JAN. 17, 1989
The Charter Review Committee held its third meeting at 7: 00
p. m. on Jan. 17, 1989, at City Hall. All members were present
except Vicki Hamilton. The chairman Tom Harvey presided over the
110 meeting.
The invocation was given by Dave Ragan. The secretary read
the minutes of the last meeting. Thurmond Rogers made a motion
to approve the minutes, and it passed unanimously.
In Section 6. 04. 02, Elizabeth Sheppard made a motion that " in
the case of short-term absence or disability of the City
Manager, the City Manager' s designated line of succession shall
be implemented. In case of prolonged absence or disability of
the City Manager, the Council may designate some qualified
person . . . . " The motion passed unanimously.
Dorothy Hurdle made a motion to add item "j . " under Section
6. 04. 03, Powers and Duties of the City Manager. It would read:
"Establish a line of succession for the City Manager' s position
and submit to the Council for its review and approval. " The
motion passed unanimously.
Dave Ragan made a motion that we leave Section 6. 06 as is, so
that the City Secretary continues to report to the Mayor rather
than to the City Manager. It passed unanimously.
In Section 6. 08. 02, Dorothy Hurdle made a motion that the
"Clerk of the Municipal Court shall be appointed by the City
Manager and approved by a majority of the Council. He/She can be
removed by the City Manager with approval of four-fifths (4/5>
of the Council. " The motion passed unanimously.
In Section 6. 08. 02, Pat Jermyn made a motion that in addition
to duties pertaining to the Court, "the Clerk shall perform any
other duties as specified by the City. Manager. " It passed
unanimously.
In Section 6. 08. 02, Lloyd Leach made a motion that the
"deputy clerks shall be appointed by the City Manager and
approved by the Council . . . . " The motion passed unanimously.
Dave Ragan made a motion to table the issue of appointing a
warrant officer until more information is obtained from the City
Manager. The motion passed, 9 to 1.
Dorothy Hurdle made a motion that the City Manager research
any state law regarding the absence from meetings by the Mayor
and Councilmembers. The motion passed unanimously.
Dave Ragan made a motion to adjourn, and it passed
unanimously.

PROPOSED CHARTER CHANGES ADDED JAN. 17, 1989
SECTION 6. 04 CITY MANAGER
2. TERM AND SALARY
The City Manager shall be appointed by the City Council and
may be removed at the will and pleasure of the Council by the
affirmative vote of four (4) members of the Council . The action
of the Council in suspending or removing the City Manager shall
be final ; it being the intention of this Charter to vest all
authority and fix all responsibility of such suspension or
removal in the Council . In case of short-term absence or
disability of the City Manager, the City Manager' s designated
line of succession shall be implemented. In case of ,prolonged
absence or disability of the City Manager, the Council may
designate some qualified person other than an elected officer of
the City to perform the duties of the office during such absence
or disability. The City Manager shall receive such compensation
as may be fixed by the Council.
3. POWERS AND DUTIES OF THE CITY MANAGER

SECTION 6. 08 MUNICIPAL COURT
2. Clerk of the Municipal Court
There shall be a Clerk of the Municipal Court who shall be
appointed by the City Manager and approved by a majority of the
Council. He/She can be removed by the City Manager with approval
of four-fifths (4/5) of the Council . The Clerk shall have power
to administer oaths and affidavits, make certificates, affix the
seal of the Court thereto, and otherwise perform any and all
acts necessary in issuing process of such Court and conducting
the business thereof. ,The Clerk shall perform any other duties.
as specified by the City Manager. There shall be such deputy
clerks of the Municipal Court as may be authorized by the
Council . These deputy clerks shall be appointed by the City
Manager and approved by the Council , and shall have authority to
act for and on behalf of the Clerk of the Municipal Court.
