HomeMy Public PortalAbout19740302SCMeetingSavannah Beach, Georgia March 2. 1974 A Special Called Meeting of City Council was held this evening at 7:30 P.M. for the following purposes: 1. Accepting qualifications of candidates for Mayor and Councilmen for the Municipal Election to be held on April 1st, 1974 2. To name an Election Manager, two Assistant Managers, and five Clerks to be the poll workers in the election 3. To consider and take some action on several fiscal matters such as transfer of funds and authorizing loans. 4. And for other purposes. The Meeting was presided over by Mayor Hendrix and a quorum of the following Councilmen was present: Karen Losey, Ernest Hosti, Walter Parker, Earl Anderson and Edward Jung. City Attorney Lance Smith was also present. Visitors at the meeting were: Mr. Ed. Buttimer, Mr. Robbie Robertson, Mr. James Bond III and Mr. James Fabrikant. A Resolution authorizing the Mayor and Council to conduct an election for the office of mayor and six councilmen on April 1, 1974 was read by the Clerk. RESOLUTION Councilman Parker moved the adoption of the Resolution. The motion was seconded by Councilman Anderson and unanimously adopted. The Clerk reported the following candidates as having qualified for the Election on April 1,1974. LIST OF CANDIDATES Councilman Jung moved that the qualifications of the various candidates be accepted, subject to the usual investigation. The motion was seconded by Councilman Losey and unanimously carried. The application of Mr. Joe F. Booth for a liquor license at the Kitten Korner was brought up and Councilman Parker stated that the Chief of Police was working on it and they were trying to speed it through but they needed more time because they still had some more investigation work to do. Councilman Anderson stated -2� that we can go on and pass on it based on John's investigation and if adything comes up we would have to reconsider. Mr. Parker stated that he did not want to make the town look bad. Councilman Anderson stated that what he was saying was we could reconsider. Councilman Parker then stated that he would do this -- he would say that we grant him the license pending the investigation by Chief Price. Councilman Anderson then stated that if the outcome of the investigation is bad, that we reconsider it. Mr. Parker then stated that if that was agreeable with everybody, he would like to see the man get started because he needs some time to get his - -- He then stated that he moved that we accept the application. of Mr. Booth for a liquor license at the Kitten Korner pending a favorable recommendation from Chief Price. The Motion was seconded by Councilman Earl Anderson. The Clerk then asked if it was OK to grant the usual deferred credit and Commissioner Parker stated that he would think so if that was agreeable with everyone as it will take awhile to get his State License. The motion was then put by the Mayor and unanimously carried. Mayor Hendrix stated that a letter had been received from Mr. Joe Tanner, Commissioner of the Department of Natural Resources, stating that in order to facilitate the initiation of the Army Corps of Engineers Beach Erosion. Control Project for Savannah Beach as rapidly as possible, they would recommend that the • Project be exempted from the provisions of the Savannah Beach Sand Dune Protection Ordinance and recommended the following suggested wording for the amendment: "Exception. The provisions of this ordinance shall not apply to activities and structures necessary for the successful completion of the Army Corps of Engi- neers Beach Erosion Control Project, since the pro- ject is proposed to result in new beach and sand dune areas protecting the health, safety, and welfare of the citizens. Such exempted activities and struc- tures shall specifically include the public parking and beach access area provided for in subsections j and k of Section 1 of the Agreement between the United States of America and the State of Georgia, the City of Savannah Beach, Georgia and Chatham Coun- ty, Georgia for Local Cooperation at Tybee Island Beach, Georgia entered into on the day of 1974. Councilman Anderson moved that the amendment, as read, be accepted and put on first reading. The motion was seconded by Councilman Hosti and unanimously carried on first reading. Mayor Hendrix then requested Mr. Hosti to instruct Mr. Reed Monday morning to take the signs down off that property (Tybrisa Property) and place them in the warehouse. Mrs. Losey then stated that she would like to make a motion. Mayor Hendrix said that she could talk when he had finished. Mr. Hendrix continued, addressing Mr. Hosti, asking him to place them in the . warehouse and he would take them for a future date. -3- Mayor Hendrix then stated that the next business on the agenda was consideration of the bill rendered by Lee and Clark. He asked City Attorney Lance Smith to elaborate on this. Mr. Smith called the attention of the councilmen to a copy of bill rendered by Lee and Clark in the amount of $8,165.50. He then asked Mr. Buttimer, a member of his law firm, to bring council up to date on the problem of acquiring the land east of the seawall. Mr. Buttimer gave council a complete report on what had been accomplished by Lee '& Clark and what remained to be accomplished. Following this report, a motion was made by Councilman Anderson that guarantee of payment be made to Lee & Clark for legal services rendered upon certification by them of titles which they show as being complete; it being the opinion of. Council that such a guarantee would satisfy the needs of Lee & Clark and enable them to turn over the files to Mr. Smith, our City Attorney. The motion was seconded by Mrs. Losey and unanimously carried. The Clerk was then instructed to write a letter to this effect to Messrs. Lee & Clark. A motion was made by Mrs. Losey that "For Sale" signs be put on the Tybrisa property, using the existing signs if necessary by painting over them and this to be done immediately. After a discussion on the wording of the motion, it was re- phrased by Mrs. Losey as follows: A sign to be put on the property letting people know that this property is up for sale stating that choice lots are available or for sale. The motion, as reworded, was seconded by Councilman Parker and unanimously carried. There being no further business, the meeting was adjourned to the next regular or special called meeting. Clerk of Council 1 MAYOR 1 1 1 1 1 A RESOLUTION BEACH, TYBEE OF MAYOR AND OF THE STATE RESOLUTION BY THE MAYOR AND COUNCILMEN OF THE CITY OF SAVANNAH ISLAND, GEORGIA, TO CONDUCT AN ELECTION FOR THE OFFICE SIX COUNCILMEN IN ACCORDANCE WITH THE APPLICABLE LAWS OF GEORGIA AND CHARTER OF THE MUNICIPALITY BE IT RESOLVED by the Mayor and Councilmen of the City of Savannah Beach, Tybee Island, in Council duly assembled, and it is hereby resolved as follows: WHEREAS, in accordance with the provisions of Section 34A -101 et seq., known as the "State of Georgia Municipal Election Code ", and in conformity with the provisions of Section Nineteen of the Charter of the Municipality, the City shall call an election for the purposes of electing the Mayor and six Councilmen of the Municipality; and WHEREAS, in accordance, furthermore, with the provisions of Section Twenty -three and Twenty -four of the Charter of said Municipality various election offices are created and are to be appointed by the governing body of the City in connection with the conduct of said elections; NOW, THEREFORE, BE IT RESOLVED, AND IT IS HEREBY RESOLVED as follows: 1. That the City of Savannah Beach, Tybee Island, shall conduct an election on April 1, 1974, from seven a.m. to seven p.m. for the purpose of electing a Mayor and six Councilmen to hold office from the first Monday in July, 1974, until the first Monday in July, 1976, or until their successors have been duly elected and qualified. 2. The Municipal Election Superintendent of said election shall be the Honorable Robert R. Cook, who is authorized to incur expenses for the preparation and conduct of such election as authorized by Section Twenty -four of the Charter of the Municipality. 3. Furthermore, the governing body of said City does hereby appoint the following poll officers to conduct and assist the Municipal Election Superintendent in such election. Box 128 Savannah Beach, Georgia 31328 Dear Ed: TELEPHONE 1912) 233.1271 PLEASE REPLY TO POST OFFICE BO% 8206 31402 In reply to your letter of March 4th addressed to my firm, I wish to advise that we stand ready to certify on a limited basis forty -five titles. This certificate would necessarily be limited since the property description cannot be completed without the survey as is to be provided by the City Engineer or the Corps of Engineers. This was requested by me personally more than ten months ago at the initial meeting that was held with the City Engineer and the Corps of Engineers. It has never been provided. Without that we have always been at a loss to ascertain the exact property required. The Council is aware of the problem because of the difficulty that has arisen as a result of the Ocean View Corporation property. Certain Ocean View property was acquired in exchange for City property. A redetermination has been made by certain persons in authority and it is now determined that more property of Ocean View is required. Ocean View Corporation of which the principal spokesman has always been Councilman Towns has advised that they are unwilling to include the additional property as part of the exchange. This difficulty which the members of the firm foresaw and advised Council previously has limited us in our activity as . to providing a complete title certificate. In addition, •any . certificate would be limited as to the date on which the title search was completed. As I am certain your lawyer will advise you, this title search will have to begin over again by him since his firm will have to make the ultimate certificate which will require a new search of the title. Never- theless, upon receipt of the property description, we would be in a position to certify the number of titles set out above. 1 Mr. Edward M. Patterson, Clerk Page 2 March 7,1974 In addition, we were advised that our services on the project would be paid for the entire work. Therefore, we can justify meetings that were held bymembers of this firm ,with the Corps of Engineers, with the State Department of Natural Resources, and with the Metropolitan Planning Commis- sion. We can also justify the charges for telephone conversa- tions with the Mayor,. the City Engineer, the Corps of Engineers representatives, the State Department of Natural Resources, and one of the Board members of the State Department of Natural Resources. I cannot justify any conferences with any of the Aldermen since they never requested me to discuss any of my work with them. Most of them did not participate in any of the work on the project with me. Our time charts are available for examination at any time.. Council will recall that our office began working on the project without any previous files and commenced work without any other type of assistance. This was done both because we were - not provided with the information and because we felt that we as careful attorneys could not rely on the work or certificate of other lawyers.' During the ten months we did our work and had progressed to the point where we would have been ready to obtain title shortly after receipt of the survey. I would appreciate your advising Council of the contents of this letter and asking them to determine whether their request for a certification subject to the limitations expounded by me and other limitations based on the time of checking the title, namely, up until February 1, 1974, would be suitable.
