A 16 k*at 7 inch variance from the 20 haei rear setback requirement in order to allow for u building to setback 3 feet 5 inches from the n+e/ property line opposite ofLafayette Street. (Exhibit 35-51,A) 3. A variance from the Maximum Density/Floor Area Ratio requirement in order to allow for ofloor area ratio of17Upercent. (Exhibit 35-51.A) The property is zoned C'1 Neighborhood Commercial and is located onthe southwest corner of the intersection of Lafayette Street and State Street. The property is described as Part of |n|ot 133.Jefferson City, Cole County, Missouri. (Keith Lesko, Consultant) Mr. Tom Sohapperu, 188SHighway Q4. Holts Summit, K8isuouh, spoke regarding this request. Mr. Scheppers explained that the purpose of the request is to promote the efficient use of space at 100 and 102 Lafayette, as well as, install u handicap accessible entrance to serve both structures. He stated that the structure at 100 Lafayette is undergoing major renovations which will incorporate the residential structure at 102 Lafayette. Mr. Snheppera explained that parking will be more than adequate toserve both 100 and 102 Lafayette. Hastated that there has been discussion with the City inregards tovacating the small alley behind the properties. No one spoke in opposition to this request and no correspondence was received. Mr. Hal DuUe, 104 Douglas Dhvo, Project Consultant with the State of Missouri Office of Administration, Division ofFacilities Management, Design &Conahuotion Seobon, spoke regarding this request. Mr. OuUe stated that they are not opposed to the proposed variances. He voiced o concern that construction at 102 Lafayette Street be consistent with the neighborhood building design standards. Mr. DuUe pointed out that this was not mentioned in the notification to adjoining property owners. Mr. Meinhardt explained that this was mentioned in the staff report. Ms. McMillan referred Mr. Du||e to the staff reports available for those in attendance. K8a. McMillan explained that the applicant is requesting u Floor Area Ratio of 170 percent however if the rear property on State Street was incorporated into this property the density would not be an issue. She stated that the front setback for the residential structure on Lafayette would be 14 feet whereas the commercial building would have a setback of 0 feet on the right-of-way line. Minutes/Jefferson City Board ofAdjustment July 13, 2010 Page Ma. McMillan explained that the applicant is proposing to extend the building plane across the whole length of both properties. She obakyd that the rear setback in the C-1 district would be measured from the alley line at the rear of those two buildings. Ms. [Nuk8iUan explained that the applicant proposes to extend the near building line with on approximate setback of3feet 5 inches. She stated that the building on the corner is some what of an anomaly in the Capital Avenue District section of the Central East Side Neighborhood Plan in that it is a commercial style building built On the street line while most ofthe district consists of residential style buildings setback from the ntxae| line. K4a. McMillan explained that the additions to the building should mirror the commercial standards eetou| in the Central East Side Neighborhood Plan. She stated that in regards to the possibility of vacating the small alley behind these two properties, the applicant would need to apply to the Public VVurka and Planning Committee. K4a. McMillan explained that staff fom|y that the findings have been met. She emphasized that u critical component is the adherence to the recommendations of the Central East Side Neighborhood Plan regarding design guidelines and architectural standards. Mr. M*inhanh inquired whether there is an enforcement mechanism for the design standards. In response, Ms. McMillan explained that currently there are no design standards in place we have to refer to the Central East Side Neighborhood Plan and the recommendations. She stated that there are exhibits in the plan that show the type of architectural style envisioned for this neighborhood and wawould refer the Applicant tothose recommendations atthis time. K4a. Parban moved and M/. Boudreau seconded toapprove the following variances for 100 arid 102 Lafayette Street, subject to the following conditions: (1) Submittal of site plan for neighboring parking |o( prior to issuance of building permit,- and (2) Adherence to the recommendations of the Central Eastside Neighborhood Plan regarding design guidelines and architecturalat*ndanjo (1 ) A variance from the front setback requirement in order to allow for a building to setback 0 feet from the front property line adjacent to Lafayette Street-, (2) A 16 feet 7 inch variance from the 20 feet rear setback requirement in order to allow for a building to setback 3 feet 5 inches from the rear property line opposite of Lafayette Street; (3)Avariance from the Maximum Danoity/F|oorArou Ratio requirement in order to allow for o floor area ratio of170percent. Mr. [WeinhaoK commented that this is in line with the redevelopment of the Missouri State Penitentiary property and activity inthe surrounding area.
