AUTHORIZING ~ CARTERET PLANNING BOARD TO CONDUCT A
PI~ELIMINARY INVESTIGATION AND MAKE A RECOMMENDATION
AS TO WHETI~R A PROPOSED WATERFRONT REDEVELOPMENT
DISTRICT IS AN AREA 1N NEED OF REDEVELOPMENT PURSUANT
TO ~ LOCAL REDEVELOPMENT AND HOUSING LAW, N.J.S.A.
40A:12A-1, ET SEQ.
WI~I~REAS, the governing body of the Borough of Carteret has
determined that it is in the public interest to consider designating and establishing
a Waterfront Redevelopment District within the Borough in accordance with the
Local Redevelopmem and Housing Law (codified at NJ.S.A. 40A:12A-1 ct seq.
"Redevelopment Law" ); and
WHI~REAS, pursuant to Section 6 of the Redevelopment Law, no area of
a municipality shall be determined a redevelopment area unless the governing
body of the municipality shall, by resolution, authorize the planning board to
undertake a preliminary investigation to determine whether the proposed area is a
redevelopment area according to the criteria set forth in Section 5 of the
Redevelopment Law; and
WHEREAS, the governing body wishes to assign the conduct of the
preliminary investigation and hearing(s) to the Carteret Planning Board pursuant
to the provisions of the Redevelopment Law.
NOW, THE~REFORE, BE IT RESOLVED bythe Mayor and Council
of the Borough of Carteret, County of Middlesex, State of New Jersey as follows:
1. That the Car~eret Planning Board is hereby authorized to
initiate and undertake a preliminary investigation and hearing(s) to
detennine whether a proposed Waterfront Redevelopment District
is a redevelopment area es required by Section 6 of the Local
Redevelopment and Housing Law.
2. That the Carteret Planning Board, following said
preliminary investigation and hearing(s), make a recommendation
to the Mayor and Council pursuant to Subsection b. of Section 6 of
the Redevelopment Law as to whether a proposed Waterfront
Redevelopment District is an area in need of redevelopment.
3. That a copy of this Resolution be forwarded to the Carteret
Planning Board for action co~sistent therewith.
