HomeMy Public PortalAboutResolution No. 001-54 06-04-1954RESOLUTION # 1 - 1954 THE STATE OF TEXAS COUNTY OF TARRANT TOWN OF RICHLAND HILLS : On this the day of Hay, 195+, the Town Council of the Town of Richland Hills, Texas, convened in Regular Meeting, at the Regular Meeting place, with the following members thereof, to -wit: Homer Norton, C. A. J. Smith, Joe Martin, Cecil Smith, W. F. Owens, Clayton Woodall, being present, with the following absent: Mayor, Aldermen, Town Secretary, constituting a quorum, at which time thefollowing proceedings were had: 44:-� introduced a resolution and made a Alderman ((6,ezr,, motion that it be adopted. The motion was seconded by Alderman('-,, The motion carrying with it the adoption of the resolution prevailed by the following vote: AYES: Aldermen C. A. J. Smith, Martin, Cecil Smith, Owens and Woodall zrat NOES: None. The resolution as adopted is as follows: RESOLUTION BY THE TOWN COUNCIL OF THE TOWN OF RICHLAND HILLS, TEXAS, CALLING AN ETJ CTION ON THE QUESTION OF THE ISSUANCE OF $1,100,000.00 WATERWORKS SYSTEM REVENUE BONDS. WHEREAS, the Town Council of the Town of Richland Hills, Texas, deems it advisable to issue the bonds of said Town for the purposes hereinafter mentioned; HILLS, TEXAS: BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF RICHLAND 1. That an election be held in said Town of Richland Hills, on the 213t day of June, 195+, at which election the following proposition shall be submitted: "Shall the Town Council of the Town of Richland Hills, be authorized to issue the bonds of said Town in the amount of 4,100,000.00, maturing in such installments as may be fixed by the Town Council, the maximum maturity being not more than Thirty Five (35) years from their date, bearing interest at a rate of not to exceed Four and one-half (4-1/2%) per cent per annum, for the purpose of purchasing, improving and extending a Waterworks System for said Town, to be issued in accordance with and secured in the manner provided in Articles 1111-1118, both inclusive, of the Revised Civil Statutes of Texas, 1925, as amended, each bond to be conditioned that the holder thereof shall never have the right to demand payment of said obligation out of funds raised or to be raised by taxation secured by a pledge of the net revenues from the operation of said Waterworks System." 2. That said election shall be held under the provisions of Chapter 1, Title 22 of the Revised Civil Statutes of Texas, 1925, as amended, and only legally qualified electors who own taxable property in said Town and who have duly rendered the same for taxation shall be qualified to vote. 4. The ballots of said election shall have written or printed thereon the following: "FOR THE ISSUANCE OF WAltRWORKS SYSTEM REVENUE BONDS" "AGAINST THE ISSUANCE OF WATERWORKS SYSTEM REVENUE BONDS" Each voter shall mark out with black ink or black pencil one of the above expressions, thus leaving the other as indicating his vote on the proposition. 5. A substantial copy of this resolution signed by the Mayor of said Town and attested by the Town Secretary shall serve as proper notice of said election. Notice shall be given in accordance with Article 704, Revised Civil Statutes of 1925, as amended by Chapter 382, passed at the First Called Session of the Forty Fourth Legislature, supra. The Mayor is authorized and directed to have a copy of said notice posted at the Town Hall and at two other public places within said Town not less than fifteen days prio to the date fixed for holding said election. There being no newspaper publish- ed within this Town, the Mayor shall cause said notice to be published on the ‘de same day in each of two successive weeks in the "IIaltom City News", a newspaper published within Tarrant County and having a general circulation in the Town of Richland Hills. The date of the first publication shall be not less than fourteen days prior to the date set for said election. Except as otherwise provided in said Article 704, as amended, the manner of holding said election shall be governed by the laws governing general elections. 44.o( fMe ADOPTED AND APPROVED this the t day of 44ay, 1954. ayor, Town of Richland Hills, Texas. THE STATE OF TEXAS COUNTY OF TARRANT TOWN OF RICHLAND HILLS I, the undersigned, Town Secretary of the Town of Richland Hills, Texas, do hereby certify that the above and foregoing is a true, full and correct copy of a resolution adopted by the Town Council of the Town of Richland Hills, Texas, (and of the minutes pertaining thereto) on the -2 t J✓y'C day of 141m7, 1954, calling an election on the question of the issuance of ;1,100,000.00 Waterworks System Revenue Bonds, which resolution is of record in the minutes of said Town Council.
