A RESOLUTION OF THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY,
FLORIDA, URGING THE FLORIDA LEGISLATURE TO
MODIFY THE MANNER IN WHICH FLORIDA'S
CONSTITUTION CAN BE AMENDED IN A MANNER SO AS
TO DISCOURAGE EXCESSIVE AMENDMENTS TO THE
STATE CONSTITUTION; PROVIDING THAT A COPY OF
THIS RESOLUTION BE PROVIDED TO THE MEMBERS OF
THE PALM BEACH COUNTY LEGISLATIVE DELEGATION,
THE PRESIDENT OF THE SENATE AND THE SPEAKER
OF THE HOUSE OF REPRESENTATIVES; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the purpose of the Constitution of the State of Florida is to set forth
the basic principles and laws of the State, as opposed to using said document as a
vehicle normally reserved for legislative purposes; and
WHEREAS, the process for amending the Constitution has been abused by those
who are using the Constitution for purposes normally reserved to statutory law; and
WHEREAS, as an example, since 1968 there have been 126 proposed
amendments to the Florida Constitution; and
WHEREAS, the State of Florida should discourage excessive amendments to the
State Constitution by, among other things, whenever possible, encouraging the sponsors
of initiatives to pursue their objectives through statutory initiatives rather than as
Constitutional amendments; and
WHEREAS, a Select Committee on Constitutional Amendment Reform has been
appointed to examine the effects that Florida's amendatory process has on
representative democracy; and
WHEREAS, the Town Commission of the Town of Gulf Stream is interested in the
amendatory process being revised so as to assure that the purpose of the Constitution
not be diluted by amendments normally reserved to the legislative process.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA AS FOLLOWS:
SECTION 1. The Town Commission hereby urges the Florida legislature to
consider revising the process by which the Florida Constitution can now be amended so
as to discourage excessive amendments to the Constitution and so as to assure that the
purpose of the Constitution not be diluted by amendments normally reserved to the
legislative process.
SECTION 2. A copy of this Resolution shall be provided to the Palm Beach
County Legislative Delegation, the President of the Senate and the Speaker of the House
of Representatives.
SECTION 3. The effective date of this Resolution shall be immediately u pon its
passage by the Town of Gulf Stream.
