Call boOrder and Introduction ofMembers, Ex -Officio Members and Staff Chairman K8einhandtouUed the meeting to order and introduced the Board members and staff, Board procedures were explained. Chairman K8einhard1asked ifthere were any Board members who would not participate in any ofthe hearings scheduled. Aquorum of five (5) Board members was present tohear the items onthe agenda. All regular members and alternate Drew Hake were designated to vote. 2. Procedures Explained The following documents were entered as exhibits for all items under consideration at this meeting: 1. The Comprehensive Plan and Land Use Map 1 Copies ofapplications under consideration 4 The affidavit ufpublication ofnotice ofthe public hearing 5 Alist ofproperty owners towhom notice ofthe hearing was sent G. Rules ufProcedure, Jefferson City, Missouri Board ofAdjustment Staff advised that items received regarding any agenda item become the property of tile Board of Adjustment. 3. Adoption mfAgenda K4o. Application filed by Kevin and TammiuThunnan. property owners, for o conditional use permit tooperate o daycare home for seven to ten children (Section 35-41B.6— Day Care Homes for Children or Adults). The property is generally located on the west side of RooevuUey Drive approximately 500feet north nfCarol Street. Mr. Barron described the proposal and explained Not the applicant is requesting approval of Conditional Use Permit to allow for the operation of daycare home for care of up to 10 unrelated children at 1400 Roaeva||eyDrive. Hestated that the subject property ia in an RS -2 single family residential zoning district and that all adjacent and surrounding properties are zoned RS -2. Ms. TammiThunnan. 14OORosnvo|leyDrive, spoke regarding this request and explained that she currently operates an in-home daycare for four (4) children and would like to inonsuue that number (oallow up{o10children. She stated that she was referred tothe Board ofAdjustment by the State Childcare Licensing Division. Mo. Thurman explained that o state permit is not required for four (4) children. She stated that the age range of the children she will be caring for is newborn tofive (5)years. Mr. Barron explained that grandchildren are considered famih/ members so Ma. Thurman could have 10 children in addition to the two (2) grandchildren listed on the application. No one spoke in opposition to this request and no correspondence was received. Mr. Barron gave the Planning Division staff report and explained that the Board Should review [fie proposal and determine if the findings offact for the conditional use permit can be met. He stated that Japproved the Conditional Use Permit for u daycare home is non -transferable. M/. Barron explained that ifthe Applicants were to move (na different location they would have to reapply at the new location. Ms. Parhao moved and Mr. Luebbert seconded to approve the Conditional Use Permit for a daycare home at 1480 RooevaUay Drive subject to the approval by the City's Environmental Services Division and the State Childcare Licensing Division.
