HomeMy Public PortalAboutCharter Review Committee Minutes 03-21-1989 CHARTER REVIEW COMMITTEE March 21, 1989 The seventh meeting of the Charter Review Committee was held on March 21 , 1989, at 7: 00 at City Hall. All members were present except Vicki Hamilton. Richard Gladstone gave the invocation. The minutes of the last meeting were read. Dorothy Hurdle made a motion to approve them, which passed unanimously. Lloyd Leach made a motion to amend Section 5. 08 JUDGE OF ELECTION to indicate that " in the event of a tie in a regular or special election, it shall be the duty of the Mayor to order an additional election for the office . . . . " The motion passed unanimously. Dorothy Hurdle made a motion to change sentence two in Section 14. 01 THE PLANNING AND ZONING COMMISSION to read as follows: Three (3) members of the Planning and Zoning Commission shall be so appointed each odd-numbered year and two (2) members shall be so appointed each even-numbered year. The motion passed unanimously. Richard Gladstone made a motion to leave the Planning and Zoning Board at five members. It passed unanimously. Dorothy Hurdle made a motion to not include a sub-division ordinance in the charter. It passed unanimously. /� Elizabeth Sheppard questioned whether 30 days was a long enough time ? period for a law to be subject to referendum. Richard Gladstone will check to see if this is specified by state law. Dave Ragan made a motion to amend Section 17. 04 PUBLIC MEETINGS to include the following: "All meetings of the Council and all meetings of Boards, Commissions and groups appointed by the Council shall be posted 72 hours prior to the meeting . . . . Minutes of all public meetings shall be kept and filed with the City Secretary within 10 days of approval. " The motion passed unanimously. Richard Gladstone made a motion to amend Section 17. 08 EXECUTION, GARNISHMENT AND ASSIGNMENT. This section indicates that the City will not garnish an employee' s wages. State law requires garnishing of wages in regard to child support; therefore, Richard added the following to the last sentence of that section: "except as prtcd by state law. Respectfully submitted, ei%ed-er-iuElizabeth Sheppard Attest: :07,r Torn Harvey, Chairman 1 PROPOSED CHARTER CHANGES ADDED MARCH 21, 1989 SECTION 5. 08 JUDGE OF ELECTION <Amend the third and fourth sentences in this section as follows: ) The (Council) candidates receiving the (greateot) majority number of votes for an office shall be declared elected. If such election results in a (Mayoral) candidate not receiving a majority of votes cast or in the event of a tie in a regular or special election, it shall be the duty of the Mayor to order (a oecond) an additional election for the office or offices in which candidates did not receive a majority of votes. SECTION 14. 01 THE PLANNING AND ZONING COMMISSION (Amend sentence two of paragraph one as follows: ) [Two (2) ] Three (3) members of the Planning and Zoning Commission shall be so appointed each odd-numbered year and [ ti1i ee (3) ] two (2) members shall be so appointed each even-numbered year. SECTION 17. 04 PUBLIC MEETINGS All meetings of the Council and all meetings of Boards, Commissions and groups appointed by the Council shall be posted 72 hours prior to the meeting and shall be open to the public, except those authorized by law to be closed. Minutes of all public meetings shall be kept and filed with the City Secretary within 10 days of approval . Such minutes shall constitute public records. SECTION 17. 08 EXECUTION, GARNISHMENT AND ASSIGNMENT (Amend the last sentence of this section as follows: ) The City shall not be liable to the assignee of any wages of any officer, agent or employee of said City, whether earned or unearned, upon any claim or account whatsoever, and as to the City such assignment shall be absolutely void, except as prohibited by state law.
