HomeMy Public PortalAbout19740430SCMeeting1 1 9 Savannah Beach, Georgia April 30, 1974 A Special Meeting of City Council was held this evening at 7:30 P.M. for the following purposes: (1) Arranging for the renewal of the note in Savannah Bank & Trust Company in the amount of $50,000.00 extending it for a period of 60 days; or to the end of the present term of Council. (2) To take the appropriate action authorizing the billing of real estate taxes for the current years taxes in two installments in accordance with the laws of the State of Georgia. This installment billing is due to the late receipt of the tax digest and valuations from Chatham County. (3) Authorizing the Mayor to sign LETTER OF INTENT to Mr. Rock Howard of the Environmental Protective Division assuring our participation in Grant for development of a WATER and SEWER Facility encompassing the entire Chatham County area. The Meeting was presided over by Mayor Allen Hendrix and a quorum of the following councilmen was present: Edward Towns, Karen Losey, Ernest Hosti, Walter Parker and Earl Anderson. City Attorney Lance Smith was also present. Concerning item one on the agenda, arranging for the renewal of our note in the bank to extend to the end of the present term of council, the Clerk explained a Resolution of Council was necessary to accomplish this bookkeeping transaction with the bank and extend our present note for the sixty days so as its maturity will coincide with the end of the term of the present administration. He then read the following Resolution: RESOLUTION Councilman Earl Anderson moved the adoption of this Resolution. The motion was seconded by Councilman Walter Parker and unanimously carried. l0 -2- 1 The Clerk then explained the necessity of getting the appropriate action passed by Council to authorize the billing of real estate taxes for the current years's taxes in two installments in accordance with the laws of the State of Georgia. This installment billing is due to the late receipt of the tax digest from Chatham County, he explained. The following Resolution was then read. RESOLUTION Councilman Walter Parker moved the adoption of the Resolution. It was seconded by Councilman Anderson and unanimously carried. A suggested form of a Resolution proposed by the Metropolitan Planning Commission was read by the Clerk, in which authorization was sought for the Mayor to sign a Letter of Intent to Mr. Rock Howard of the Environmental Protective Division assuring our participation in the Grant for Development of a Water and Sewer Facility encompassing the entire Chatham County area. Mayor Hendrix suggested that since this present administration did not have the power to bind the new administration, it would be his recommendation that all action on this matter be deferred until such time as it could be studied by the incoming administration and the appropriate action taken by them. The Clerk was also instructed to write the Georgia Municipal Association for further information on the new proposed Water and Sewer Facility. There being no further business the meeting was adjourned to the next regular or special called meeting. CLERK OF COUNCIL L‘)Ake,c, kox—z—t, Coni-v-1))4-42/ - MAYOR 1 1 1 1 RESOLUTION AUTHORIZING TEMPORARY LOAN BY THE CITY OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, UNDER THE CONSTITUTION OF THE STATE OF GEORGIA, ARTICLE VII, PARAGRAPH IV, AND FOR OTHER PURPOSES. WHEREAS, under and by virtue of the Constitution of the State of Georgia, Article VII, Section VII, Paragraph IV (Section 2 -6004 of the Georgia Code of 1933, Annotated) each County, Municipality or Political Subdivision of the State author- ized to levy taxes is given the authority to make temporary loans between January 1, and December 31, in each year to pay expenses for such year, upon certain conditions; and WHEREAS, such conditions have been fulfilled by the City of Savannah Beach, Tybee Island, Georgia as hereinafter appears; and WHEREAS, the said City of Savannah Beach, Tybee Island, Georgia has now outstanding no temporary loan, or loans, made in the current year, or in any prior year; and WHEREAS, the total gross income of said City of Savannah Beach, Tybee Island, Georgia from taxes in the last preceding fiscal year (1972 -1973) was $177,200.00; and WHEREAS, the total anticipated revenue of the City of Savannah Beach, Tybee Island, Georgia for the year 1973 -1974 exceeds $402,500.00; and WHEREAS, the amount to be borrowed, $50,000.00, plus all other anticipated obligations and expenses of the City of Savannah Beach, Tybee Island, Georgia, for the fiscal year 1973 -1974 are less than the total anticipated revenue from all sources for such fiscal year; and WHEREAS, under the aforesaid authority, the City of Savannah Beach, Tybee Island, Georgia may make such temporary loan, or loans, in the fiscal year 1973 -1974 in a total amount not to exceed $50,000.00; and WHEREAS, the Mayor and Council constitute the of the City of Savannah Beach, Tybee Island, Georgia. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council Savannah Beach, Tybee Island, Georgia in a legally governing body of the City of 1 1 called meeting, assembled April 30, 1974: That the City of Savannah Beach, Tybee Island, Georgia is hereby authorized to borrow from Savannah Bank & Trust Company of Savannah the sum of $50,000.00 to be represented by a Promissory Note bearing interest at the prevailing and best obtain- able rate of interest per annum, and the entire amount together with interest, to be repaid on or before June 28, 1974. The Promissory Note evidencing said loan shall be executed in the name of the City of Savannah Beach, Tybee Island, Georgia and signed by the Mayor and /or Mayor Pro Tem and Clerk of Council. Approved and adopted at a Special Meeting of Council this 30th day of April, 1974. Clerk of Council R E S O L U T I O N WHEREAS, The City of Savannah Beach, Georgia, has heretofore billed for its real property taxes once a year, that being on May 1; and WHEREAS, present Georgia Law requires Municipalities to utilize county valuations in arriving at their assessments and that they assess at 40% of market value and that these valuations must be the ones approved by the State Revenue Commissioner; and WHEREAS, the approved County Digest will not be avaialable until a time in the year beyound the normal billing date; and WHEREAS, The City of Savannah Beach is required by Georgia Law to adopt a method of paying ad valorem taxes for the current year in two or more installments; NOW, THEREFORE, BE IT RESOLVED that the City of Savannah Beach in Coucil Assembled does hereby adopt a method of payment of real property taxes in two installments, whereby the first installment is to be billed in May of 1974, based on valuations of the State and County for the year 1973, with the final installment to be adjusted to the new valuations as received from the Chatham County Tax Assessors for the year 1974, which adjustmant shall reflect the total tax liability to the City of Savannah Beach with the further resolution that should the estimated taxes exceed the total tax liability for the current year, the excess payment shall be refunded by The City of Savannah Beach.
