A. Amendment #Bh7the 2DYf-20Y4Transportation Improvement Program
1. Missouri Department of Transportation. Pavement improvements on the westbound lanes
of Highway 50 from Business 50 to 0.6 miles west of Route D. TIP Project No. 2010-11,

Mr. Sanders explained that these amendments are due toareduction inthe total cost ofthe project.
The Board initiated the public comment period to conclude with a public hearing on July 18, 2012.

B. Policy Discussion.- Including Illustrative Projects in the TIP and Federal Fiscal Constraint
Requirements
Ms. K8cK8i||on explained that federal regulations require projects be fiscally constrained in order to
be included in the Transportation Improvement Program (T|P), meaning projects have full funding or
funding is anticipated within a very short time. Ms. K8cK8i||an said staff proposes the following policies
to clarify the requirement:
Policy 2012-1. Projects to be Included in the MTP. Projects which do not demonstrate fiscal
constraint shall not be included inthe TIP, but may be included in the K8TP, including those which
may otherwise be eligible to be included into the T|P, except for the lack of approved funding or
inability bodemonstrate fiscal constraint. Such projects shall be proposed for inclusion into the
MTP Illustrative List through amendment ofthe MTP.
Policy 2012-2. Competitive Grant -funded Projects. Projects proposed to be funded with
competitive grants must first be represented in the MTP. Project sponsors may submit TIP
applications for projects when the notice of grant award has been received. The notice of grant
award may serve aadocumentation of fiscal constraint.
Policy 2012-3. Documentation oKFiscal Constraint, Local Matching Funds. Documentation
of |noa| match requires demonstration of available or reasonably expected to be available |noa|
funds, such as:
• Excerpt from anadopted budget inwhich the project funding ieincluded;
m An order, ordinance or fiscal nob* committing local funds to the project by the governing
body;
• Leder of intent from the chief a|eobyd official or chief administrative official identifying
extrapolated locally authorized or appropriated, or historically used funds, or new funds
for the project.
Mr. Sorivnar requested a definition of fiscal constraint. Mr. Latuszek explained that this means
that funds are in -hand for the project.
Mr. Koastner explained that K8oODT sets project priorities based on the amount of money
available each year from state and federal funda, and only these projects go into theStaiewide
Transportation Improvement Program.
Mr. Crane requested clarification for the term "reasonable" within the definition of fiscal constraint,
He stated that projects starting in later years and that can show that funds aro available should be
in the TIP rather than go through the amendment process. Ms. McMillan explained that there were
difficulties getting the TIP approved through K0oDOTand Federal Highway Administration when
fiscal constraint could not bademonstrated on local matches. Ms. McMillan added that projects
that are not fiscally constrained should appear in the Metropolitan Transportation Plan first.
Mr. Crane inquired whether Section 5309 projects are fiscally constrained. K8n. K8cKAi||an
explained that the Federal Transit Administration requires the Transit Program of Projects to be

Mr. Sanders requested comments from KAoODT and FHVVAthat a letter mfintent from the chief
e|aobad official or chief administrative official identifying extrapolated locally authorized or
approphebmd, or historically used funda, ornew funds for the project is sufficient. Mr. Letuazak
stated that a letter would suffice but it is preferred to have e bsh|e in the TIP showing funds that are
available ineach year.
Ms. McMillan explained that it is more difficult to demonstrate fiscal constraint for competitive
projects or those proposed to be grant funded She stated that we do not want to include on
illustrative project list in the TIP, but these projects should be able to move from the MTP tothe TIP
when they are funded.
Mr. Weber moved and Mr. SmrivnersecVnded to adopt the proposed policies as written, The
motion passed unanimously.
C. FY2013-2016 Transportation Improvement Program and schedule (first draft)
Mr. Sanders explained that the W1oDOT Operations and Maintenance Section will be not updated
until after MoDOT's 2013-2017 STIP has been approved and corresponding calculations have been
performed and provided toCAK8P[>. He stated that the public comment period is proposed to begin
atthe July 18.2U12meeting and conclude otthe August 15.2012meeting.
D. FY20Y3Unified Planning Work Program and schedule (first draft)
Mr. Sanders stated that the dnaftFY2O13 UPVVPwas distributed at today's meeting. He explained
that the major change from the FY2O12UPVVPisthe absence of the contract with HDR Engineering,
Inc., for the Travel Demand Modeling project, which will be completed this year,
Mr. Schvvurtze moved and Mr. Scrivnersecondod to initiate the public comment period. The motion
passed unanimously.
E. Discussion.- Possible MoDOT Scoping Study for a right turn lane onto Liberty Road from Hwy.
50163 East
Mr. Koostnerexp|oined that there is no information at this time however they are looking at possible
configurations and traffic counts at this location.

A. Section 53Y0 Grant Applications and Schedule
Mr. Sanders explained that the deadline is July 1. 2012 and two applications have been received,
He stated that the Board will evaluate the projects at their July 18. 2012 nnaoUng and make o
recommendation to&YoO(}T.
