HomeMy Public PortalAboutCharter Review Committee Minutes 03-07-1989 CHARTER REVIEW COMMITTEE 410 March 7, 1989 The sixth regular meeting of the Charter Review Committee was held on Ni✓ March 7, 1989, at 7: 00 at City Hall. All members were present. Dave Ragan gave the invocation. The minutes of the last meeting were read. Pat Jermyn' s motion to approve the minutes was passed unanimously. Dave Ragan made a motion to amend Section 5. 08 JUDGE OF ELECTION, so that a candidate for City Council must receive a majority of the vote to be elected. The motion passed 5 to 4. Pat Jermyn made a motion to amend Section 6. 03 POWERS AND DUTIES OF CITY COUNCIL item (6) to read as follows: "To appoint all commissions, boards, committees. task forces and/or appointed groups to assist the Council in the performance of its duties and responsibilities, such powers subject to the restrictions of the Charter and the laws of the State of Texas. " The motion passed unanimously. Richard Gladstone made a motion to allow Section 12. 06 INDEPENDENT AUDIT to remain the same. It passed 9 to 1. Elizabeth Sheppard made a motion to add the following sentence to the end of Section 13. 02 POWER TO TAX: "The Council shall impose such ad valorem taxes as are necessary to support the budget . " The motion passed unanimously. Elizabeth Sheppard made a motion to amend one of the sentences in Section 5. 02 QUALIFICATIONS as follows: "A member of the Council ceasing to possess any of the qualifications specified in this section or any other sections of this Charter for a period of sixty (60) days following notice from the City Secretary regarding same, or who is convicted of a felony while in office, shall immediately forfeit his/her office. " The motion passed unanimously. Pat Jermyn made a motion to leave Section 13. 03 EXEMPT PROPERTY as written-__It passed unanimously. Dave Ragan made a motion to leave Section 13. 05 LIMITATION OF TAX RATE as written. It passed unanimously. The meeting was adjourned. SECTION 5. 08 JUDGE OF ELECTION (Amend the third and fourth sentences in this section as follows: ) The (Coup.11) candidates receiving the (.grcdt,2 t) majority number of votes for an office shall be declared elected. If such election results in a (Mayoral) candidate not receiving a majority of votes cast, it shall be the duty of the Mayor to order a second election for the office or offices in which candidates did not receive a majority of votes.
