City Manager Pirrie invited all to attend the City's Veterans Day ceremony on November 11, announced that the second draft of the Sixth Cycle Housing Element Update has been released City Council Minutes November 8, 2022 Page 2 and is available for review on the City's website, and invited all to participate in the motel ordinance community listening session on November 29. PUBLIC COMMENT This item starts at 04.37 in the archived video. Mayor Leano invited public comment. Maria shared an audio clip of those speaking in support of the Laemmle theatre. Melanie spoke in support of the Laemmle theater and asked that the City Council preserve 450 West Second Street as an independent movie house. Unidentified speaker spoke in support of the Laemmle theater and asked for an update on the process and sale of the Laemmle theater. Peter Saeta spoke in support of walkability in the City as well as bicycle transportation. He encouraged the City Council to create a plan that would make the thoroughfares in the City more bicycle friendly. Chloe Vettier asked for better treatment of bicyclists in Claremont and raised concern regarding cars being parked in bike lanes. Priscilla Espinoza, Claremont Helen Renwick Library, shared upcoming events taking place at the Library. Allison Henry spoke in support of the second draft of the Sixth Cycle Housing Element Update as it addresses tenants, high rents, and unstable living conditions. Unidentified speaker asked City staff to address the lack of lighting at the intersection of Bonita Avenue and Berkeley Avenue. Camilla introduced the Claremont Tenants United organization and shared that the organization seeks to gather the voices of Claremont renters and looks forward to drafting tenant protection ordinances. There were no other requests to speak Brad Johnson, Community Development Director, responded to questions raised during the public comment period. He shared that the property of the Laemmle theater is currently in escrow, contingent upon a development approval, and hopes to bring the new project for this property to be heard before the Planning Commission to review in January. The City is analyzing a number of streets that will address various bicycle and pedestrian improvements. Mr. Johnson responded to questions from the City Council regarding parking in bike lanes, and public notification for the development project to be reviewed by the Planning Commission in January. City Manager Pirrie confirmed that the lighting at Bonita Avenue and Berkeley Avenue will be analyzed. Adoption of a Resolution Approving the City Warrant Register Adopted Resolution No. 2022-67, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLAREMONT, CALIFORNIA, ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID, dated October 27, 2022. 2. City Council Minutes of October 25, 2022 (Regular) Approved and filed the regular City Council meeting minutes of October 25, 2022. 3. Resolution Reconfirmina the Existence of a State of Emeraencv due to the COVID-19 Pandemic Adopted Resolution No. 2022-68, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLAREMONT, CALIFORNIA, RECONFIRMING THE EXISTENCE OF A STATE OF EMERGENCY DUE TO THE COVID-19 PANDEMIC. 4. Cancellation of the December 27, 2022 Regular City Council Meeting Cancelled the regular City Council meeting of December 27, 2022. 5. Administrative Review of the Local Hazard Mitigation Plan (Funding Source: General Fund) Received and filed the administrative review of the Local Hazard Mitigation Plan. 6. Authorization to Amend the Existina Contract with the Lawton Group/Carestaf Inc. Extending the Term and Increasing Compensation for Professional Temporary Employment Services (Funding Source: General Fund) Authorized the City Manager to execute an amendment to the existing contract with the Lawton Group/Carestaf Inc. for temporary professional employment services, extending the term by six additional months through June 30, 2023, and adding additional compensation in the amount of $36,300 to cover the costs of temporary staffing through June 30, 2023. 7. Authorization to Amend the Eden Inforum Gold Support Aareement to Extend the Term and Increase Compensation (Funding Source, Technology Fund) Authorized the City Manager to amend the agreement with Tyler Technologies, Inc. for maintenance services and support of the Eden Inforum Gold Financial system, extending the term from January 1, 2023 to December 31, 2024 in the amount of $63,485 for the period of January 1, 2023 through December 31, 2023 and $65,707 for the period of January 1, 2024 through December 31, 2024. Purchase of an Advanced Backup System and Authorization to Enter Into An Agreement for Cloud -Based Storage Services (Funding Sources: American Rescue Plan Act Fund and General Fund) A. Approved the purchase of the Dell Integrated Data Protection Device system from Abtech Technologies in the amount of $29,224.18 and authorize the City Manager to execute the purchase agreement; and B. Authorized the City Manager to enter into a two-year agreement with StorTrust in the amount of $40,656.00 for cloud -based storage services. 9. Adoption of a Resolution Approving a Negotiated Exchange of Property Tax Revenues Associated with the Annexation of One Single -Family Home Located at 3560 Padua Avenue (APN 8671-002-018) Into County Sanitation District No. 21 to Receive Off -Site Disposal of Sewage Into the City Sanitary Sewer System (Annexation 770) Adopted Resolution No. 2022-69, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLAREMONT, CALIFORNIA, APPROVING AND ACCEPTING THE LOS ANGELES COUNTY SANITATION DISTRICT'S REQUEST FOR A NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUES ASSOCIATED WITH ANNEXATION NO.770, CONSISTING OF OFF -SITE DISPOSAL OF SEWAGE FOR ONE SINGLE-FAMILY LOT WITH ONE EXISTING SINGLE-FAMILY RESIDENCE LOCATED AT 3560 PADUA AVENUE (APN 8671-002-018); AND AUTHORIZING EXECUTION OF A JOINT RESOLUTION WITH ALL AFFECTED AGENCIES. 10. Second Reading and Adoption of an Ordinance Imposing a Temporary Moratorium on No -Fault, Substantial Remodel Evictions for Certain Residential Tenancies in the City of Claremont (Funding Source: General Fund) This item was removed from the Consent Calendar. Councilmember Calaycay moved to approve Consent Calendar Items No. 1-9, seconded by Councilmember Stark, and carried on a roll call vote as follows: AYES: Councilmember — Calaycay, Leano, Medina, Reece, Stark NOES: Councilmember — None Item Removed from the Consent Calendar 10. Second Reading and Adoption of an Ordinance Imposing a Temporary Moratorium on No -Fault, Substantial Remodel Evictions for Certain Residential Tenancies in the City of Claremont (Funding Source: General Fund) This item starts at 39.06 in the archived video. Councilmember Reece recused himself from the discussion and left the meeting as he is a landlord in Claremont. Mayor Leano invited public comment. Allison Henry suggested the number of units allowed to be exempt from the ordinance be studied in order to provide maximum tenant protections. Rachel Forester questioned if Councilmember Reece owns property consisting of more than 20 rental units in the City and if he does not, would he be able to participate in future discussions regarding tenant protections. City Attorney Patterson responded to a question raised during the public comment period and explained that Councilmember Reece's ability to participate in future discussions would need to be evaluated further depending on the property or properties owned by Councilmember Reece. Councilmember Calaycay moved to adopt Adopted Ordinance No. 2022-07, AN UNCODIFIED ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLAREMONT, CALIFORNIA, ESTABLISHING A TEMPORARY MORATORIUM ON CERTAIN "NO FAULT" RESIDENTIAL EVICTIONS DUE TO A PROPERTY OWNER'S INTENT TO SUBSTANTIALLY REMODEL THE TENANT'S UNIT IN THE CITY OF CLAREMONT, seconded by Councilmember Stark, and carried on a roll call vote as follows: AYES: Councilmember— Calaycay, Leano, Medina, Stark NOES: Councilmember — None ABSENT: Councilmember — Reece PUBLIC HEARINGS - None ORDINANCES - None ADMINISTRATIVE ITEMS - None ADJOURNMENT Mayor Leano adjourned the meeting of the Claremont City Council at 7.14 p.m. The next regular meeting of the Claremont City Council will be held on Tuesday, November 22, 2022, at 6.30 p.m., in the Claremont Council Chamber.
