CHARTER REVIEW COMMITTEE
February 7, 1989
i-� The Charter Review Committee held its fourth meeting at 7: 00
p. m. on February 7, 1989. All members were present except for Vicki
Hamilton. Dorothy Hurdly' gave the invocation. After the minutes were
read, one correction was noted. The vote on Dave Ragan' s motion to
table the issue of appointing a warrant officer until more
information is obtained from the City Manager passed 8 to 1, rather
than 9 to 1 . Lloyd Leach made a motion that the minutes be approved
as read. It was seconded and passed unanimously.
Dorothy Hurdle made a motion to delete item C. 3. from the agenda
under Old Business and substitute New Section 5. 11 ABSENCE OF MAYOR
AND COUNCILMEMBERS. It was seconded and passed unanimously.
Richard Gladstone made a motion to leave Section 5, 06 QUALIFIED
VOTERS as written. It was seconded and passed unanimously.
Lloyd Leach made a motion to add new Section 5. 11 ABSENCE OF MAYOR
AND COUNCILMEMBERS. It would state the following: " If any member of
the City Council is absent from four (4) of seven (7) consecutive
regular meetings, writhout - explanation acceptable to a majority of the
remaining City Coucilmembers, his office shall be declared vacant at
the next regular meeting of the City Council by resolution, " It was
seconded and approved unanimously.
Jack Watson made a motion to amend the last duty of the Mayor in
Section 6. 02 as follows: " In time of danger or emergency, the Mayor
may, in accordance with the Texas Disaster Act of 1975, Article 6889-
7 of the Revised Civil Statutes of the State of Texas, take command
of the police and other departments and govern the City by
proclamation and maintain order and enforce all laws. The Mayor' s
actions may not be continued or renewed for a period in excess of
seven days except by or with the consent of the City Council . " It was
seconded and approved unanimously,
Dorothy Hurdle made a motion to put a slash between Mayor and
Mayor Pro Tem in the title of Section 6. 02 and to number the various
duties of the Mayor. It was seconded and approved unanimously.
Dave Ragan made a motion to table Section 6. 04. 03 (h) regarding
the City Employees' grievance procedure until the committee has an
opportunity to examine the grievance procedure which is included in
the Richland Hills Personnel Policies Manual . It was seconded and
approved unanimously. •
Dorothy Hurdle made a .motion to not add a Warrant Officer to
Section 6. 08 at this time. It was seconded and passed unanimously.
Thurmond Rogers made a motion to adjouri:i. It was seconded and
passed unanimously.

PROPOSED CHANGES TO CHARTER ADDED FEB. 7, 1989

Add new section:
SECTION 5. 11 ABSENCE OF MAYOR AND COUNCILMEMBERS
If any member of the City Council is absent from four (4) of
seven (7) consecutive regular meetings, without explanation
acceptable to a majority of of the remaining City Councilmembers, his "
office shall be declared vacant at the next regular meeting of the
City Council by resolution.
SECTION 6. 02 DUTIES OF MAYOR/MAYOR PRO TEM
The Mayor of the City of Richland Hills:
<1> Shall preside over the meetings of the City Council and
perform such other duties consistent with the office as may be
imposed upon him by this Charter and the ordinances and resolutions
passed pursuant hereof.
(2) May participate in the discussion of all matters coming
before the Council and shall be entitled to vote in case of a tie,
but shall have no veto power.
(3) Shall sign all contracts and conveyances made or entered
into by the City and all bonds issued under the provisions of this
Charter.
(4) Shall be the chief executive officer of the City.
(5) Shall be recognized as the official head of the City by the
court for the purpose of serving civil process, by the Governor for
the purpose of enforcing military law, and on all ceremonial
purposes.
(6) May, in time of danger or emergency, in accordance with the
Texas Disaster Act of 1975. Article 6889-7 of the Revised Civil
'Statutes of the State of Texas, take command of the police and other
departments and govern the City by proclamation and maintain order
and enforce all laws. The Mayor' s actions may not be continued or
renewed for a period in excess of seven days except by or with the
consent of the City Council. •
The Mayor Pro Tem shall be elected from among the members of the
five (5) Councilmembers; shall be elected at the first regular
meeting following the general City election, and shall , in the
absence or disability of the Mayor, perform all the Mayor' s duties.
