, and is a better route for approval of this specific mix of uses than,
for example, a rezoning to a commercial zoning designation that would permit a much wider mix of uses
that could potentially conflict with the adjacent uses. Staff supports the proposed rezoning to PUD.
Preliminary PUD Plan:
The Preliminary PUD Plan proposes only a mix of land uses within the existing building. No site
modifications or building additions are proposed. Permitted uses are proposed as all permitted uses of the
M-2 zoning district plus adult daycare. Signage and lighting is proposed to follow the requirements for
the M-2 district.
The areas to the north and to the west of Merchants Drive are zoned commercial, and a number of
commercial uses exist in the vicinity of this property, including a former childrens daycare. The proposed
use as an adult daycare would not be out of character with existing uses in the area. Staff supports the
proposed PUD Plan.
Staff Recommendation
Staff recommends approval of the Rezoning and Preliminary PUD Plan request.
