Present: Mayor, Thomas Anderson; Councilmembers, Sarah Lutz, Wilfred Scherer, Thomas Crosby; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoEllen Hurr; Police Chief, Charles Hoover; Attorney, Richard Schieffer; Engineer, Skip McCombs; Couneilmember William Reiser 1. ADDITIONAL AGENDA ITEMS Couneilmembers agreed to discuss the following additional items: Four wheel Drive Road Rally Long Lake/Medina Morningside Water Fee Collection Forms 19 2. MINUTES OF FEBRUARY 16, 1982 Motion by Reiser, seconded by Crosby to approve minutes of February 16, 1982, as presented. Motion declared parried 3. PUBLIC WORKS DEPARTMIIVT Four Wheel Drive Road Rally Jim Kraemer, representing the March of Dimes, appeared to discuss the use of Leo Leuer's farm on March 21st for a four wheel dirve road rally. He explained that they would be entering the farm through Woodlake Sanitary Landfill via Boyer Rd. and would also be using Evergreen Rd. north of the Medina Ballroom. He stated that they would have security people and would attempt to keep all traffic on County or State roads and off of Medina roads. He had a statement signed by Leo Leuer stating that he would be responsible for keeping all dirt scraped off of the roads. He explained that they had One million dollars worth of insurance for the event and that their club, the Ridge Runners had $5cp,000 worth of insurance. Council explained that the problem in 1981 was primarily caused by spectators. Kraemer stated that he personally sets up the course and that it is not revealed until the day of the event, with spectators urged not to follow. Chief Hoover stated that he could not control the rally with Medina's officers. Wilfred Scherer stated that he had problems with their using Woodlake Landfill. JoEllen Hurr reported that there may be problems with vehicles driving through Woodlake considering the fact that there are monitoring wells for the landfill, on the property. Richard Schieffer stated that Woodlake's approval is conditioned on Medina's approval. Thomas Crosby stated that he is against any off -road activity that would not enter from a blacktopped road. Motion by Crosby, seconded by Scherer that Medina not authorize rally on property in Med- ina which results in spectator or participant utilization of unpaved city roads and that Woodlake property be excluded from rally plans in view of the fact that monitoring pro- grams,in connection with the landfill, are being conducted. Also that insurance or other security, considered satisfactory by city attorney be provided and that prior approval from the City Counoil,for any other site,be secured. Motion declared carried Mr. Kraemer asked if Evergreen Rd. was being excluded. Mayor Anderson stated that they could use Evergreen Rd. Richard Schieffer stated that he would review the insurance coverage and agreement with Leo Leuer. Road Maintenance Material Bids Motion by Scherer, seconded by Reiser to accept bids for road maintennce materials on April 6, 1982, at 10:00 A.M., with Council to consider bids at their ounoil meeting that evening. Motion declared carried Minnegasco Motion by Scherer, seconded by Lutz to adopt Resolution 82-5 allowing Minnegasco to install gas lines on Carriage Dr., Bridal Path Tr., Navajo Rd. and Hunter Dr. Motion declared carried 20 Long Lake/Medina Morningside Water Skip McCombs reported that Long Lake has agreed to putting a value of $67,000 on Medina's wells at Medina Morningside and crediting that amount to the total cost of a project to combine the two systems. He explained costs to each city with each to maintain its own water lines with a mainten- ance agreement that would take care of the wells and water tower. Discussion of costs to individual property owners in comparison to the charges they are now paying for the purchase of the system. Council agreed to hold a public information meeting on March 16th to explain the project to the Medina Morningside property owners, with owners to be notified by letter of the meeting. 4. POLICE DEPARTMENT Employment of Additional Officer Larry Thompson of Suburban Police Recruiting Services explained their organization of 50 communities operating under a joint powers agreement to perform recruiting, interview- ing and background investigation of prospective police officers for communities. Richard Schieffer asked if they did psychological testing. Mr. Thompson stated that was one of the main parts of their service. Sarah Lutz asked if test results were provided to the city. Mr. Thompson explained that the results of tests were given to the cities psychologist. Discussion of a procedure for interviewing applicants. Mr. Thompson stated that Medina would possibly want to interview fifteen candidates, that they provide a suggested questionair and suggestions for a panel to do the interviewing. He explained that the fee is $650 plus $100 for each existing officer in the department, with Medina to them become a member of the joint powers agreement. Motion by Reiser, seconded by Crosby to enter into the Joint Powers Agreement with Sub- urban Police Recruiting Service at a cost of $950. Motion declared carried 5. PLANNING AND ZONING 1EPARTMENT Ray Anderson, substandard lot Council reviewed memo from JoEllen Hurr regarding Mr. Anderson's request to build En his substandard sized lot which adjoins his home property at 355 akeview Dr. on Holy ame T,Ake. Discussion of Section 403 of Zoning Ordinance wherein a lot must be one acre in size in an unsewered area, must have frontage on a public street, be under separate ownership as per date of ordinance, that setback requirements can be met and proof can be provided that an adequate sewage treatment system could be designed. Mr. Anderson stated that the percolation test indicates two areas as suitable for septic systems using 900 ft. drain fields. He also stated that there is gravel on the property. Thomas Anderson stated that the one acre requirement and separate ownership cannot be met. Jo'1llen Hurr stated that a setback variance from the lake for the septic system would be needed and that soils maps do not indicate suitable soils which could be proved otherwise by soil borings. William Reiser asked how many other similar situations there might be in Medina. Ms. Hurr stated that there are at least 10 substandard lots in common ownership and to approve would be inconsistent with what is granted in the Independence Beach area. Thomas Crosby stated that the situation seemed to be unfair. Richard Schieffer stated that to grant a variance the situation would need to be isolated from all others. Thomas Anderson stated that Rerhaps the item should be tabled for two weeks to enable pre- paration of a resolution by x. Crosby which would include reasons to approve. Motion by Crosby, seconded by Reiser to grant a variance to Ray Anderson to build a house on Lot 5, Raskob's JJakeview Addition; variance granted from lot size requirement and common ownership to permit utilization of lot for the purpose for which it was purchased; in effect to conform to adjacent houses on adjacent lots. Hardship being that lot is not buildable without variances which are granted subject to application for whatever other building variances are needed. Motion carried Voting No -Anderson and Lutz Dockside JoEllen Hurr reviewed memo regarding plan review of Dockside units 1,2,3"and 8,9 and 10 2 Y Mr. Spaeth has presnted plans totaling 18,6.56 sq. ft. (including four units previously approved.) The resolution of approval allows for a total of 16,150 sq. ft. She stated that she disagreed that the space marked"»nfinished" would remain as such because the slope of the propery suggests walk -outs and plans do not include type of doors. She stated that she had taken the total square footage and deducted 10% as non -habitable space and arrived at the total of 2506.•sq. ft. in excess of that allowed by resolution. Mayor Anderson explained that the Council is trying to avoid overdevelopment of the area. Thomas Crosby stated that because the three untis have walkouts they can be construed as habitable and he would look differently at the plans if the lower level were entirely underground. Motion by Crosby, seconded by Scherer to endorse interpretation of habitable space in Zoning Administrators memo dated March 2, 1982. Motion declared carried Richard Schieffer advised that Council not issue any building permits on the property until plans for the remaining units have been submitted because the amount of allowable scpsre footage remaining may be short when final unit plans are submitted and the devel- oper may claim he cannot make use of a remaining lot or lots. John Spaeth stated that he disagreed with the interpretation of habitable space square footage. Richard Schieffer advised that Mr. Spaeth redesign the project and resubmit. Motion by Reiser, seconded by Scherer to table the matter until John Spaeth presents revised plans. Motion declared carried Mark Franklin Jotllen Hurr reported that Mark Franklin had sent a letter stating that he no longer needed the resolution regarding radio towers on his property. She stated that she had discussed the matter of the accumulated fees incurred in developing the resolution, withthe city attorney and he had suggested putting a lien on Mr. Franklin's property. Form for collection of fees Joqlen Hurr reported that she had been asked to clarify authority for collection of fees in connection with a form she had sent to WCCO for signature. Richard Schieffer stated that the authority is contained in the ordinance and that the Council need not adopt the form as its main purpose is to inform applicants ofithe cities right to collect fees incurred during consideration of a project. He suggested that Attorney, Mike Nash and WCCO could discuss some sort of agreement for payment of fees if WCCO is concerned about having to pay for any study that might be suggested by anyone. 6. BURLINGTON NORTHERN RAILROAD Richard Schieffer explained that he had discussed the annual charges of $750 by Burlington Northern with Long Lake's Attorney and apparently Long Lake has said that the charges are for an easement not for maintenance,so therefore, Orono and Medina must divide the cost according to their agreement. Mr. Schieffer also explained that under the terms of the agreement the Mayors of the cities involved can hold meetings to clarify certain matters. Thomas Anderson agreed that such a meeting should be arranged. 7. MINNEHAHA CHEEK WATERSHED DISTRICT Donna Roehl explained that 1981 funds in the amount of $744 for replacement of a culvert on Willow Dr., south of Co. Rd. 24, had not been spent and that the WatershedDistrict would like it used or they would keep it in the fund for other use. Wilfred Scherer explained that a request for 1982 funds includes a request to Use the $744 to replace the culvert plus an amount to clean 800 ft. of the ditch as it drains to Wolsfeld Lake. Motion by Reiser, seconded by Scherer to forward application for funds to Minnehaha Creek Watershed District for ditch cleaning and culvert replacement. Motion declared carried 22 8. BILLS Motion by Reiser, seconded by Lutz to pay the bills; Order Checks # 1083-1132 in the amount of $24,757.57 and Payroll Checks # 6574-6606 in the amount of $9839.14. Motion declared carried 9. POLICE DEPARTMENT SEMINARS Motion by Reiser, seconded by Lutz to authorize expenditure of $75.00 for Chief Hoover to attend the Police Chiefs' spring training seminar March 31-April 2, 1982. Motion declared carried Motion by Lutz, seconded by Crosby to authorize Mike Rouillard to attend the DWI Seminar in St. Cloud March 31-April 2, 1982 for a registration fee of $52.00.
