FOR THE 2022-23 SIDEWALK REHABILITATION PROJECT TO PROVIDE SIDEWALK REPAIR AND REPLACEMENT SERVICES (FUNDING SOURCE: MEASURE R FUND) SUMMARY Each year, the City of Claremont completes a Sidewalk Rehabilitation Project in which a different area of the City is identified for work to address sidewalk lifts and deviations. The available funding for this year's project will allow for the repair and replacement of over 35,000 square feet of sidewalk and over 4,000 square feet of driveway approaches. Staff has compiled a list of known sidewalk deviations over the past year and developed the scope of work for this project. A Notice Inviting Bids was issued in September 2022. At the end of the bid period, nine bids were received, with DM Contracting, Inc. being the lowest responsive bidder. Following the award of contract, the project will be ready to proceed. RECOMMENDATION Staff recommends that the City Council: A. Award contract to DM Contracting, Inc. and authorize the City Manager to enter into an agreement with DM Contracting, Inc. in the amount of $369,400 with a project contingency of ten percent ($36,940), for a total of $406,340, to provide sidewalk repair and replacement services at identified locations throughout the City; B. Authorize the City Manager to enter into an agreement with RKA Consulting Group in the amount of $25,000 for monument preservation. CLAREMONT Page 1 of 3 Printed on 11/17/2022 ALTERNATIVES TO RECOMMENDATION In addition to the recommendation, there are the following alternatives: A. Refer the item back to staff for additional information. B. Reject all bids and direct staff to rebid the project. FINANCIAL REVIEW The 2022-23 Sidewalk Rehabilitation Project, which includes surveying, inspection, removal, and replacement services at locations throughout the City, is solely funded through restricted Measure R Funds. No General Fund monies will be used for this project. The City allocated $550,000 as part of its adopted Capital Improvement Program (CIP) budget and approved carryforwards in 2022-23 for the Sidewalk Rehabilitation Project. The proposed cost for the scope of work for the removal and replacement services performed by DM Contracting, Inc. is $369,400. Staff requests awarding $369,400 to DM Contracting, Inc. and recommends a project contingency of ten percent, or $36,940. The total cost of the contract will be $406,340. In addition to the agreement with DM Contracting, Inc. for removal and replacement services, staff proposes to retain the services of RKA Consulting Group to provide contract monument preservation services at a cost of $25,000. This brings the total project cost to $431,340. The staff cost to prepare this report and administer this project is estimated at $2,896 and is included in the operating budget of the Community Services Department. ANALYSIS As a community with thousands of trees, there are many locations in Claremont where sidewalks have lifted, creating deviations that can lead to trip -and -fall incidents. Per the California Joint Powers Insurance Authority (CJPIA), a deviation of three-quarters of an inch (3/") or greater between abutting sidewalk slabs represents a priority repair. Annually, the City compiles a list of known sidewalk deviations throughout the City. This list is then used to develop a scope of work for the annual Sidewalk Rehabilitation Project. The project this year will address deviations at identified locations throughout the City. The City will retain the services of RKA Consulting Group to conduct the monument preservation process. Monument pins define the line between properties and are often found on sidewalks or curbs. RKA Consulting Group will work throughout the project to ensure that monument pins are preserved and recorded according to State law. In September 2022, the City issued a Notice Inviting Bids for sidewalk removal and replacement services as part of the Sidewalk Rehabilitation Project. The bid period closed on October 18, 2022, with nine bids received. Submitted bids ranged from $369,400 from DM Contracting, Inc. to $747,000 from Gentry General. Staff recommends awarding a contract to the lowest responsive bidder, DM Contracting, Inc., in the amount of $369,400 for the removal and replacement of sidewalk deviations. DM Contracting, Inc. is a reputable concrete repair company that has been in business for over twenty years and has completed similar jobs for the cities of Highland, Colton, Rancho Cucamonga, and Upland, with CLAREMONT Page 2 of 3 Printed on 11/17/2022 favorable references. RELATIONSHIP TO CITY PLANNING DOCUMENTS Staff has evaluated the agenda item in relationship to the City's strategic and visioning documents and finds that it relates to the following: Council Priorities, Sustainable City Plan, General Plan, and the 2022-24 Budget. CEQA REVIEW This item is not subject to environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and Section 15060(c)(3) (the activity is not a "project" as defined in Section 15378).
