The regular monthly meeting of Savannah Beach City Council
was held this afternoon at 3:00 P.M. in City Hall with Mayor
Allen Hendrix presiding and a quorum consisting of the following
councilmen present: Edward Towns, Karen Losey, Ernest Hosti,
Walter Parker, Earl Anderson and Edward Jung. City Attorney Fred
Clark and. Police Chief John Price were also present.
VISITORS and PETITIONERS present at the meeting were:
Rev. Robert E. Conely, Mr. T. S. Chu, Mrs. Mola Jung, Mr. James
Fabrikant, Mrs. Louise Shaw, Mr. Robbie Robertson, Mr.-Glenn Weaver,
Mrs. James Fabrikant and Mr. Bob Williams.
he invocation was pronounced by the Reverand Robert E.
Connely of the Chapel -by- the -Sea Baptist Church; followed by the
pledge of allegiance to the flag.
The Minutes of the Special Meetings of November 28th,
December llth and December 26th; also, the regular council meeting
of December 19th, were approved as written.
Mr. T. S. Chu, long time Savannah Beach merchant, appeared
before council to request that the flow of traffic on Sixteenth
Street be changed back to move in a west to east direction as it
was prior to the change last summer. Also, appearing with Mr. Chu
was Mr. Bob Williams, vice - president of the Savannah Beach Chamber
of Commerce and owner of the Tides Motel. Both Mr. Chu and
Mr. Williams felt that the change to the present traffic pattern
had seriously damaged business in the area and Mr. Williams
stated that he visited the 16th parking area many times during
the summer months and there did not appear to be as much traffic
as moved through the lot with the old system.
Mrs. Georgia Greisbach requested permission of City Council to
allow her girl scouts to plant trees at various places on the
beach. She asked for written permission to do this and especially
requested that the city mowers be instructed to watch out for the
newly planted trees. Mayor Hendrix turned this request over to
Mr. Hosti and the Department of Public Works to supervise this..
Mayor Hendrix requested that all members of our Board of
Registrars excuse themselves temporarily and then presented the
name of Mrs. Louise Shaw to fill the existing vacancy. He .
reported to council that Mr. Edmund Solomon who was appointed to
the Board at an earlier meeting, had not accepted and that was the
reason for this action. Councilman Earl Anderson asked if Mrs.

Shaw was the recommendation of Mr. Fabrikant, Chief Registrar.
The Mayor stated that it was. Mr. Anderson then moved that Mrs.
Shaw be appointed to the Board. The motion was seconded by
Councilman Hosti and unanimously carried.
BILLS OF THE VARIOUS DEPARTMENTS for the Month of December
were approved for payment.
City Attorney Fred Clark then administered the oath of
office to the following:

Mayor Hendrix then called upon City Attorney Fred Clark
for the first reading of the amendment to the animal ordinance.
After several objections, suggestions and recommended changes,
Mayor Hendrix suggested that before the final reading comes up
next month, that the Police Commissioner and other interested
parties get together and build the ordinance that they feel is
proper - one that we can live with. Councilman Parker then
moved that the Ordinance, as amended, be adopted on first reading.
It was seconded by Councilman Anderson and unanimously carried.
City Attorney Fred Clark informed Council that two more
problems had arizen in our Social Security program that needed
handling by Council - one of them being whether or not we should
pay in for our elected officials who were paid a small salary -
and the other being an option to be given to all city employees
who were eligible for membership in a Public Retirement System,
to decide in a referendum whether or not they desire Social Secu-
rity coverage. It was explained that the Public Retirement System
in this instance being the Georgia Firemen's Pension Fund and
the employees involved being our paid firemen.
After a lengthy discussion on these two options, a motion
was made by Councilman Hosti that Council elect NOT to have
deductions made on the salaries of the City's elected officials.
The motion was seconded by Councilman Towns and unanimously
carried.
In order to explain the second option to Council, which
has reference to the. City's paid firemen, the Clerk read a portion

of a letter dated January 2, 1974 which he said had been received
from Employees Retirement System, our Social Security Agency,
as follows:
"On or before February 15, 1974, each of your paid firemen who are
members or eligible for membership in the Georgia Firemen's Pension Fund,
should be given a copy of the Notice of Referendum which will be held on
May 15, 1974 for Docial Security purposes. Those who vote "yes" will be
covered and those who vote "no" or fail to vote will not be covered.
Each fireman, who is a member or eligible for membership in the Goerig
Fireman's Pension Fund on May 15, 1974 should be allowed to vote for
Social Security purposes. Also, we want to emphasize that all new firemen
employed after the referendum is held on May 15, 1974, will automatically
be covered for Social Security purposes as of the date of employment
regardless of their wishes in the matter or their membership status in the
Georgia Firemen's Pension Fund."
"It is our suggestion that you continue to include your firemen
on your regular Social Security reports jast as you have been doing,
bearing in mind they cannot be officially covered until the referendum is
held on May 15, 1974 and coverage finally approved for them by the
Federal Authorities."
Following the explanation, Councilman Anderson moved that
Council, by unanimous consent, adopt the following Ordinance on
first and second readings at this meeting, which would by refer-
endum, give our two paid firemen the choice of electing to make
social security payments or not; and, at the same time, make it
mandatory for all new firemen employed after the referendum is
held on May 15, 1974, be automatically covered for Social Security.
ORDINANCE
Unanimous consent was given to adopt this Ordinance on
first and second reading at this meeting. The motion was then
seconded by Councilwoman Karen Losey and unanimously carried.
With reference to the proposal by the City of Savannah Beach
to annex the whole of Tybee Island, Councilman Parker read a
Resolution requesting that the Georgia General Assembly enact
the necessary legislation at this 1974 Session to enable the
City to submit the proposal to the electors in the affected area
on April 1, 1974, the date of our regular municipal election.
It was explained that this issue would be put on a, separate machine.
RESOLUTION
It was noted that this Resolution was adopted by Council at
the regular council meeting on December 19, 1973.

Councilman Hosti informed Council that our back hoe had
become obsolete; that it was approximately six years old and broken
down. He also stated that, at the cost of putting it in good con-
dition, he did not feel we were justified in keeping it. He
stated further that we had gotten a tractor from Ford Fincher Tractor,
the list price of which was approximately $15,000.00. He stated that
our price, as a municipality, was $11,837.00. And, with the trade -in .
for old machine of $2,200.00, it made the City's price $9,637.00. He
stated further that since this equipment would be used mostly by
the Sewer and Water Department, Mr. Hutton had authorized its purchase
with funds from our Sewer -Water Construction Fund which. contained
$40,000.00 for purposes of this kind. He then moved that this back-
hoe be purchased with money from this account. The motion was
seconded by Councilman Parker and unanimously carried.
Mayor Hendrix stated that Mrs. Beverly Hatch of the Savannah
Beach Library Board had requested council to obtain some additional
shelves for the library and had supplied him with a description of
what they wanted; together with a price for building and installing
them. He stated that the shelves they wanted were three custom - built,
fruit - finished, 48 -inch birch book cases; and, the bid submitted by
Wilmington. Cabinet Shop was in the amount of $420.86. Councilman
Jung moved that this proposal be referred to the Library Committee
with power to act. The motion was seconded by Councilman Anderson and
unanimously carried.
In regard to the Tybee Island Beach Erosion Control Project,
and the various agreements which have been entered into between the
United. States of America, the State of Georgia, Chatham County and
the City of Savannah Beach, City Attorney Fred Clark stated that,
acting on a request of the Chatham County Commission he had prepared
a Resolution which, in effect, states that as time passes including
the period after completion of the initial phase of the.
Project and if the financial condition of the City of Savannah
Beach improves substantially that we will re- evaluate the costs-
sharing formula between the City and the State at any time that
the financial condition of the City of Savannah Beach has evidenced a
substantial change. He then read the Resolution:

Following the reading of this Resolution, Councilman Parker
moved its adoption. It was seconded by Councilman Hosti and Unani-
mously carried.

Mayor Hendrix announced that he had made some changes
in the standing committees and chairmen and so that they might be
entered upon the Minutes of this meeting, he would like to read

ORDINANCE
An ordinance, declaring the policy and purpose of the city
of Savannah Beach, Georgia, to extend to the employees and
officials of said city and its instrumentalities, not excluded
by law or by this ordinance, the benefits of the systems of
Federal Old Age and Survivors Insurance, as authorized by the
Federal Social Security Act, the State Enabling Act, and '
amendments thereto, upon the basis of applicable State and
Federal laws or regulations; authorizing and directing the
Mayor, or other chief executive officers, to execute agreements
and amendments thereto with the Employees' Retirement System of
Georgia, for coverage of said employees, and officials of said
city shall appropriate and pay over for employer's contributions,
administrative expenses, and a guaranty fund as provided by
applicable State or Federal laws or regulations; providing that
said city shall keep records and make reports as required by
applicable State or Federal laws or regulations; excluding
from this ordinance any position,employee or official not
authorized to be covered under applicable State or Federal laws
or regulations.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SAVANNAH BEACH, Georgia, as follows:
Section 1. It is hereby declared to be the policy and
purpose of the city of. Savannah Beach, Georgia, to extend at the
earliest date possible under the agreement entered into by the
State of Georgia and the FederalSocial Security Administration,
to the employees and officials thereof, and its instrumentalities,
not excluded by law or by this ordinance, the benefits of the
System-of Old Age and Survivors Insurance as authorized by the
Federal Social Security Act, the State Enabling Act, and amend-
ments thereto. In pursuance of said policy, and for that purpose,
the city shall take such action as may be required by applicable
State or Federal laws or regulations.
..Section 2. The Mayor, or other chief executive officer, of
the city of Savannah Bdach,.Georgia, is hereby authorized and
directed to execute all necessary agreements and amendments
thereto with the Employees' Retirement System of Georgia for
coverage of said employees and officials as provided for in
Section 1 hereof, (to) include any *employees that are in positions
covered by a public retirement system, in the manner by said
law provided. *(namely, firemen)
Section 3. Withholdings from salaries or wages of employees
and officials for the purpose provided for in Section 1 here-
of are hereby authorized to be made in the amounts and at such
times as may be required by applicable State or Federal laws
or regulations, and shall be paid over to the State Agency.
Section 4. There shall be appropriated from general funds
such amounts at such times as may be required by applicable State
or Federal laws or regulations for employer's contributions,
administrative expenses, and such funds shall be paid over to
the Employees' Retirement System of Georgia in accordance with
regulations established by said Agency.
Section 5. The city shall keep such records and make such
reports as may be required by applicable Slate or Federal laws
or regulations.
Section 6. There is hereby excluded from this ordinance any
authority to make any agreement with respect to any position, or
any employee or official or official not authorized to be covered
by applicable State or Federal laws or regulations.
Section 7. This ordinance shall take effect upon its approval
and publication as required by law.

hereinafter called 'Political Subdivision," does hereby apply to the Board of Trustees of the Bmployeee-
Retirement System of Georgia, created and established by Act No. 3& of the 1949 Session of the Gene:
Assembly, as amended, hereinafter called the `State Agency," pursuant to the provisions of Act No. 82 of
the 1956 Session of the General Assembly,.to extend the insurance system established by Title LT of the-
Social Security Act to services performed by individuals as employees of the Political Subdivisions.
The Polities Subdivision submits for the State
come effective on the date hereinafter stated.
. I. Definitions _

• For purposes of this plan and agreement:

(a) The term "employee" means an employee as defined in Section 210 (J) of the Social
Security Act and shall include an officer or elected Official of the Political Subdivision.
(b) The term "retirement system" means. a pension, annuity, retirement, or similar fund or
system established by the State of Georgia, or by the Political Subdivision. •

This agreement includes and covers all services performed by individuals as employees of the.
• Political Subdivision, except:
(a) Any service performed by an employee in a position which, on the date of execution of this
agment, is covered by a retirement system. (Unless- covered after .a referendum)
. (b) Semites performed by. an employee who is employed to relieve him from unemployment.
(c) Service performed in a hospital, home or other institution by an inmate thereof. •
(d) Service of employees of transportation systems who are covered compulsorily under the
Social Security program.
(e) Service of an emergency nature..
(f). Agricultural labor or service performed by a student, if such work *would be excluded if
performed by a private employee
(g) Service which is excluded from employment by any provisions of Section 210 (a) of . the
. Social Security Act, as amended, other than paragraph 8 of such section:

Agency may by regulation prescribe, an amount equal to the Political Subdivision's share
of the. cost of administration of the State Agency, such amount to be not greater than five
per cent of the 'contributions made by the Political Subdivision under paragraph (a) of
this section.
(f) The Political Subdivision agrees to impose upon each of its employees (and officers) as to
. services covered by this agreement, a contribution with.respect to wages, not exceeding the
amount of tax which would be imposed under the Federal Insurance Contribution Act if
.such services constituted employment within the meaning of that Act, and to deduct the-
' ' ' amount of Such contribution from his wages as and when paid. Contributions so collected .
shall be paid into the Contribution Fund in the State Agency in partial discharge of the
. liability of the Political Subdivision under subsection (c) of Section 4 of Act No. 734,195; _
Session of the General Assembly. It is agreed and understood that the failure of said polit-
ical. subdivision to deduct such contributions shall not relieve the employee nor the Politi.
cal Subdivision of liability therefor.
V: Adjustment, refunds and interest on delinquent payments
(a) If more than the correct amount due under Part IV of this plan and agreement is paid with
, respect'til• any remuneration, proper adjustment (or refund; if adjustment is-impracticable) \Shutt°lie made without•interest in such manner and at such tinges as the State Agency shall, -

(b) • If the Political Subdivision does not make,: at the time or times due, the payments required
under this plan and agreement,. there shall be•added, as-part of the amounts du

cretion may direct the proper state agency to deduct such delinquent amounts plus interest.

VI.. Termination
(a) The Political Subdivision may request the State Agency to • take all necessary steps with
. the Social SecurityAdministration, pursuant to Section, 218
to terminate this plan and agreement (g) of the Social Security Acts .
P greement either in its entire application to the Political Subdi ..,
vision or with respect- to any coverage group. Upon good cause shown at a time and in a
manner to•be specified•by the State Agency, the State Agency shall give n o t i c e to the •
Social Security:. Administration required by Section 218 .(g) of the Social Security Act for
the purpose of granting the-requested termination to the Political Subdivision.
. (h) If the -State Agency, after...notice and opportunity for hearing to the Political Subdivision,
finds that there has been a failure to comply substantially•with any provision contained in
this. plan and agreement and /or-in said State Act, it may terminate this plan in its 'entirety,
such termination to take effect -at the time prescribed in such notice and on such conditions
as may be provided by regulations of the State Agency, and as may be consistent with the -
provisions of the Social Security Act. -
VII. Modification
This plan and agreement may be modified at the request of the Political Subdivision, to
include coverage groups or services in addition to those now included by this plan. Such
modification must be consistent with Act No. 734, 1953 Session of the General Assembly,
. approved December 21, 1953, and the provisions of Section 218 of the Social Security Act.
Agency may by regulation prescribe, an amount equal to the Political Subdivisions share-
of the cost of administration of the State Agency, such amount to be not greater than five
per cent of the contributions made by the Political Subdivision under paragraph (a) of
this section.
(f) The Political Subdivision agrees to impose upon each of its employees (and officers) as to
services covered by this agreement, a contribution with respect to wages, not exceeding the
amount of tax which would be imposed under the Federal Insurance Contribution Act if
such services constituted employment within the meaning of that Act, and to deduct the
amount of such contribution from his wages.as and when paid. Contributions so collected
shall be paid into the Contribution Fund in the State Agency in partial discharge of the
liability of the Political Subdivision under subsection (c) of Section 4 of Act No. 734, 1953
Session of the General Assembly. It is agreed and understood that the failure of said polit-
ical subdivision to deduct such contributions shall not relieve the employee nor the Politi-
cal Subdivision of liability therefor. -

VI. Termination

III. Administration of the Pia te Reports .Comjalivaace with regulations
The Political Subdivision agrees and has heretofore authorized and directed the appropriate of-
ficers and employees to do and perform all things found necessary by the State Agency to the
proper and efficient administration of the plan, including but not limited to the maintenance or
employment records relating to both services and salaries, required contributions by butte the- -
Political Subdivision and its employees and other data required by the State Agency or the-
Social Security Administration, to make such reports in such firm and containing such infuannac
lion as the State Agency may from time to time require,` and to comply.with such provisions.
the State Agency or the Social Security Administration may from time to time find necessary ifs-
assure the correctness and verification of such reports.
IV. Contributions
(a) The Political Subdivision will pay into the Contribution Fund established by Act. No. 734,,
1953 Session of the General Assembly, with respect to wages as defined in Act No. 82, 1956
Session of the General Assembly, at such time or times as the State Agency may by regula-
tion prescribe, contributions • equivalent to the sum of the taxes which would he imposed.`
by under the Federal Insurance Contribution Act if the services covered by this plan and.. -
agreement constituted employment as defined in such Act.
(b) The Political Subdivision agrees to appropriate from funds under its control in each and
every year this contract shall be and remain in force, sufficient sums of money to insure the
payment of the obligations of the Political Subdivision to the State Agency, including the
Political Subdivisions share of administrative expense, imposed by this contract for the
ensuing fiscal year. All such appropriated sums shall be covered into a revolving fund, 10
be created by the Political Subdivision, which shall be devoted exclusively to the payment
of the obligations imposed under this contract, as and when the same shall become due
and payable, until all of such obligations shall have been satisfied in full.
(c) As assurance of its ability to pay its share of the contributions which will become due and
payable to the State Agency under the terms of this agreement, and assurance that said
contributions will be adequate, the Political Subdivision.agrees to and shall advance to the
Contribution Fund, an amount-equal to the contributions (employer

vided for in subsection (a) of this section that would be made for a period of two years,
which shall be credited to the Political Subdivision in the Contribution Fund Account. The --
contribution shall be arrived at in the first instance by a fair estimate based on the payroll
. for the last month of the previous calendar quarter; provided, however, that said advance-
ment
may be adjusted from time to time as the State Agency may require and when ad-
justed the estimate shall be based on the payroll for the calendar gatartcr inamediately-
preceding the date of the adjustment. The advancement provided for herein may be used
by the State Agency to offset any unpaid financial obligation incurred by. the Political Sub-
division hereunder, and for no other purpose, and may be applied thereto summarily, but
such use shall not relieve the Political Subdivision of such obligation to the State Aget;cy,
provided, however, no advancement by the Political Subdivision shall be applied to the
default of any other political subdivision.
(d) The foregoing - -
g g provisions with reference to the advanced deposit shall apply except the -
State Agency may waive such deposit where applicable, and in lieu of the advanced de-
posit to secure the State in event of default on the part of the political subdivision, it is
hereby understood and agreed to by the political subdivision that in case of delinquency in
making reports and contributions when due, any funds due said political subdivision by
any State Department or the State Treasurer, shall be withheld until such reports and
contributions have been made to the State Agency as provided for in Section 4 (e) or 4 (f)
of Act No. 734, Georgia Laws 1953, or Section 4 of Acr. No. 561, Georgia Laws 1967,
or Act No. 408, Ga. Laws 1973, approved 4�T17/73, whichever is applicable.
(e) The Political Subdivision will pay to the State Agency, at such time or times as the State

R E S O L U T I O N
WHEREAS the City of Savannah Beach, Tybee Island,
Georgia, has heretofore entered into agreements between the
United States of America, the State of Georgia, and Chatham
County, in furtherance of the Beach Erosion Control Project,
and
WHEREAS, it is anticipated that the financial con-
dition of the City of Savannah Beach, Tybee Island, Georgia,
will improve substantially as time passes including the period
after completion of the initial phase of the said Project, and
WHEREAS, it is the desire of the City of Savannah
Beach, Tybee,Island, Georgia, and the State of Georgia to re-
evaluate the costs sharing formula between the City and State
to reflect the financial condition of the City of Savannah
Beach, Tybee Island, Georgia, and its ability to contribute
an increased amount to the said Project,
NOW, THEREFORE, BE IT RESOLVED that the City of
Savannah Beach, Tybee Island, Georgia, in Council Assembled
does hereby authorize its Mayor to consult with the officials
of the State of Georgia to re- evaluate the contributions and
the costs sharing formula between the City and the State at

change.
