RESOLUTION NO. 2022.012
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD, COUNTY OF LOS ANGELES, STATE OF
CALIFORNIA, AUTHORIZING THE SUBMITTAL OF
LYNWOOD'S 2021-2029 DRAFT HOUSING ELEMENT TO
THE STATE DEPARTMENT OF HOUSING AND
COMMUNITY DEVELOPMENT (HCD) FOR ADOPTION
AND ADOPTION OF THE MITIGATED NEGATIVE
DECLARATION
WHEREAS, California State law mandates that all California cities and counties
plan for housing needs of their residents; and
WHEREAS, the California Department of Housing and Community Development
(HCD) determines the total number of new homes that need to be built, and level of
affordability of the new homes, in order to meet the housing needs in each region of
California, which is called the Regional Housing Needs Allocation (RHNA); and
WHEREAS, the Southern California Association of Governments (SCAG) receives
the RHNA from HCD for the Los Angeles region which includes the City of Lynwod
("City"); and
WHEREAS, each jurisdiction plans for its housing needs through its Housing
Element, which is required per California State law to be updated on approximately 8-
year cycles; and
WHEREAS, the City's current Housing Element covers the planning period of
2013-2021 and was adopted on August 6, 2013, by the City Council and certified by the
HCD on October 11, 2013; and
WHEREAS, the City of Lynwood has prepared a 2021-2029 Housing Element that
complies with the provisions of State law and is consistent with the other elements of the
Lynwood General Plan; and
WHEREAS, the proposed project has been reviewed pursuant to the California
Environmental Quality Act (CEQA) and an Environmental Initial Study and Mitigated
Negative Declaration (MND) have been prepared by Infrastructure Engineers relative
to potential environmental effects of the project; and
WHEREAS, No potential significant impacts were identified in the Initial Study,
therefore, an Environmental Impact Report was not required; and
WHEREAS, a Mitigated Negative Declaration has been prepared as
environmental documentation for the 2021-2029 Housing Element; and
WHEREAS, The Draft Mitigated Negative Declaration was circulated for public review
December 17, 2021 through January 17, 2022. No comments were received regarding the Draft
MND during the public review period. and did not result in any changes to the Draft MND.
WHEREAS, a public hearing notice was published in the Press Telegram on
December 17, 2021, announcing that the Lynwood City Council will conduct a public
hearing to consider submittal of the amended City Housing Element of its General Plan
(2021-2029 Housing Element) to HCD for approval. In addition, the public hearing notice
was posted at three (3) public locations, which included inside City Hall, outside City Hall
at the kiosk, and on the City website; and
WHEREAS, the City Council of the City of Lynwood has sufficiently considered all
testimony presented to them in order to make the following determination.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS:
Section 1. The City Council of the City of Lynwood hereby finds and determines that all
of the foregoing recitals are true and correct and are incorporated herein by reference.
Section 2. The City Council of the City of Lynwood hereby finds that Lynwood's 2021-
2029 Housing Element for the period October 15, 2021 through October 14, 2029 has
been prepared in accordance with the California Government Code Sections 65580-
65589.
Section 3. The City Council of the City of Lynwood hereby authorizes and directs the
City Manager to submit the City's 2021-2029 Housing Element to HCD for review and
approval, which is attached hereto as Exhibit A.
Section 4. The City Clerk shall certify to the adoption of this Resolution and hereafter
the same shall be in full force and effect.
