HomeMy Public PortalAboutCharter Review Committee Minutes 01-03-1989 CHARTER REVIEW COMMITTEE JAN. 3, 1939 The Charter Review Committee held its second meeting at 7: 00 p. m. on Jan. 1989. All members were present except Dorothy Hurdle, who was out of town, and Pat Jermyn. Richard Gladstone made a motion, seconded by Thurmond Rogers, to approve the minutes, which was approved unanimously. Lloyd Leach suggested listening to the tape of Riley Fletcher from the Texas Municipal League when he spoke to the Charter Commission. He indicated possible conflicts that existed in our charter. Dave Ragan made a motion, seconded by Thurmond Rogers, to accept the Rules of Procedure drawn up by Lloyd Leach. The motion was approved unanimously. Dave Ragan made a motion, seconded by Lloyd Leach, to leave the rate of pay for the mayor and councilmembers at $10 per month. The motion failed 4 to 3. Richard Gladstone made a motion, seconded by Thurmond Rogers, to increase the rate of pay for the mayor and councilmembers to $20 per month in Section 5. 01 of charter. The motion was approved 4 to 3. Dave Ragan made a motion, seconded by Jack Watson, to leave the number of councilmembers at 5. The motion was approved unanimously. Lloyd Leach made a motion, seconded by Richard Gladstone, to change the date of our regular municipal election to the first Saturday in May to conform to state law. This is found in Section 5. 03 of the charter. The motion passed unanimously. Lloyd Leach made a motion, seconded by Dave Ragan, to continue to allow persons running for City Council to change to a different place after they have already filed. The motion was approved unanimously. Dave Ragan made a motion, seconded by Vicki Hamilton, to table our iscussion of qualified voters found in Section 5. 06 of the charter. The lotion was approved unanimously. The city manager will check on the state law regarding this. Richard Gladstone made a motion, seconded by Dave Ragan, to leave Section 5. 02 as is regarding the residency requirement for mayor and councilmembers. The motion was approved unanimously. Elizabeth Sheppard made a motion to allow the mayor, with the approval of a majority of the council , to appoint a person to fill a vacancy if there remains 180 days or less from the next election date until the expiration of the office to be filled. The motion passed with 6 votes for, 1 against and 1 abstention. Lloyd Leach made a motion, seconded by Vicki Hamilton, to leave the part of Section 6. 02 as is which prohibits the mayor from voting except in case of a tie. The motion passed unanimously. Jack Watson questioned, in Section 6. 02, the mayor needing the consent of the Council to act in case of an emergency. The city manager will check the state law governing this. Lloyd Leach made a motion, seconded by Dave Ragan, to leave the charter as is regarding the length of terms of the mayor and councilmembers. The motion passed unanimously. Vicki Hamilton made a motion, seconded by Dave Ragan, to adjourn the meeting. The motion passed unanimously. The committee will begin with Section 6. 03 at the next meeting. Respectfully ezietketsubmitted, Attest : Elizabeth Sheppard, Secretary Tom Harvey, Chairman `- n PROPOSED CHARTER CHANGES AS OF JAN. 3, 1989 • SECTION 5 . 01 CITY OFFICIALS The municipal government of the City shall consist of a City Council composed of a Mayor and five (5) Councilmembers. Said Mayor and Council shall be elected from the City at large. The City Councilmembers and Mayor each shall be allowed, for incidental expenses, the sum of Twenty ($20. 00) Dollars per month and such designated actual expenses supported in writing which shall have been presented to the City Council and received approval . SECTION 5. 03 DATE OF ELECTION; CANDIDATES TO RUN FOR PLACES; PLACES DESIGNATED The regular municipal elections of the City of Richland Hills shall be held on the first Saturday of May of each year, and the same shall be conducted and the results canvassed and announced by the election authorities prescribed by the Election Code of the State of Texas, and said Code shall control in all municipal elections except as otherwise herein provided. The Mayor, and two (2) Councilmembers, Place 2 and. Place 4, shall be elected in even numbered years. Three (3) Councilmembers, Place 1, Place 3 and Place 5, shall be elected in odd numbered years. The two (2) year term of office shall apply to all Council positions, and numbered places will be effective in the 1987 City election. SECTION 5. 09 VACANCIES In case of a vacancy from any cause in the office of Mayor or Councilmember, the City Council shall order a special election to fill such vacancy, on the next election date, authorized by the Texas Election Code, provided, however, in the case of only one (1) vacancy when there remains one hundred eighty (180) days or less from the next election date until the expiration of the office to be filled, the Mayor, with the approval of a majority of the Council, may appoint a person to fill such vacancy.
