AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO TRANSFER PROPERTY OWNED BY THE CITY OF
JEFFERSON TO THE MISSOURI HIGHWAYS AND TRANSPORTATION
COMMISSION IN CONJUNCTION WITH THE LAFAYETTE STREET INTERCHANGE
PROJECT.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and directed to sign
the Donation Letter and Waiver of Appraisal attached hereto as Exhibit A.
Section 2. The Mayor and City Clerk are hereby authorized and directed to sign
the General Warranty Deed attached hereto as Exhibit B.
Section 3. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.

The Missouri Department of Transportation is pleased to inform you of an improvement planned_for your
area. Engineering drawings which describe the proposed project are attached.
We.do want to inform you of your right to receive compensation for the land and/or property rights in
question, as determined.by an appraisal Of the rights to be acquired froth your property. 1
We are hopeful that, because of the benefits to be derived from the project,me can reach an agreement with r
You to donate the required land and/or property rights to accomplish the proposed constuction. Should you

choose to donate, we would appreciate your signing this letter, waiving your right to compensation and pro j
rata tax adjustment and returning it to us. To comply with regulations, we will also need your signature later I
on a formal conveyance document.

An acquisition brochure is furnished'withthis letter. It's purpose is to explain the process which must be
followed to acquire right of way. 1

GENERAL WARRANTY DEED
THIS AGREEMENT, made the day of , 20 , by and between
CITY OF JEFFERSON, A Municipal Corporation, Grantor, of the County of Cole, and State of
Missouri, and the STATE OF MISSOURI, acting by and through the MISSOURI HIGHWAYS AND
TRANSPORTATION COMMISSION, Grantee, P. O. Box 718,Jefferson City, Missouri, 65102.
Grantor, in consideration of the sum of One Dollar and Other Valuable Consideration, to be
paid by the Missouri Highways and Transportation Commission, the receipt of which is hereby
acknowledged, does hereby grant, bargain and sell, convey and confirm fee simple title in the property
described in this deed. •
Grantor conveys to the Missouri Highways and Transportation Commission of Missouri the
following described real estate and interests in real estate in the County of Cole, State of Missouri:

A tract of land situated in the Southwest Quarter of the Southwest Quarter of Section 8, and the
Northwest Quarter of the Northwest Quarter of Section 17, Township 44 North, Range 11 West, (also
being Part of(plot No. 746 in the City of Jefferson, Missouri), in the County of Cole, State of Missouri,
more particularly described as follows:
All the land of said grantors lying within the following described tract: (This conveyance includes all the
realty and realty rights described in the following paragraphs that lie within the limits of a tract of land
described and recorded with the Cole County Recorder of Deeds in Book 369 Page 510).
Beginning at a point on the hereinafter described Realigned Route 50 Centerline Station 10+67; thence
northeasterly to a point 150 feet left of Centerline Station 10+67; thence southeasterly to a point 155.62
feet left of Centerline Station 11+86.43; thence southeasterly to a point 185 feet left of Centerline Station
12+35; thence southeasterly to a point 201.59 feet left of Centerline Station 13+94.74; thence
southeasterly to Centerline P.T. Station 17+68.63; thence along a curve to the left, the radius being
8000.00 feet, the central angle being 03 deg. 54 min. 23 sec., the arc length being 545.43 feet to

Realigned Route 50 Centerline P.C. Station 12+23.20; thence N 51 deg. 28 min. 02 sec. \Vest a distance
of 156.20 feet to the point of beginning.
All of grantor's land in the above described tract is 12,577 square feet, more or less.
Also, all abutters' rights of direct access between the highway known as Route 50 and grantors' abutting
land in the Southwest Quarter of the Southwest Quarter of Section 8, Township 44 North, Ranee 11 West,
in the County of Cole, State of Missouri.
The Centerline of Route 50 and Realigned Route 50 is described as follows: Commencing at a steel
Right-Of-Way marker at the Northeast Corner of Inlot No. 719, City Of Jefferson, as shown on MoDOT
Project 50-U-1(7)(1962)_ accepted by Joseph NI. Bax. L.S. 2300; thence S 25 deg. 05 min. 16 sec. W a
distance of 134.79 feet (Project 50-U-1(7) = S 26 deg. 06 min W - 135 feet) to Existing Route 50
Centerline P.O.T. Station 34+14.4; thence coincident with said Centerline the following courses: S 48
deg. 09 min. 23 sec. F a distance of 244.20 feet to Route 50 Centerline P.C. Station 36+58.60; thence
along a curve to the left, the radius being 5653.67 feet, the central angle being 03 deg. 18 min. 38 sec., the
arc length being 326.67 feet, the chord being S 49 deg. 48 min. 43 sec. F a distance of 326:62 feet to
Existing Route 50 Centerline P.T. Equation Station 39+85.27 BK. = Route 50 Realignment P.C.C. Station
0+00.00 ATI. ; thence coincident with the Route 50 Realignment the following courses: along a curve to
the left, the radius being 5653.67 feet, the central angle being 02 deg. 36 min. 01 sec., the arc length being
256.59 feet, the chord being S 52 deg. 46 min. 03 sec. E a distance of 256.57 feet to Realigned Route 50
Centerline P.R.C. Station 2+56.59; thence along a curve to the right, the radius being 6000.00 feet, the
central angle being 02 deg. 36 min. 01 sec., the arc length being 272.31 feet, the chord being S 52 deg. 46
min. 03 sec. E a distance of 272.29 feet to Realigned Route 50 Centerline P.T. Station 5+28.90; thence S
51 deg. 28 min. 02 sec. F a distance of 694.30 feet to Realigned Route 50 Centerline P.C. Station
12+23.20; thence along a curve to the right, the radius being 8000.00 feet, the central angle being 03 deg.

545.33 feet to Realigned Route 50 Centerline P.T. Station 17+68.63; thence S 47 deg. 33 min. 39 sec. F a
distance of 100.90 feet to Realigned Route 50 P.O.T. Equation Station 18+69.53 BK. =Existing Route 50
Centerline Station 58+54.26 AI-I.; thence coincident with Existing Route 50 Centerline, S 47 deg. 33 min.
39 sec. E a distance of 145.74 feet to Existing Route 50 Centerline P.O.T. Station 60+00.00; thence
departing said Centerline, N 20 deg. 33 min. 28 sec. W a distance of 499.86 feet to a 5/8"X24" rebar with
aluminum cap at the Northwest corner of Inlot No. 753. City of Jefferson, witnessed by Joseph M. Bax,
L.S. 2300.
Grantee shall obtain all rights, privileges, appurtenances and•immunities belonging to Grantor, its
successors and assigns forever.
Grantor hereby covenants that it is lawfully seized of an indefeasible estate in fee in the premises
herein conveyed. Grantor covenants that it has good right to conVey the property. Grantor covenants that
the said premises are free and clear of any encumbrances done or suffered by it or those under whom it
claims; and that it will warrant and defend the title to said premises unto the Missouri Highways and
Transportation Commission and unto its successors and assigns, forever, against the lawful claims and
demands of all persons whomsoever.
