HomeMy Public PortalAboutRES 03/01RESOLUTION 003 -1 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, URGING THE FLORIDA LEGISLATURE TO ENACT LEGISLATION AUTHORIZING COUNTIES AND MUNICIPLAITIES, AT THEIR OPTION, TO COLLECT LOCAL GOVERNMENT CODE ENFORCEMENT FINES IN THE SAME MANNER AS NON -AD VALOREM ASSESSMENTS; PROVIDING FOR DISTRIBUTION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the code enforcement boards of the counties and municipalities of Florida have proven effective in enforcing local ordinances and the standards codes which have been adopted to protect the health, safety and welfare of the public, while affording property owners due process of law and otherwise protecting property rights; and WHEREAS, the objective of local procedures is to cause properties to be local ordinances and the standards codes, the threat of fines is an effective means be taken with respect to properties in and the standard codes; and government code enforcement brought into compliance with not to generate revenue, but of causing remedial action to ,riolation of local ordinances WHEREAS, bringing foreclosure actions to enforce code enforcement liens is difficult, expensive, and often impracticable; and WHEREAS, an effective procedure now exists for the collection of assessment of through the levy of non -ad valorem assessments pursuant to Sections 197.3631 through 197.3635, Florida Statutes, and such procedure should be available to counties and municipalities for the collection of code enforcement fines; NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA THAT: Section 1.
