HomeMy Public PortalAbout2022.030 (02-15-22) RESOLUTION NO. 2022.030 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING THE FOURTH AMENDMENT TO THE AGREEMENT WITH SWA IN THE AMOUNT NOT TO EXCEED $8,500 WHEREAS, the City received funding from the San Gabriel and Lower Los Angeles Rivers and Mountains Conservancy (RMC) in the amount of $1,692,575 for the Lynwood Park Infiltration Restoration and Water Quality Improvement Project; and WHEREAS, on August 21, 2018, the City Council approved for SWA to design the Lynwood Park Infiltration Restoration and Water Quality Improvement Project at the parking lot of Lynwood City Park along Spruce Street; and WHEREAS, on November 18, 2018, the City Manager approved a contract amendment for additional percolation testing (First Amendment); and WHEREAS, during the design phase, SWA found that the percolation was poor at the parking lot site; and WHEREAS, on July 22, 2019, the Board of the RMC approved to change the project site location from the parking lot at Lynwood City Park to a City owned lot at Fernwood Avenue and State Street to develop a Park; and WHEREAS, on February 18, 2020, the City Council approved Resolution No. 2020.023 approving to amend the Agreement with SWA (Second Amendment) for the design of a community park at Fernwood Avenue and State Street (Project) that meets the RMC grant requirements; and WHEREAS, on March 16, 2021, the City Council approved Resolution No. 2021- 031 approving to amend the Agreement with SWA (Third Amendment) for extended project duration and administrative production and coordination; and WHEREAS, Consultant has provided additional services such as bid review and extended bid coordination; and WHEREAS, staff needs SWA to prepare construction drawing sheet for the pole mounted park sign; and WHEREAS, an amendment to the Agreement is necessary for these additional services. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS: 1 Section 1. The City Council of the City of Lynwood hereby finds and declares that the foregoing recitals are true and correct, and incorporates them herein as findings and as a substantive part of this Resolution. Section 2. Approve a Fourth Amendment to the Professional Services Agreement with SWA, and authorize the Mayor to execute the Fourth Amendment in a form approved by the City Attorney. Section 3. This Resolution shall take full force and effect immediately upon adoption by the City Council. PASSED, APPROVED and ADOPTED this 15th day of February, 2022. 41111.
